President Signs Landmark Overseas Pakistani Property Bill 2024 to Protect Diaspora Property Rights

On October 30, President Asif Ali Zardari signed the Special Court (Overseas Pakistani Property) Bill 2024 into law, a major milestone for the rights of overseas Pakistanis. Alongside this, he also approved the Deposit Protection Corporation Amendment Bill 2024, aimed at safeguarding Pakistani citizens' financial interests, particularly for those living abroad.


Specialized Courts for Overseas Property Disputes


The Special Court (Overseas Pakistani Property) Bill 2024 establishes dedicated courts to resolve property disputes faced by Pakistanis living abroad. The new courts will ensure that cases are settled within 90 days of filing, addressing long-standing delays that have impacted the Pakistani diaspora. Additionally, an online complaint filing system will be introduced, making it easier for overseas Pakistanis to file and track their cases from anywhere in the world.


Senate Support and Importance for the Pakistani Diaspora


Senate members have praised this bill as a landmark for protecting the rights of overseas Pakistanis. Senator Irfan Siddiqui underscored the importance of these legal reforms, highlighting the diaspora’s contributions to Pakistan, particularly through USD 3 billion in monthly remittances. The bill is expected to build stronger ties with overseas Pakistanis by providing them with quicker, more accessible legal recourse for property issues, ultimately strengthening their bond with Pakistan.


This progressive legislation reflects the government’s commitment to addressing the unique needs of Pakistanis abroad, ensuring their investments and assets are safeguarded under an efficient and responsive legal system.

Salam my family have some land in Mirpur AJK in Pakistan which has always been family land. Someone who works within the government as a gadawar (not sure if I have spelt that correctly, but is basically one post above a patwari) has laid claim to the land. He has made some false paper work about the land and overnight built some rooms on the site and even had electric installed. Once I was made aware of the issue I had a family friend who applied for a stay order which was granted but the other party has moved someone into the building and now we are waiting to see what happens from the court process. The lower court which is run by the land authority is saying very little as he has a lot of influence in that court and the solicitor is not confident that it will get a positive response so is looking to file at the next court up to try and get a fair hearing.
I am very disappointed that as an overseas Pakistani I am having to deal with this from someone who is working for the government in an official post and has already cos a considerable amount of money and this is just the early stages and I foresee this cost increasing considerably before the case is fully sorted. I do travel to the country as often as possible but with this incident I have been very put off and would kindly request that strong action be taken against government employees who abuse the power of their job, some people have suggested that he owned the land rightfully and if this was true why would he feel the need to build on it overnight? Also as a family we had collectively agreed that this land was to be used for a graveyard to respect my grandads wishes but this incident has caused considerable distress to the older members of my extended family.
