Residential Plot

Hi

Can I find 1 kanal residential plot in
wapda town lahore phase 1 block E1 which may
be free from pool,electric wires,manhole and away from drainage.As todate I did not see such plot.
If some have the same one please write.

Dear All,
As salamu alaqum,

I have to write about a serious issue regarding rental of my house in Wapda Town, Lahore.
I gave it out on rent; on 1st January 2011, therefore the 11 months agreement will end on 30th Nov. This month when a went to collect the rent I gave my tendent a written notice for one month, I wanted him to sign the photocopy so that I have a receiving from him. He insisted that he would NOT sign the recipt of that notice. Moreover, he said that he could not vacate it in September. He would do so in October otherwise in November.

I am having some doubts that he will not even vacate in October, but the fact is I have to shift back to my place as soon as possible.


I am therefore seeking very serious and helpful advice how to resolve this issue amicably.

Contracts are signed to be honored not to be breached without valid reason. You have committed to rent the house to him till end of November so why are you serving him notices to vacate early? Is he not paying the rent? Is he damaging the house? Is he making structural changes in the house without your permission?

There can be a termination clause in the rental contract which explains under what conditions the contract can be terminated by either party. Does the termination clause in your contract allow you to terminate the contract at any time without reason with just one month notice? If not then YOU are the one creating problem for your tenant.

You can give him notice to vacate upon completion of the contract period and if he continues to stay, then you can start the legal eviction process. If your tenant has agreed to vacate in October he is an exceptionally nice guy. My helpful advice to you is to go apologize to him.

I wouldn't be able to act upon your advice as the agreement has a clause for one month notice from either party.
If my tendent had wanted to vacate earlier, I wouldn't mind.

House purchase in Lahore

Salam all,

I live in Canada but visit Pakistan once a year so taking care of the house/ tenants is the biggest concern because my friends can only help out so much. Can anyone advise me as to where I should purchase a house in Lahore and with a budget of approximately 70 lac will I be able to get 1 kanal house in a good area i.e. Valencia? Wapda? 10 marla in DHA?

Any advice by respected CMY and other members is well appreciated! Thanks

In DHA Lahore you need min 80 lacs to buy a 10 marla house.

It is suggested that you buy a house in DHA Lahore or Bahria Town only as these places are Qabza groups free.

Dear Saeed Sahib,

In your budget, a slightly used 10 Marla House will be available in Wapda Town Lahore. It’s a decent society with all amenities available there and rental return and demand are also reasonable. 10 Marla house can fetch your monthly rent of around 35 K.

I m really shocked to see Dear CMYs’ comment that only DHA & Bahria Town is free of Qabza..... or because LRE deals in them only!!!!!!

I was recently in Pakistan trying to purchase 1 kanal house. I did explore wapda/valencia/nfc and surrounding society.
In wapda one kanal house in okay location will cost you around 125 Lacs(you can find close to nala or houses requiring renovation around 100 lacs)
Valencia has many house of 1 kanal new built by contracters in Market average final price is 90-115 lacs,most of these house has low quality materials fitted.
NFC has rates similiar to valencia.
In 70-80 lacs you can try to get 10 marla old house in wapda which may need renovation. new 10 marla houses(good quality materials) are in range of 90-100 lacs.

My son is doing Mechanical Engineer in Nust (1st year) and coming Lahore next week for 2 months summer vacations. He asked me to check any institute from where he could get course of PRO-E.
As I am not technical person, so would like to take advantage from this forum. Can you please recommend any institute preferably nearby by Wapda Town, Lahore) to get this course.

I propose that your son should open google.com & search "PRO-E Courses in Lahore." There are quite a few institutions in Lahore, not very far from your area, that offer short courses in this software.

No doubt, Pro-E is high end modeling package. But he should not restrict to Pro E only. Solidworks, Unigraphics and Catia have the same capabilities as Pro-E.

The best thing is that Soldiworks and Uni-graphics have build-in tutorials for self learning. I'm not sure about Pro-E.

Question Regarding giving a house on rent

Dear Members,

I want to ask a rather important question.
I plan to rent out a single story neat house 10 Marla but what are a chances of "QUABZA"???

This thought bothers me a lot, as this house is my only property asset, and it worries me if such a thing happens to me.

In addition, there is the COURT STAY thing. That means when u want your house back the tendent may get a STAY from Court and you would have no option but to let him stay in your home, although you may need it now.

My house is located in Wapda Town, Lahore, if that help.

Hoping to get some serious, intellgent and knowledgeable replies.

1. Selection of tenant is the most important. Usually, the retired people and the company hiring for their employees are the best to rent out the house.

2. Terms of the rental agreement is very important. A tenant can not take stay if an agreement is drafted according to legalities carefully. There are lots of technicalities in making an agreement which a layman does not understand. Only a lawyer can tell you those complexities how an agreement gets void automatically in case of failure to pay rent or comply with the agreement thus rendering anyone unable to take stay from the court of law.

3. Do not ever take rent in cash, always make a clause in the agreement binding tenant to deposit the rent in your given account no., only the bank deposit slip should serve as proof of payment of rent.

4. Make agreement only for one year and rewrite it on expiry.

I adopt this method, while renting out my house and shops and never faced a problem from tenants.

Rental contracts are pretty much regularised and officially documented.
No one has much of a choice to make changes in the way one pleases!
All clauses and rules are pre-defined and have legal standings.
For example, in Islamabad, normally contract is for 5 years and after every 3 years, you can increase only 8.1 per cent per annum. After 5 years, all is void and you can legally re-negotiate your rent from scratch, based on market forces.

Transaction through bank legally covers both, the landlord and tenant. For example, my rental agreement states that if tenant deposits the rent after 5th of each month then this agreement shall stand as canceled forthwith, thereby I can force him to vacate since in this case no agreement exists in the eyes of law. The bank transaction is the solid legal proof to this effect.

@Rental Adisor:
Kindly read the Rental Act and the legalities of an void /voidable agreement and then discuss here. What all you have written is the only market practice which has got nothing or little to do with law. I have never contracted in property matters based on a standard ready made agreements available with Ashtam Froosh which are only good for the tenants to take stay as and when they wish.

"Rental Contract" and "Rent Agreement" are two different things more or less having 20 legal differences. A rental contract is made for one year or more and legally it is required to get it registered with rent controller of the area for which a fee has to be paid. Wheres, in case of rent agreement of 11 months, its not required to get it registered with rent controller and as per law it is not rent contract as such but an agreement between the two parties.

I got a standard rent agreement from stamp frosh (11 Months), and on it, clearly stated that the tendent cannot take a stay from court.

But I dont know for sure, it has any "VALUE", because as I understand, the Paki Courts favour TENDENT :)

This sentence does not have any legal value at all. Rather this is the best sentence which perfectly worsens your case for being contrary to the land of law. Because you can not deny anyone of his legal right as per the constitution of Pakistan. As long as an agreement is intact either party can take stay. Try to have a clause which makes the agreement void by a mutually agreed upon clause.
Paki Courts do not favor anyone this is we who do not have understanding of the law.
