I really appreciate fast successful meetings our FBR Team, Mr. Haroon Akhter and Minister for current Tax Policy. Why did not this respected management utilizing goby from other countries like Europe, Australia, USA or Canada. I 100% agree with Rana, there should be NRP account Like in India NRI account, It works like Legal off Shore account and helps that Country,
Honestly I have to transfer money in Pakistan from UAE but looking for Off Shore account as I don't know where my Kids Need this Money In future, UK Canada or Somewhere else. From Pakistani account it is difficult to transfer Money out though not impossible,
I will appreciate if Govt can establish NRP account of same or even more functionality than NRI account. It will be a great help for overseas people and Pakistan itself.
Already Govt initiative for Pakistan origin Card have helped a Lot many overseas Pakistanis, They can still fell they are in Home and buy property and Come anytime when they want.
I will ask Forum Members if they have experience in transferring Money out of Pakistan from Foreign Currency Account, what are the regulations? and How lengthy is Process?.

I also have no problem if India's business community didn't get any opportunity to get into politics or rule their country. A good businessmen will ALWAYS keep his own business interests at top. and that is what Nawaz is doing. Sacrificing country on his personal business interests. With India, KSA and Turkey. Whereas our Finance minister Ishaq Dar has business interests in Dubai real estate. When you elect businessmen to rule you then you get sudden change in policies just 2 days before budget approval (policies kept secret again to safeguard their own business interests.) If we go back to Nintees we know that same businessmen rulers made special laws for for 2-3 days just so can take advantage of them. Thats what you get with businessmen rulers.

A question to ponder!

It is being said that the Govt. and Real Estate representatives are negotiating a deal to save the real estate sector, but I think the currently available information suggests that the RE Reps are ignoring a major factor that would be more harmful for Real Estate business in the short and long term

As it seems, there will be an agreed "Fair Market Value" on the conclusion of negotiations, which will be declared as DC Rate.

It means that an investor will have to pay 5% (3% Stamp Duty + 2% CVT) on DC (Fair Market) Rate at the time of purchase, and 2% Withholding Tax at the time of sale of a Plot.

In addition, investor will also pay 1% commission at the time of Purchase, and 1% commission at the time of sale of the same plot.

Moreover, about 1% Transfer Fee/Documentation Charges for the transfer of the same plot will also be paid by the investor.

This means that an investor will have to pay about 10% of Fair Market value (3+2+2+1+1+1 %) on a single plot investment/deal. It means that an investor will not be able to sell a plot until he covers these 10% extra charges.

Such a scenario is bound to damage the real estate market until the percentage of Stamp Duty, CVT, and Withholding Tax is not reduced reciprocally in accordance with the increase in DC Rate.

For example, the currently announced DC Rate of DHA Phase 9 Prism is 30 Lac per Kanal. But if the DC Rate is increased to say 100 Lac (approximate Fair Market Value) per Kanal, then the Stamp Duty + CVT + Withholding Tax (3+2+2 = 7%) will increase from Rs. 210000 (at current rate) to Rs. 700000.

This situation will sharply reduce the number of transactions. So I believe that the Real Estate representatives must take up this matter on top priority, rather than just focusing on Amnesty for Source of Income that perhaps will benefit only the major players in the business rather than the real estate business in general.

Fair Market Tables will be developed and agreed separately. DC Rate Tables which is the domain of provincial government will stay separate. CVT and Stamp Duty being provincial taxes are calculated based on DC Rate Tables and effective July 1, 2016 DC rate is binding for the aforesaid provincial taxes. For Filers, effectively the impact of Advance Tax of 1% on Seller and 2% on Buyer will be calculated on Fair Market Value will be NIL as these are adjustable. However, for Non Filer it will be a big impact i.e. 2% on Seller and 4% on Purchaser of Fair Market Value as for him it will be non adjustable unless he becomes a filer; apparently the intention is to increase the cost of doing business for Non Filers. Hope it clarifies.

Abdal Sb, It will be unrealistic to have two rates: 1) DC Rate 2) Fair Market Rate, because once you declared to have purchased a plot at DC Rate, you will have to pay 10% Gain Tax on the difference between DC Rate and Fair Market Rate at the time of sale, which will again be a huge amount.

1. Let the dust settle after new taxes and Let the market take clear direction (up or down)
2.
Files and plots far-away from possession might be little risky but they can give higher return (if market direction remains positive)
3. On ground plots or near possession will be safe but will give lesser return
4. Try to find options that are not overpriced and have good margin to groom
5. DHA Multan, SuiGas2, are good and still lot of room for growth.

If you are looking to invest for 2-3 years then
DHA Multan one kanal file is the best option. When you will be here in Pakistan the file rates for DHA will be very low because its launching was expected on 24th July but it has been delayed to January 2017 aprox. So you can buy the file on low rates and retain in for 2-3 years to get benefits.

I would say you should start construction on phase 7 plot. There are more security issues now in GCC/middle-east than in Lahore. So no need to go for Raya.

if security is primary concern then go for raya. but if yu want more growth price wise then phase 7 is better. but Dha phases are open from all sides with no entry/ exit check points. plus phase 7 has got many villages which can serve as hide outs for robbers. also Q block is nearby barki road which will also be a concern as people can easily flee after a robbery etc. dont mean to scare you but had a personal experience of robbery at my house during day light in DHA (and our house is infront of a water tank which has some DHA offices also and 24/7 security guard sits on the gate of that water tank)

In Australia, u will get the benefit of leverage i.e by paying AUD 175 k, u will own property of 700,000/Though u will incur interest expense, but however u will be having equity in each year, by paying part of EMI towards principal repayment. ( i have not accounted for any capital gains in this)
However, as mentioned by Jameel Mughal, Pakistan property has its own capital gains charm. If I were you, i will diversify to hold at least one property in AUD, if i do not have any RE in Australia.

The government on Thursday agreed, in principle, to offer the biggest ever tax amnesty scheme in the country’s history, which will whiten a whopping Rs7 trillion untaxed and black money currently stashed in the real estate sector

Finance Minister Ishaq Dar and representatives of the real estate sector discussed the broader contours of the amnesty scheme, which will be implemented by either promulgating a presidential ordinance or introducing a bill in parliament, said a government official. It was the third round of talks in last four days.

Taxing real estate: Govt forms body to address concerns of property dealers

After the talks, Dar told media that the next meeting will be held on Wednesday in which real estate sector representatives and FBR officials will share their respective property valuation rates. “On Wednesday, the two parties will reach a consensus as things are going towards positive direction,” he said.

Real estate sector representatives would bring their own property valuation rates of 18 main cities and FBR officials will share their rates. On the basis of both the rates, valuers will work out ‘consensus rates’. These determinations then will become the base for giving amnesty on past transactions and calculating taxes on future transactions, said the officials.

Dar ducked three repeated questions on whether the government was going to give another tax amnesty scheme and left the venue. It will be the tenth amnesty scheme in the history of the country and the third of the PML-N government in last as many years. The government’s last tax amnesty scheme to traders miserably failed, as it could bring in only 9,090 traders in the net against the claim of over one million.

The need for the tax amnesty scheme arose after the government brought legal changes to determine fair market value of the properties by amending Income Tax Ordinance through Finance Act 2016. However, a move that was initially aimed at capturing actual income gains from the property transactions would end up whitening about Rs7 trillion untaxed and black money currently parked in the real estate sector.

Real estate sector, govt close to breakthrough on controversial tax decisions

The ill-conceived changes in the tax law immediately created two problems, putting a question mark over trillions of rupees transactions carried out till June 30 and the fair market value of the future transactions, said a senior government official who attended the negotiations.

A government official told The Express Tribune that it has been decided that the government would not ask the source of income of the past transactions from investors.

Abdul Rauf Alam, President Federation of Pakistan Chambers of Commerce and Industry (FPCCI), said that this issue was not only the issue of real estate and builders associations but it was the issue of every businessperson, industrialist, importer, exporter and bureaucrat.

Since the beneficiaries of the schemes are from all segments of society, the scheme is expected to pass through all the legal obstacles, said FBR officials.

“The big players in speculative business in real estate and capital markets are the beneficiaries of policies of appeasement,” said eminent tax expert Dr Ikramul Haq. He said these big players, in between politicians and corrupt bureaucrats, get their share courtesy a few leading tax experts who in connivance with some stalwart in FBR provide support to tax evaders. Haq added that the whitening of assets by compromise is a great fraud depriving the country of trillions of rupees in taxes.

According to the broader contours of the likely amnesty scheme the government would settle the past property transactions by charging a fixed tax of 4% to 5% of the price differential between the deputy collector rates and the new rates, which will be determined by next week.

Congratulations, This was Only workable solution. I will advise forum members once this bill is passed they should Act ASAP to file Tax returns, When Govt was already charging CVT, stamp WHT and Advanced Income Tax, there was no provision for such action.
The Only hitch was the clause the past Pay CVT stamp etc on DC rate or Sale deed "WHAT EVER IS MORE" People have been paying blindly @ DC Rates and there was No objection.
Now another clarification will come soon, After this amenity the Gain Tax Collection mechanism will also need revision. That will also Come up as 2,3% of fair market price at time of sale to seller which is Fair and acceptable.

Pakistan's external debts crossed $75b figure. Ultimately inflation will raise and PKR will fall further against $. GOVT had no choice but to impose taxes as they also intends to spend all reserves before elections. But new property taxes will be a cause of flight of money too. In fact these unplanned taxes are nightmare for Pakistan same way GOVT seized forign currency accounts in 1998. Now even GOVT reverse this decision but damage has been done.

They settled the matter with NAB 6 months ago, that first Eden will give plot possession of Eden land and then Eden Garden Ext.,development is going on in Eden land but still no development in Eden Garden.They have enough land for both projects and for LRR passing through from it.But I think Eden land possession is expected in 2017 end while Eden Garden Ext, may take 3_4 years to develop

Dear shahzad feroze,Eden garden ext and its other projects are big fraud and robbery in daylight.It is badly failed project.As I have my personal experience with this project.I bought a plot on instalments on Rs.8 lac in 2011 and sold after long struggle luckily at only 4 lac 50% minus.I saw innocent people were crying with tears in Eden's head office,but they got disappointment only.Nobody is ready to provide them the exact info.If you can stay more time and have holding power,then see how the cat jumps.Best of luck.

Dear Friends ,
I have one plot in Phase 7 which I am selling . The other one in Prism ( facing Golf which I will sell later ).
My Phase 7 plot is being sold at 160 ( plus minus ). Should I reinvest in lahore which is risky because of Ishaq Dar or should I purchase on flat in Sydney CBD ( say 700000 AUD ) . I give 25 % upfront and mortgage rest ? I give the apartment on rent

Please suggest ???

@Rana: If you run yr math to calculate it is not worth investing in Australian Flat of AUD 700000 by 25% down payment i.e AUD 175000 plus cost/lending fees of the mortgage etc minimum 5% of the price AUD 25250
comes to 201250 x @ 78.00 AUD/PKR is 15697500, and if you are estimating PKR15500000 sales proceeds with tax deductions it will be further reduced. Even going through this hassle, you still owe 75% mortgage on the Flat, therefore in my opinion with all the risks of ifs & buts still investing in Pakistan Real Estate is much better.

I would say it all depends on your plans in near future.

If you dont want to come to pak any time soon and want to settle completely in aus then take it invest there in time to get max gains.

So but if have setting that you and your family regularly coming to pak or in future you plan to send your kids to pak for any reason than you must be having some sort of house or setting in pak as well.

I know people who are settle in UK 197 and having more property in PAk and still purchasing even their kids hardly visited pak in 30 or 40 years s its all about ur priorities and falimy setting

Some factors:

If you don't already have a property in AUS, it might be a good idea to diversify country risk and invest in AUS if you already have a property in PK. This is especially if you already have permanent residence rights to stay in AUS, unlike us poor folks in the Middle East.

Secondly, due to high levels of immigration, and concentration of jobs in Sydney CBD, rental properties in Sydney CBD should always be in demand in future.

Thirdly, Pakistan property has performed really well over the last couple of years, but at same time it has also been in the doldrums for a certain period. That being said, asset appreciation on property over long term is usually high.

Fourth, for those able to get mortgages its not too bad to let the tenants build your equity for you, but its a more longer term gain and you will not gain much on asset appreciation like Jameel Sb. pointed out.

If You take into account the data given above last 5 figures are quarters and average them up and then Make Cumulative Averge you may be astonished to see that Pakistan is Giving Much More returns, If You take into account Currency devaluation in Last 8 years Canadian Dollars Lost almost same value as that of Pak Rupee same is the case with Australian Dollar.
US is Last 9 ys average is still negative No gain rather Loss , Canadian and Australian SO So if you take into account devaluation of their Currency other are far Below

I will welcome some experience of other overseas people lIke in UK France etc At least Abu Dhabi I gave example that

Now he asked again and Today I confirmed the price have gone to 4 lac per Merla ie 200% Gain in 2 years. This Much gain in Canada and Australia comes in 18 to 20 years

I am agree with mr. Jameel Mughal.
I am living in Europe and i observed what MashaAllh Pakistan RE gave to people that no one country in whole Europe has given. Even in crises Pak RE rose.
My brother whole world is crying and trying to destroy orher economy, brexit is latest example.
My family bought 2 plots in EME in 2000 with 20 lac and MashAlh now is price for 2 is lac.
Now you see even was slump in 2004 in pak.

Brother, just invest in Pak and sleep freely. After few years Inshalh you will gain most than whole world.

LDA Avenue 1 plots

Dear LRE,

I am bit confused to understand that how an potential buyer can check whether the plots in LDA Avenue 1 is clear or under litigation?

I am planning to buy a 10 Marla plot in L Block in 1260 to 1269 series as the owner is not disclosing the plot number yet.

Please help.

Most of the part of L block is in litigation.Best blocks to invest are F,J,M,H,D.These are litigation free.Ask owner to take Noc from lda office and secondly u can get details from lda one window.
