گٹرباغیچہ الاٹمنٹ کیس: سپریم کورٹ نے فیصلہ سنادیا
اسلام آباد: سپریم کورٹ نے کے ایم سی ایمپلائز کوآپریٹو سوسائٹی(گٹرباغیچہ) کی زمین کی الاٹمنٹ منسوخ کردی ہے۔




تفصیلات کے مطابق چیف جسٹس کی سربراہی میں سپریم کورٹ کے 2 رکنی بینچ نے کے ایم سی ایمپلائز کوآپریٹو سوسائٹی کو زمین کی الاٹمنٹ سے متعلق کیس کی سماعت کی، فریقین کے دلائل مکمل ہونے کے بعد سپریم کورٹ نے گٹرباغیچہ کی 200ایکڑ زمین کی الاٹمنٹ منسوخ کردی۔



سپریم کورٹ نے اپنے مختصر فیصلے میں کہا کہ کے ایم سی کو اپنی زمین اپنے ہی ملازمین کو الاٹ کرنےکا اختیار نہیں ہے، قانون کے مطابق یہ زمین تعلیمی،مذہبی یا دیگر فلاحی مقاصد کیلئےالاٹ ہوسکتی تھی، سوسائٹی کےنام پر زمین الاٹ کرا کر گٹرباغیچہ کی زمین حاصل کی گئی۔



اس سے قبل ہاوسنگ سوسائٹی کے وکیل نے عدالت عظمیٰ کو بتایا کہ کے ایم سی کو ہاؤسنگ سوسائٹی کو زمین الاٹ کرنےکا اختیار ہے یہ ریٹائرڈ ملازمین کی سوسائٹی ہےجس میں ریٹائر ملازمین اوربیوائیں رہائش پزیر ہیں، الاٹمنٹ منسوخی سے3لاکھ ریٹائر افراد اور بیوائیں بےگھر ہوجائیں گی، بیواؤں کو چھت کی فراہمی رفاہی مقاصد میں شمار ہوتی ہے۔



وکیل کے ایم سی سوسائٹی نے عدالت کو بتایا کہ عدالت بیوہ خواتین کے بنیادی حقوق کا بھی سوچے، زمین کا مقدمہ کرنے والوں کے پیچھے لیاری گینگ وار کے لوگ ہیں۔


جس پر چیف جسٹس نے ریمارکس دئیے کہ عدالت نے اہل کراچی کے بنیادی حقوق کو مدنظر رکھنا ہے، بیواؤں کو پنشن کی صورت میں ان کا حق تو مل رہا ہے، اس پر وکیل سوسائٹی کا کہنا تھا کہ اتنے پیسے نہیں ملتے کہ بیوہ خواتین گھر بنا سکیں۔



چیف جسٹس نے اپنے ریمارکس میں کہا کہ قانون کے تحت ریلوے سمیت کئی اداروں کی سوسائٹی ختم کی ہیں، کے ایم سی اپنے ملازمین کو براہ راست یا بالواسطہ زمین نہیں دے سکتا، کیا ہم سپریم کورٹ کی زمین اپنے ملازمین کو دے سکتے ہیں؟، سپریم کورٹ کے پاس پارک، لان اور دیگر اراضی بھی ہے۔
