Who Owns Land of DHA Plot

Dear All
I am asking an important question about the absolute ownership rights of the plots in DHA. Is Allotment of the plot has the same ownership rights as the Registry of the land. Can someone please provide more information about this important aspect of the land ownership of plots in DHA. Thanks.

A valid question as DHA is located in Cant area and Cant leases only.

All properties are handed over to DHA Lahore witha legal registry and free of cost by land owners so absolute ownership will be person getting plots against their land given to DHA Lahore.

BUT still its DHA Lahore legal branch that can guide you more accurately. Please call them and update us with feed back.

This question was asked 30-35 years back and understanding was 99 years lease, As Some residential plots were on Lease area but now DHA is working like a cooperative society and holders have freehold rights.
DHA is registered as Cooperative society act and this was on front page until 3 years back, Later it has been removed as it may create impression that Authority is something superior to cooperative society. However Pakistani Law does not permit any Housing "Authority". In all cases in Court DHA represents itself as Cooperative Society. The Most Famous case in this regard was In DHA 7 where planning division handed over Land to DHA in Lieu of Files. As per Law of Land acquisition by Cooperative society The Formula for swap of Agri Land vs Developed Plots is 1:3 with no development charges, As we all know DHA issues 1:4 Files with due development charges. The Case continued for years I don't know want was agreement Finally.

Thanks to CMY and Habib for giving further information. Though Habib has mentioned that plot holders have freehold rights, however no where on DHA website, this information is given. If anyone from DHA is reading this please confirm this assumption of freehold rights of plots.
On the other hand I suspect that most people who have bought plots in DHA (including myself) still not sure what they have bought, a leasehold plot or a freehold plot.
It is requested to DHA, please clarify this. People who buy plots in DHA by paying millions have a right to know a clear answer of this question. Thanks.

What a rubbish and foolish question? Did DHA mentioned anywhere that we have buying leasehold or freehold plot?
As CMY mentioned that DHA is buying land free of charge from land owner so there is no question of lease. Another point is that we have paid the development charges. Important thing is to remember the power of people.
Need of the hour is the unity if we are united then we will win else destroyed.
I have observed that we Pakistani have leg pulling and negativity in our blood let us change the society.

KSA888 - This is neither a rubbish nor a foolish question, this is an important and valid question, which unfortunately has not been answered by DHA or any of the replies above. It will be better to know the exact and correct answer of this question now rather than in the distant future when one day DHA plot holders may suddenly start receiving notices to renew the lease of their plots by paying x millions or face huge fines.
Asking for a clear answer of this question is not going to impact on the unity of the nation, rather this will remove any doubts we may have.

So what rights you get when you get registery ? What are the points you are confused with ?
Its funny that you think DHA lease land to owners, its not leased. As CMY mentioned, its bought from agri owners etc & then sold to public. DHA in any way cannot ask lease, cannot forcibly acquire or change ownership.

People like Saeed Sb are common in our society who deliberately create confusions among people, either they are looser or want to get some benefit.
Best place to ask such questions is DHA management which is very clear about the general public ownership.

Please be assured that I do not have any negative intentions. All I wanted was a clarification on the question of exact ownership rights of plots in DHA. This is because, on DHA letters which are given to plot buyers , ownership right is referred as ‘Allotment’. If you read the definition of an ‘Allotment’, it generally means, “a piece of land given to someone on rent”. So an ‘Allotment’ is not the absolute ownership of the plot. So what exactly meant by DHA, when they say ‘Allotment’, this was my query. But it seems, most people (including myself) on this forum do not know the exact answer and some even started doubting my intention. I perhaps need to try DHA directly, though I doubt they will answer this question clearly. Anyway, I will not post any further reply on this topic, in order to close this discussion, as some people do not like to discuss difficult questions. God bless you, all the best.

This is burning question and will arise in next century when our next generation will pay through nose bcoz we are getting lease and not ownership.DHA bahria and other societies after expiry of lease have right to kick out the laesees and their legal hiers.

I have a question and I need guidance and advice from all of the experts. i have a house in Wapda Town, which i am selling. a property dealer gave me 25 lac and promised to give balance payment till 30/07/2015. i know he is trying to find customer till then. the thing is i was getting little suspicious so i asked from few people and some of them told me that this property dealer is a very "chalu" guy. he will take stay order on his bayana.

I want to ask is this possible?? what i heard before was that if full amount is not paid within the given time the bayana stays with the seller and seller can sell to anybody else.

Need advice and suggestions from experts.

Unfortunately most of properties are sold like this,if you are in pakistan and not overseas then there is no issue. keep the possession of house. Ask him to pay full amount in time. in case he cant find buyer you put an application in wapda town society office that this deal was done and still payment not arranged.MAKE SURE ALL PAPERS OF HOUSE ARE READY FROM YOUR SIDE. if more time passes then tell him that you want to cancel deal And see his body language. if he does not agree on some terms then fie case. keep his 25 lac and keep possession of house and tell your lawyer to keep using delaying tactics.

if you did a deal in good price then it is quite likely that he will find buyer.

Moiz,I understand yr position, but first stand firm, and follow the advice of Mr. Jameel, and involve WAPDA Society as well. Further send legal notice through yr lawyer (not on yr own) for strict performance of the 'bayana contract' within specific date & time with damages otherwise you have absolute legal right to own, possess or sell the house bearing no obligation or charge on your part. A little fee to a skilled lawyer will do the job but do not panic now. Best wishes.

This panic state is first sign of Loss, Best is to settle these issues out of court. one of My friend who lives in UAE sold his 2 houses like this. In First case in Allama iqbal town he kept waiting fro more than 6 months and then Biana was revered without any loss to nay party. You will have no financial loss, the terms of payments are clearly written on biana paper. How You can get Loss if you arer eady to sell in specified amount. The Only thing which can give you loess is if you change your mind that I don't want to sell.

I have read similar news on GEO tele-tape and feel that it will be a disaster for property dealers and real estate prices. Mr. CMY is requested ask like minded dealers to approach the Minister and try to talk him out of this.

Govt. should encourage investment in all sectors for the good of country's econonmy and should avoid taking steps which would force people to hold on to their money rather than investing it.

I am totally disagree with the figure only 5% pay taxes. Its only 15% pay income taxes, other yet pay taxes such as GST, W.H, Surcharges, Import Export Taxes & so o on.. & at the moment everyone pay around 40-60 of their whole expenditure only on the tax. But yes those who are paying income tax are less.. just for example, at the moment all pakistani who have transport paid around more then 350% (i am not counting current increase), similarly, every person who use telecom pays 36% tax, every person who just buy general daily use utilities he pay around 15+6% tax.. We have to demand from the government.. also, have u seen our government cabinet 81 ministers (excluding PA, Assts, Secties etc) just imagine even a country like USA don't have that huge cabinet. Similarly we have nazims, as well as civil government for every district, and pakistan has around 144 districts, so just imagine how many they absorb..

WaqarBhai, you are right, there are many sorts of hidden taxes in Pakistan. In USA and other european countreis, if public pay taxes in reward they also get facilitis. I am not against paying tax, but our tax departmens need lot of reforms to be updated. I further agree with Waqar we do'nt need too many ministers, secrectires, nazims, and useless civil servants without their positive output.
