Advice Needed

I have a inherited a share in a small house i.e. from my grandfather to father and then me. My father's brother and his sister also have share. Now my father and uncle have died and my uncle's son is putting pressure on me to sale the house and threatening me that he will sale himself if i will delay. I don't want any dispute but i want to know what are my legal rights if i don't want to sale my share and want to keep it?

Dear Ahmad

There are two way. 1) Get the house evaluate from 2/3 person along-with your cousin and pay his share. 2) Sell the house along-with your cousin and distribute the amount accordingly.

Thanks to all who replied. I want to comment on few things

Curious, The two ways you told me seems logical and right but the thing is that i have emotional attachment to that house i don't want to sale it. At the same time i don't have much amount to buy it yet. While my cousin is threatening me on phone that he will sale or give the house to some one and will get the payment by his own if i will delay.

The house is in a village near Lahore and neither I nor my cousin is living there and we have rented the house and sharing the rent.

Presently Intaqal or transfer from father to me is not done. As per fard The house belongs to my Uncle, Father, Aunt. My uncle and father have died.

All i want is to get some more time to be in a better financial state to deiced if i can buy the house or not.

You are wrong my friend and your cousin is right. You are being selfish. If your cousin wants to sell this house then you should go ahead and sell it off and resolve the matter. There is no point in being stubborn and making this matter worse. Whenever there is partnership involved one has to think practically NOT emotionally. You may have emotional attachment with that house but it bears no value or importance practically. Why don't you think it other way round, what if you were in need of money but your cousin refused to sell it. What's your take on that? Look pal, in my honest opinion you have two options to resolve this matter. Either pay him his share and keep the house or sell it off in market and get your share. Best of luck!

I-14 Islamabad

Yesterday I visited I-14 Islamabad. Current entrance is from the GT Road (through Hajji Camp Road). Even Development work is not same as other Islamabad Area, but main Roads and street roads have been developed and some area is ready for construction. There are few houses being constructed in I-14/3, I-14/1 Areas. One Federal Government High School is build and running. Area is not flat and there are ups and down, but possession is available and owner can start construction today. You may get 30x60 plot from 18 lacs to 24 lacs depending on area. There are also some plots of sizes 30 x70 and 35 x 65, but most of them are 25 x 60 and 30 x 60. If you are thinking to build your house in next 2 years then this will be a good investment. Better to visit yourself and see the development work, but currently this one is cheapest option in CDA sectors in Islamabad. This sector is adjacent to GT road.

Please be aware of I-14 before putting investement. There are cases in which more than 1 owner showed up for 1 plot. My uncle got a plot but now a days he going through court for settlement because more than 1 owner showed up for the plot he bought in I-14. So please confirm before investing. Otherwise, this sector could have been developed by now.

I am just visiting Islamabad and not a property dealer. There are few property dealer on the spot who can help in purchasing. It is better to investigate and physically inspect the location before buying. 2nd transfer is safe option.

I have a 10 marla plot in bahria town Islamabad phase 3. Recently I got a notice for non-construction charges (2500 rupees per month for last two years). They want me to start construction before June 30, 2012 otherwise pay a fine of 150,000 per year. I know from other posts that BT charges 2500 per month after 3 years of possession but what is this 150,000 per year? Never heard about this. What should I do ? Anybody has experience like this.

I checked the notice again and it says "non-utilization charges". I cannot start construction by June 30, 12 and 150,000 per year is a lot of money. I am sure I am not alone with this issue. Any suggestions?

Have you got the possession of the plot and could not start the construction with in three years grace period? If so, you have to pay 2500 per month, if you did not get the possession the payment has to be 500 per month as maintenance charges but 150,000/ year is not understandable.

Bhatti Sb, Thank you for the reply. You are right, I have the posession and did not start construction in 3 years grace period. I have seen people mentioning 2500 per month charges which is ok. But this 150,000 is strange. Guess I will be calling the BT office tomorrow. Thanks again for reply.

I also got same notice. I do not have possession. I will visit BT office today or tomorrow and discuss this with their officials. It is not acceptable to pay this kind of charges for delay in construction.

I request the people from Islamabad to tell me about the prices of 25X50 single stoery old houses in I-10 Islamabad.

What would be the price of 25X50 plot only in I-10 if there is any left un-constructed?

In steet 55, I-10/1 a single stoery old house was sold for Rs. 34,00000 about two years ago. The prices should almost be the same now-a-days as well owing to nose down trend in the market.

Sorry no idea about G-8. In G-9/4, in November 2011, a cornor resiential plot 30 x 60 with extra land was finalized at 83 lacs.

Empty structure plot should be same price as plot price (around 40-45 lacs based on location) . IF you like the location and existing structure seems to be useful, then you may add 4-5 lacs for structure and 1 lac for utility.

price of 30x50 house in G-9/4 varies from 65 lacs to 90 lacs based on location. Most of the 30x50 house in G-9/4 are very old and they go by only plot price.

Please also ask the columnist why do we go after the government for every thing why does the public not take responsibility and deposit their money ONLY in Islamic Banks. If the public would take out their money from traditional banks they would disappear without government intervention. There are banks that conduct Islamic banking only and do not have any window for traditional banking.

Islamic banks would be more than willing to improve their sharia compliance in order to get more business.

Bahria Town Phase 8 - One Kanal Residential Plot

Salam o Alikum,

I wish to invest in Rwp/Isbd real estate with 2-3 million. My objective is investment for 5 years or so.

For the time being, I'm thinking of buying a one kanal plot in Bahria Town Phase 8 Rwp/Isbd. Good location and reasonable price would work for me.

Please contact me if you have plots at above location or in a position to advise better alternative opportunity for investment in Rwp/Isbd.

For 5 years investment, I suggest you to buy a 30x60 plot in G-14/2 or G-14/3. This will hopefully give you around 100% profit within 5 years. Bahria do not have this kind of opportunity.

If you are in Islamabad then you must start looking at newspapers and find a honest property dealer. There are very few options within this range. You may not be able to get any commercial property in CDA sector, but residential opportunities are available like G-14, G-11, I-14, I-16. For commercial properties you need to find one in Jinnah Gargen, Soan Garden or nearby societies. If this is for investment then buy a small plot and in good location. But if you like to build your house then 1k plot is a good option

@ Islamabad Property... Usman338 is asking for 1-Kanal. And 1-Kanal in G-14/2 or G-14/3 is not available in 2-3 million(20-30lac). Even 10 Marla starts from 45 lac. He needs more to buy plot in G-14. In F-17 he can get 1-Kanal and I think it is a good investment, construction has already started.
