As salamu alaqum,
I have to write about a serious issue regarding rental of my house in Wapda Town, Lahore.
I gave it out on rent; on 1st January 2011, therefore the 11 months agreement will end on 30th Nov. This month when a went to collect the rent I gave my tendent a written notice for one month, I wanted him to sign the photocopy so that I have a receiving from him. He insisted that he would NOT sign the recipt of that notice. Moreover, he said that he could not vacate it in September. He would do so in October otherwise in November.
I am having some doubts that he will not even vacate in October, but the fact is I have to shift back to my place as soon as possible.
I am therefore seeking very serious and helpful advice how to resolve this issue amicably.

Contracts are signed to be honored not to be breached without valid reason. You have committed to rent the house to him till end of November so why are you serving him notices to vacate early? Is he not paying the rent? Is he damaging the house? Is he making structural changes in the house without your permission?
There can be a termination clause in the rental contract which explains under what conditions the contract can be terminated by either party. Does the termination clause in your contract allow you to terminate the contract at any time without reason with just one month notice? If not then YOU are the one creating problem for your tenant.
You can give him notice to vacate upon completion of the contract period and if he continues to stay, then you can start the legal eviction process. If your tenant has agreed to vacate in October he is an exceptionally nice guy. My helpful advice to you is to go apologize to him. |

Dear MAS,
I wouldn't be able to act upon your advice as the agreement has a clause for one month notice from either party.
If my tendent had wanted to vacate earlier, I wouldn't mind.
