Asslamoalikum

How to calculate Zakat on Plots that are not in possession (Payment completed)?

Is Zakat applicable on plot where we're un-decided weather to keep it for home or sellout?

What is ruling about the property where payment/installments are still under process?

Kind regards
Muhammad Amer

@ Amer, its better to consult a qualified scholar. Anyways, I believe the following 2 fatawaas would help you a lot (Insha Allaah):

I agree with Ashfaq. This is the similar finding when I inquired from many different mufti(s) or scholars. There is a big confusion in our society that Zakat should be paid on the amount at which we bought the land (intended for business) because we have not yet sold it and have not gained the profit in our hand. Please also note that your intention to keep land for a house may change and zakat will be due when your intention is changed. Anyways, I have just shared my findings. It should better be asked from scholars and would love to know their replies if this forum permits.

Dear Amer
Zakat is calculated on the basis of "tradeable goods" at their current value when one year has passed after them being in your possession and becoming tradeable. This means a plot held with the intention of making home or running business (making plaza) on it doesn't attract Zakat even if it's a 4 Kanal plot in middle of DHA or a 16 Marla commercial pair in Phase 3 Y block. As in both cases the intention is not to profit from resale so these are both non-tradeable goods.

On the other hand even a 5 Marla file in phase 9 would be subject to Zakat at its current market rate if held for reselling and been in possession of such file over a year, as its a tradeable commodity.

Hope it clarifies. May Allah guide us all.

In case of prism plot allocation only no possession letter. How to pay Zakat i.e on current value or original purchase value of file.

Dear Guest
Any file or plot, regardless of balloted, not balloted, posession, no posession, as long as the property is sellable and is held with the intention of future sale and profit gain, constitues of a tradeable assest and is subject to Zakat if one full year has passed from dae of acquisition of such property.

How zakat has to be calculated (current value, value exactly one year ago, or a mean of value one year ago with current value) is a much more delicate subject on which I am not an authority by any means. And am sure islamic scholars would also differ on this in their opinions if you consult multiple scholars on this. My personal opinion is that one should err on the cautious side and give zakat at the current value (which is likely to be higher) instead of the value exactly one year ago. And unless the property was bought exactly one year ago, the purchase price is irrelevant for calculating Zakat. For example if you bought a kanal file in 9 prism 2 years ago at 45 or 50 it has absolutely no relevance in calculating Zakat for current year. The only two dates (and the property value on those dates) that matter is 1. Current date and current value 2. Value of property exactly one year ago.

Hope I could calrify?

Appreciate help on below questions. Assume my Zakat year is Jan 1st - Dec 31, 2016

- Is zakat only on plots held for more than a one Zakat year (if intention is to resell these plots for profit)

- Is there any zakat on plots purchased and resold during the Zakat year (thus held for less than one year)

- if i purchase plot on Dec 29,2016 of my zakat year, will zakat only be due if this plot is held till Dec 29, 2017. If i sell it before Dec 29 ,2017 will there be any zakat due in 2017

Many thanks & Jazak Allah
