Delays in Developing Plots

I've taken 3 plots in Phase 9 of Bahria Town Rawalpindi. These plots were fully paid by me in the year 2007. Although BT mgt announced to merge in Phase 8, but I did not opt as assurances were given that development in PHASE 9 is in full swing. Upon my visit to BT OFFICE in 2012, I was informed by the rep of BT that our Customer Care dept has mislead you. BT MGT alloted two plots in sector F-5 and one plot in sector K of phase 8.
Recently I've visited BT OFFICE and found that there is litigation in sector F-5 & now they will relocate to a new developing area.
In case if I would not have gone to their office, I would not have known the status of my plots. Kindly advise is this the way BT handle its customers.
Is there any legal responsibility to hand over plot - ready for construction within a stipulated time. Kindly suggest what action I should take.
Your inputs in this regard will help me to make a correct decision.

Coming to your questions:

Yes! this is the way BT handle its customers who invest in installment projects. Few of them are lucky to get everything in order.

2. Is there any legal responsibility to hand over plot - ready for construction within a stipulated time?

No, Brother there is no legal responsibility. Please go through the terms and conditions on the back of application form.

I wish that Bahria Management understands the problems and resolve the issue.

Is there no responsibility of Bahria Town to develop plots within a specified time limit. I've invested in Phase 9, which was subsequently transferred to sector F-5, Phase 8, I've paid full money more than 8 years back, but still no development in this area. According to Real Etate Agents, heavy machinery was transferred to Bahria Karachi. This is the reason for slow progress. Any justification requested by real estate agents for this irresponsible act of Bahria Town?

Compare with EME Phase 2? Well EME Phase 2 is still in thin air with all those unknowns and very little known. It has been amongst the worst performers in the recent real estate boom and has so bad fundamentals that many average societies can easily outperform in future ROI terms. It is at least 10 to 15 years project. (DHA 9 proper is way better investment than EME Phase 2.)

Whereas NFC 2 is on ground with all the land in possession and boundary walled. All main boulevards, main roads are already carpeted. Contract for remaining development to be awarded soon. Remaining development work of initial blocks should be completed within 18 months with DHA standard (under ground utilities, wide road network, all facilities within society, gated, secure, controlled entrance, etc.) Its main feature is dual approach from Multan road and Canal road. In future NFC 2 will serve as gateway to Bahria Town from the Multan road side. NFC 2 is safe and secure society. No qabza group there. Your title is as secure as in DHA. And like DHA you can buy while being abroad.

NFC 2 price will most likely always remain below Bahria Town price because Bahria Town is a GREAT BRAND. In fact Bahria Town as a brand is much more valuable than DHA brand and that difference is widening day by day. Had Bahria Town Lahore location been closer to DHA Lahore, Bahria Town plot would definitely have been priced way more than DHA Lahore plots. ( BTW NFC 2 development standard which can be witnessed on ground is equivalent to DHA development standard but not even close to Bahria Town development standard.)

Currently average one kanal plot price in Bahria Town is around 1 Crore. NFC2 average price is around 32 Lacs. Due to NFC 2 location which is better than most parts of Bahria Town Lahore in the coming months and years it can easily rise up to at least around 65% of Bahria Town plot as the development is in progress. i.e. If Bahria Town plot next to NFC 2 will be around 1 Crore, NFC 2 will be around 65 Lacs. And when BT plot will be worth 2 Crore, similar NFC 2 plot will be around 1 Crore 30 Lacs. That 70 Lacs premium for Bahria Town plot will be for Bahria's BRAND POWER.

BT mgt has transferred my 1 Kanal Plot to sector FV & a 10 Marla plot to Sector K of BT-8. My both plots were fully paid i.e. appr Rs14,62,000/- & RS 812,000/-. BT has requested development charges of Rs 212,000/- & Rs 97,000/- respectively. Kindly advise the following:
-What was the BT rate for 1 Kanal and 10 Marla plot+Development charges.
-Location of Sector F & K taking future development ?
-Present market rate for these two sectors?
-Expected no of years to live in these sectors?

New location from sector perspective is good.
About 11-13 lacs in k for 10 marla depending upn location.
If I am not making mistake on sector F5, 1 kanal should be b/w 25 and 32 lacs. If its sector "F" only then 1 kanal around 20 lacs.
Liveable in 3-5 yrs.

BT Phase 9 Swap to Phase 8

BT Rwp has announced that BT9 allottees can exchange their plots to BT 8. Kindly advise short term as well long term benefits. Further if BT 9 is fully paid, will their be refund as BT 8 prices I believe were lower than BT Ph 9.
