I have an important question. My father died an year ago; he had a plot in DHA karachi 200 sq yard commercial. Later on we applied for the transfer of plot and 2 months back the plot was transferred to his legal heirs. Me, my mother and 2 sisters.
Now i wanted to sell the property but there is a disagreement as my mother and sister is not willing to sell the property.
In this case am i handicapped or can i proceed any case legally. Because i am not sure if they would ever be willing to sell due to personal issues.

Dha laws dictate that all the owners should be present and willing to sell.so you don't have any option except to convince your mother and sister. |

According to Sharia (your mother share 12.5% and then remaining 87.5% (you have 43.75% and each of your sister have aprox 22% of that plot). I am not sure if there are DHA rules to divide 1 commercial plot into smaller plots (if so you can claim for possession of your 43.75% share = (3.5 Marla = 87.5 sq yard) and then sell your share. |

this is not right time to sell , feel lucky you have a good commercial which can value more in future , if you really need it try to convince all , otherwise follow your mom decision , ot will give you better on long run and life hereafter |
