Pls. advise me on this matter.
I signed an turn key agreement with a contractor to renovate a 10 marla house as per drawings (drawings given by me includes building, electrical and sewerage drawings. I get separate services of an architect for these drawings).
Before the signing of agreement the contractor visited the site and thoroughly viewed the site and then he gave me final quotation, i got two three more quotation and after comparing the items i selected this contractor.
The contractor violated agreement variously but main violation is time. The agreement to complete was 4 months but after passing 6 months he could not complete the gray structure (its very painful as we shifted to rented house).
2. Other Violation is Payment plan. He mention in agreement that 10% on different job but he insist to pay more amount for various activities and till yet i had paid 26/27 lacs which is almost 700,000 excess payments (as many activities not yet started/completed).
3. The quility of his work is not as per mentioned standard as he mentioned in his agreement that every activity will be A+ (the best quality available with their firm).
Some other violations which u understand as normal contractor did.
During last 2/3 months i ask him many time (not only personally but also send SMS and Whattsapp) to speed up my work and complete my work in time but his routine did not changed.
One or two times I want to kick him but my friends (Including one witness in agreement) ask me to continue work with him as money will struck so i kept mum to avoid disrupt my work.
Whenever i ask him about delayed work he says that your building was to complex and cost which he gave is too lesser. Although he did not ask to quit the agreement but his delaying tactic suggest me to think otherwise.
Pls. mention what should do in this situation as i am really disturb in this situation.

That is very common with more constructors. They try to get more money from you at the start of the project. If now he has less money to get from you and more work remaining then he will never finish it.
His goal is to re-negotiate agreement with you and get more money. Either you hire a new person or work with him, you will end up paying more money eventually. Either way in future, don't give contractors extra money up front. |

Even if you have legal contract, it will be of no use. There are consumer courts, which probably can help. If you want to do legal action, these consumer courts can probably help. Do check with these consumer courts thoroughly before taking any action. 2nd option is to terminate contract with him & hire someone who can complete the job & this will rid you from further tension & trouble. If this contractor is making trouble he will continue doing same in future, so better kick him out. |

I dont think going legal will help you out anything as you yourself have breached by paying extra or upfront. The rules of agreement are straight that you pay on completion to enable you termination of agreement any time and to keep contractor under your terms. Now that you have already paid more than the work legal action will not give you anything except allowing you to terminate agreement without any further payment and perhaps thats what your contractor would love to have. I dont know the total value of your agreement and percentage completed but if you have not paid more than 50% better terminate and if you did better work it out with existing contractor to let it be done with some acceptable quality. I would suggest swallow the pill and move on. However what is the guarantee that your next contractor is not like him! It's a nightmare unless you know that the contractor is reliable. Unfortunately reliable and dependable and two words that even money can't buy in Pakistan !
