Advice

Salaam

Need sincere & honest advice I was born and brought up in Dubai and now working here I recently (December 2011) purchased a 1 kanal file in DHA 9 from Lahore real estate on my mother’s name
The money was transferred though proper channel UBL bank from Dubai to Lahore in my father’s account.

Fewdays back my family in Pakistan received a letter from FBR or income tax dept. asking them to declare the source of money & payment of income tax I guess as I haven’t seen the letter yet

now my question is do I have to pay income or sales tax on 1 kanal file as I don’t have the land yet it’s just a file and secondly the money with which I have purchased the 1 kanal file on my mother’s name is earned in Dubai am I bound to pay tax on oversea earned money in Pakistan ?
as my mother is a house wife and my dad is retired after completing his services in Dubai and we don’t have any kind of business or source of income in Pakistan

" I am a house wife. The file is purchased from the remittences of my son who is serving in Dubai. In this connection, I am enclosing the bank statement of my husband bank account in which the remittence made by my son is highlighted. Regards "

Better consult a lawyer , just for 2000 to submit the reply to FBR and give the relevant documents to FBR, like, payment transfer receipt and copies of cnic of you, and parents.

My dear friends I am fine here in USA and hope you all are fine too.

From today I will insha Allah be able to post some messages/ answers here as I have a computer, internet connection and the phone lines activated.

I will be in USA min till end of Feb 2012 and perhaps a little longer.

Due to time differences I dont want to display my USA phone number here as I could be getting calls 24 hours a day from Pakistan and other countries (Keep in mind When its 12 noon in Pakistan its 1 Am at night in USA). I use to get 100s calls daily and didnt mind to answer a calls for friends even at 2 am at night. But now it will be very difficult for me to answer calls in USA at middle of the night. Houses here in USA are very small and if one speaks in one room people in other rooms get disturbed. I have my family here will me and kids need enough sleep time. LDA Plot Transfer

Hello,
I need some advise. My father has a plot in LDA but its under litigation for ages and God knows how long it is gonna take to resolve. As my father is old he wants to transfer that plot on my name. I need an advise that what are the steps do we need to take to transfer that property.

So far we have never seen that plot neither LDA has given possession of that property and it only exists in LDA files. :)

Appreciate your help on this.

Property transfer has to be made in LDA Office near Johar Town. Transfer process duration is 1-2 months. You have to apply for clearance first in the above mentioned office then they will give you a specific date.
Be aware of property dealer office directly situated in LDA Avenue scheme, they are just Liars & Fraudias.

Fahad sahib the plot can be gifted to you by your father. Litigation or possession of plot is not hinderence in it. Just go to LDA office and ask the procedure of gifting. There is no transfer charges on it, if at all if any charges are there, then it will be very nominal. Wish you best of luck.

Till the final order of the court LDA will never transfer the plot to any one. Look for a best lawyer and try to win the case in the court.

A Review- Commercial Plots Bahria Town Rawalpindi

The activity in Bahria Town Rawalpindi/Islamabad Commercial Plots and Commercial Plazas has been in full swing for the last 2-3 years. Almost all major dealers have been fully involved/participating in the sale purchase of plots and booking of commercial units getting handsome advantages in return to their marketing tactics. Simultaneously Bahria Town had been regularly introducing new commercial areas to attract potential buyers on progressive rates prevailing in the market. Resultantly a number of various Commercial Areas and Points have been lined up in Bahria Town Rawalpindi, especially in Phase 7, Business Bay and Safri Valley/Homes. Phase 1-6 have very limited Commercial Areas with limited sale purchase activities.

5. Mini Commercial Extension Phase 7
6. Spring North Commercial Area
7. Business Bay Commercial Areas(DHAI)
8. Safari Homes Commercial Areas(LINEAR)

10.Centre Point Commercial Japan Road
10.Rafi Block Commercial
11.Business Ave

The rate and popularity of above commercials differ from each other considering location, approach, current and future utilizations and of course the market trend set by the investors and dealers. Many of the investors including very expert builders and property dealers could not assess the worth of these areas and some of them are in real trouble especially in the HUB Commercials.
Some of these areas have proved to become the most expensive due to ground realities and have gained many folds. Lack of vision and limited information is leading new buyers/investors to select a wrong place mainly due to attractive advertising campaigns by the builders and dealers.
In the above review I have left out Phase 1-6 Commercials. Question can be asked by the interested one. Beside above the Commercials areas to be developed in Phase 8 and some of the Safari Valley are still to be floated by Bahria Town.
I must appreciate that Bahria Town has done excellently well in developing these commercials and few of these are humming with lot of Business activities and world famous Brands are being attracted in a fast speed.

In phase 4 of Bahria Town Rawalpindi the main commercial block, other than a few shops at 2 to 3 locations, is beside the Theatre & Petrol Pump on Road A. Given the size of Phase 4 & the number of houses in this phase this commercial area seems to be insufficient.

Pl.advise.

1. Is there a possibility that Bahria will increase this commercial area or introduce a new commercial area in the vicinity of this area.

2. In Lahore LDA has allowed the conversion of residential plots to commercial plots in a number of colonies belonging to LDA & Privete Developers. If we look at the map of Phase 4 we can note that Residential Plots on both sides of road A (dual carrigeway) are best suitable for such a conversion. Such a conversion will neither spoil the beauty of this wonderfull development nor interfere with the peacefull living in residential areas. By doing so Bahria will meet a requirement & earn money as well by charging the difference between commercial & residential rates from the owners of plots allowed to be converted.

I am not aware of such a practice in Bahria Projects. Kindly advise your opinion. I also invite other visitors of this site to comment.

Dear Abdul Salam Sahib. You have very nicely elaborated the Commercial areas of Bahria Town Rwp of Phase 7 & 8. It shows your insight knowledge of the area. Though you have not introduce yourself yet I think you might be one of the leading investor, builder of Bahria Commercial.
I quote an extarct of your narration below:-

@AG.....Converting main Blvd plots into commercial always remain an open choice with the builders as done by PWD Housing Scheme adjascent to Bahria. Till today there is no such news. BT is definitly aware of shortage of commercial plots in Phase 1-6 and thus has certain addition in phase 4..but it is just so so. However Bahria Business Centre will meet all the requirement which is located at the juncture of Phase 1,2, 3, 4 and 5.

Dear AH!....your opinion is valuable. This is the third time commercial plots of GT Road in DHAI 2 has been floated( previously Alghurair and then DHAI themselves had tried without any results). Now Alghurair/DHAI are selling these plots through property dealers offering them a very attractive and huge advantage....They have started promoting and will face no problem to sell to their investors. I am newbie to property stuff. And intended to buy a 10M plot in phase 8 ext. But I received mixed reviews about about bahria town. Can you please help me in making this decision. Specially, people are real concerned about legal transfer of land, or any other legality issue if Malik Riaz has been busted in future for some reason, or society declared as bankrupt or something else.

i just want to ask that is there any legal value of Mukhtar-nama in Pakistan ?

Tax department has some criteria through which it decides monthly rent of some property. The notices are sent on the address along with Chalan form payable to National Bank Ltd. In Lahore these notices are being received nowadays.
I understand that property tax is not paid with income tax. You will be paying income tax on the income of rent but property tax is a different matter and it is paid through prescribed form.

Your English is much better than mine. Language is for communication and it this purpose it being fulfilled then nothing to worry about.
You have not mentioned the size of plot on which your home is constructed.
You are not supposed to contact income tax office for paying property tax. For this purpose you need to contact Excise and Taxation Department Rawalpindi/Islamabad. Its contact number is 9271926.
If your plot size is about 5 Marla then forget every thing as it is exempted from property tax.

Thanks again about your prompt reply. My plot size is 20x40 and I am enquiring about the rental income tax property as I rented out my lower portion. Last year rs 150000/- was exampted to tax. I heard that in current budget government increase the limit from 150000/- to 300000/- as my rental income is 960000 per year. could you please advise me about it.

Always welcome.
Your home is exempted from property tax. This is the reason you had not received a notice in this regard.
Now the matter under discussion is income tax from rent as well as from other sources. You will need to deposit tax (if any) with your annual return.
Whether your income is exempted from tax or not, I could not say any thing about it as my knowledge and information is very limited in this regard. May be some other friend on this page will guide us.

Dear Pardesee, You are right. In the recent budget announcement, incom ceiling upto 3 lacs is exempted from income tax. Previously it was 150000/-. If your total income including rent of the said house does not exceeds Rs. 300000/-, then there is no income tax to be paid by you. Regards

Renting home to Goverment Department

Aslam o Alikum, we are approached by one of the government department to rent full double story house for 3 years contract with one year advance payment.

Considering this is government i guess the risk of non payment or releasing the house after 3 year will be minimum?

Is there anything else for me to worry about?

I am out of Pakistan, is there standard contract, is it worth involving a law firm or real estae, please share your thoughts?

There is always chance in this case that the first payment might be delayed due to clerical procedures, confirmation from department etc. It also depends on which department you are talking about. I have experience with Wapda, where visiting Wapda House several times it took still more than a year when we received the 1st payment. Off course it is bit secure as Govt. department dont run away. More at that time we paid almost 25% Excise Duty on monthly rent.

Dear Irfan,

I really had a very bad experience by renting the house to the Government department. Your house will be used roughly and the damages will be higher than the rent what will you collect for entire three years. Keep in mind that there will be no maintenance from the tennant since it will require a lot of formailties to get it approved from the government. you will be solely resoponsible for the maintenance.

I think you should make a video of the house prior to renting it out and make them responsible in writing to give you the possesstion at the same position after the contract expired. I am also overseas pakistani, but I myself decided not to rent my house to anyone regrdless how much they offer. Because at the end you pay more than twice of the rent you collected to bring the house back in the same condition.

In this case they are offering us 1 year advance payment !!!, yeh wear and tear i have to watch out !! but if i get advacnepayment should e ok

one factor is since this is goverment so i feel secure that they will not do QABZA on my house?

The department is also part of goverment charity program, so i also am more willignto give me house (not only for money) but knowing house will be used for a deparmtent which will serve needy...

I might ask tem to give a deposit say 3 month's worth of rent as security for wear and tear.

Irfan Sahib, seems alright. No need of involving anyone. What you have to do is to get Rs. 50 or 100/- Stamp paper in Kachehry and ask from the stamp papers wala that who is making the rent contract over here.Go to him and he will do the needful for you. It should contain following clauses in addition to the standard format:-

1.Period of contract 2. Rate of rent 3. Mode of payment of rent 4. Security amount (refundable after clearance of all bills, damages etc, if any )5. Notice of vacation period 6. Purpose of rent ie residential or commercial etc etc as per agreed upon by both the parties.

Owner and Rentee signatures + Tow witnesses signatures (One from rentee side and one from Owner side) and then Attestation by Notary Public. Keep original stamp paper with you and hand over photocopy to the department.

This process will hardly cost you few hundered Rupees like Rs. not more. Wish you best of luck

I think you as well all others who speak against the DHA themselves realize that one of the most potent housing schemes in this country is DHA. It is very unfortunate that the property value in the entire country is seeing decline or stagnation. If the property business was booming as good as was in 2005, the DHA property worth would have risen far more than any other housing scheme even if there was no development work. I think it should not be bothering us as to who is earning what from DHA Valley or any other joint ventures. We need to see as to what we are gaining. Unfortunately, those who have invested in DHA Valley are seeing a huge loss but believe me it is just matter of time. While it may take a bit longer than expected, but once DHA Valley will be developed, your all losses would get covered up. In fact you will InshAllah gain a lot.
Why I am so excited about merger of AGOCHS with DHA is for simple reason. The worth of my property with AGOCHS was just hovering around 13 to 15 lacs. With DHA tag on it, the worth has doubled. It is expected that the same plots would be of worth no less than 30 lacs. It is simply because of extremely good location of the AGOCHS-II i.e. on main GT Road right in front of DHA-II. The worst plot of DHA-II is still worth more than 45 lacs.

I have personally driven all along the AGOCHS area. While it is true that the topography of the area is not level but then the climbs and slopes are very smooth. I believe that one hardly finds absolutely leveled area in Rawalpindi/Islamabad area and of course AGOCHS-II is no exception. We all know that the Bahria Town Phase-II Extension area was having around 30 feet ditches but you see now, after development, it is a perfect area to build a house. I think skepticism about non important issues should be avoided.
As regard to the retaining the AGOCHS plot for future is concerned, if one could afford to pay additional development charges that DHA is levying, the plot must (R) must be retained. Within two to three years when the area would be developed, its worth will be though not equal, but very close to DHA-II plots. And on top of all, a perfect place to live.

Whether you have paid any installment or not, as long as your membership has been passed onto DHA, you will get a DHA plot. Now all the installments have to be paid to DHA after they give u the membership number. You may please get your membership checked through Phone No + Ext 127.
DHA is asking for additional 10 Lacs as development charges.
It is quite premature to give a time tag for the development of the area but could be no earlier than 2015 keeping in view the pace at which DHA is working on its projects.

I visit DHA office today. There is no statments or any of your documents available in DHA record section. They are just taking undertaking by allottees that they paid this amt of money and remaining instalment are this or watever. They even dont have statment of instalment. You are one to fill the Stamp paper available from DHA office outside mentioning your remaining amount against the plot and paid amount also you will undertake that you will pay additional devlopment charges of Ten lac along with membership fee 27500 against each plot later when DHA will ask you to pay in future. This is the whole story.

I think I owe apology to all members of AGOCHS whom I did not update with development of merger process. I feel very sorry to inform that DHA has asked AGOCHS management to take away all the documents of their society and return only after all anomalies were removed. AGOCHS is not willing to do so and as informed by one of their officers, and they have moved the court to resolve the issue. Now if things go to court, intricacies are hard to resolve in quick time. LET'S ALL PRAY TO GOD TO GET US OUT OF THIS UNCERTAINTY.
