I seek urgent advise please.
My friend's brother has died in USA. There is no other family member there. What happens to the house of the deceased in such cases? Is it at risk of being vandalized? My friend is the beneficiary of his brother's will, including insurance. He is going to USA to receive the remains of the deceased to bring to Pakistan, sell the assets, receive the insurance money, etc. But in the meantime he is worried about the belongings of his brother since there is no one to look after them. Can someone please recommend the appropriate safety procedure to follow? Is there any department that can be contacted? Thanks, Faisal Naseer. .

Where is he located? If it is in a decent location, there should not be any problem.

I would recommend, go to islamic finder website and find a close by islamic center. Get the phone number and call them and tell them about the situation. They should be able to help you out.

There are laws in US. If he is married, all goes to his wife (different state to state). Otherwise it goes to state unless he has ratified will. same is true with any insurance, if his name is in beneficiary he would get it otherwise goes to state. If house in decent area, nothing would happen to house. If deceased is US citizen talk to State dept.

Deceased is a Canadian citizen but was living and working in USA for last two years. He has no wife or children. He named his brother in Pakistan as beneficiary. I asked the company the deceased worked for to send me a letter on a letterhead mentioning particulars such as since when he worked for the company, his social security, address and that he has died, etc. I told them it will be useful to present such a letter to the US Embassy. However, the company refuses to send this letter and says that the next of kin, the brother of the deceased, should send his mailing address first because they have to send the insurance documents. When i told them that the brother will be in USA in less than two weeks, and the documents by mail can arrive after two weeks, so please send the documents by email, but they still insist on the mailing address. Then i told again to send the letter about death of their employee on company letterhead, they still say first i should give them the mailing address then they will give the letter. I don't understand what's the connection of a simple letter with the insurance documents and mailing address? Is there some law that can make the insurance void or something like that if the beneficiary's mailing address is outside the United States?

The deceased was living and working in Houston. Can you please forward me some numbers of some reliable Islamic Centers and the contact person in Houston? The brother of deceased has decided to bring the remains back to Pakistan. I have heard that Southwestern Airlines does not charge for this service, is this true?

I stongly urge you not to deal with the insurance company yourself, instead get a lawyer to do this, it will save you time and money.If not insurance companies will give you so much hassle. Dont Worry about vandalism, its not pakistan. To find a lawyer in the area, just go to google.com and type lawyer in houston, and you will find the list of lawyers. There are many urdu speaking lawyers as well. You can also request on this forum if someone knows a good lawyer. Most of the lawyers in this type of cases, only charge once beneficiary is paid.

Houston has a lot of pakistani population. I left in 1998 so dont have direct contacts, but Houston now has a Pakistan consulate as well. Try to talk to them and see if they could help as well, and then the other info.

2 pronged approach

Contact ICNA (www.icna.org) or ISNA (www.ISNA.net) or CAIR (WWW.cair.com) and ask them for help

Contact islamic center near that house and ask them to take care of that. Keep in mind there are some islamic organizations just on paper, they might be listed on islamic finder but if there is an active masjid or islamic center that is good

Contact local police station and inform them of the situation. Tell them that you have authorized the imam of the local islamic center or icna or isna or cair to deal with the situation

Dear Faisal,
Sorry to hear about your brother. My mom died in NY two years ago and I know the whole procedure, so I write in here so you have background.
There are four things that you need to deal with
1: Decision to bring or not bring the body to PK (There are serious issues to consider here so do not downplay this,
2: How to get the body and get it shipped or how to get it burried
3: Insurance and stuff collection
4: Wages etc collection, 401K (retirement) etc. and dealing with the company of deceased.

4: Let me start with dealing with company of deceased: They are not authorized to give any information etc to any one but legal heir of the deceased. HR laws will also have prohibition in this regard. You should give them the address and ask them to send the documents through fedex or DHL. The mail should be in PK in maximum 48 hours. And Fedex is not really expensive (relatively speaking). keep in mind that you just need them to get your brother to US otherwise whatever money they owe, or insurance etc, you will get that eventually, so don't bother much. Try to have some one there ASAP.

3: Insurance is where you will get some money. And disposing off what he has will just have some urgency since if your brother was on rent, the land lord can confiscate things in lieu of rent and charge the estate (remaining money of your brother) for removal etc. So getting ther quick is good but not that big of a deal. Just one additional note, There is usually a one month or two months advance that you will also be able to collect from the land lord if he was on rent, if he owned the property then you will have some other work to do.
2: Only authorized heirs can collect the body. So you will need to send an authorization to a person to collect the body. Edhi centres are very active. You need to contact Bilquis Edhi's centre in Houstan area and see if they can help you out. In NY they have a complete network and funeral homes that can help you out.

1: To bring remains of a person to PK, you will need to have a procedure called embombing done on the body of the deceased. Embombing involves taking out all the stuff from the stomach and filling it with some kind of liquid so that the body does not deteriate, etc. After embombing, the coffin will be sealed and people can view the deceased only through a mirror in the coofin (you woudl have seen that secene in American movies/funerals). Now, I have spoken to few musilim fate scholors and they agree that the deceased should be burried asap and near the place of death.
For your reference a hadees is stated below (I have narrated below to best of my recollection, check with a scholor to get accurate haddees) After a ghazwa, Hazoor started to give lectures to few deads. Some asked why and he(PBUH) said that they (the deceased) can hear better than you.

It means that dead will be penalized with Embombing process and some consider this un islamic. So Many leave their loved ones burried in USA/Canada because of this. Please consult with your faith scholor and get info.
the only way out of embombing will be to have the dead body burried for around six months as amanat and then close coffined body is brought to PK. This will be expensive but doable option since after six months all the stomach body parts would not exist. I have not done this but this is what my understanding is. You need to also check if they have not performed embombing already to preserve the body till some one can take control.
