How to handle troublesome tenants,

Dear members

My house is on rent in Johar Town. It was rented out before 7 years. He used to pay the rent regularly

Now I needed my house for my own family. I asked the tenant to vacate the house. He started using delaying tactics.

Now he managed a stay order from a court.

present rent is about half the market value.

If I have to go for litigation or there is some other ideal method.

How long it will take to eject the tenant if I go for the litigation.

How to choose a good lawer?

What are the best and worst conditions.

Dear brother have faith now civil matters related to property are to be solved with in 3 months as per the new policy laid out by Supreme Court please discuss with a lawyer Inshallah if you are on the rigot side do not worry

well, never go to the court. All property related cases goes beyond 4 yrs min, max 40 yrs. Try to resolve issue from other means, like involve "Fojdari court" or try to access Shabaz shareef, or something like this. Pakistani law ___-_ really badly.

Try to avoid court. Do your best to make settlement outside the court if you could. I fought my case for my shops, it took three years but without any verdict. Finally, on give and take formula, I was able to vacate them. What to speak about our Pakistani courts ? ..... you rarely find any honest person there.

If nothing works out, hire a suicide bomber to threaten your tenant and I give you grantee he will vacate your house within no time.

i strongly suggest that you forget the courts. Hire some Kan-Katte to rough up the tennant, problem will be solved in an instant.

Where is justice? Where is whole drama of Chief Justice and so called lawyers movement? Or it was just a political play? And masses are fooled by this corrupt community of “law and order” “justice” nonsense.

Dear Borther,
AS you mentioned that your tenant has got the order of injunction(stay order)from the court. It is very easy to get an injunction order from the court even within an hour becasue the Court wants to hear both parties before some do unjustice with anyone. I will suggest you not to go for any illegal mean to vacat your house as the tenant has got the stay order and it would be a contempt of Court liable for criminal proceedings against you.
There is no need to be afraid of a stay order. You just need to file an application for eviction of tenant. There could be many reasons you can get the order for eviction but the reason you mentioned here that you need the house for your own use is a strong one only if you do not own any other place to live. If you hire a good Lawyer not necessarily a big name who can proceed your case effectively, it would not take more than six months to get an order of eviction. You can also file an application alongwith eviction for review of rent which is attracting the tenant not to leave your place. Good luck

In a similar situation, our shop (worth 30 lacks) got vacated after 15 years (session court, hight cour and finally supreme court).
First, I agree with few suggestions above, best is to request him to vacate (request through few senior respectable citizens).
If not, hire few "Kan Toote" and with commando night action of only one/two hours, I am sure you will get a success. Even Punjab Police is ready to do this job as well.

We had a house a small one, given on some tiny miny rent (i guess the rent at that time was just 100Rs. in posh area of Mardan). The person used same tactis to avoid giving rent for 1 yr or so (It wasn't big deal for us so we didn't toke that seriously) then that guy bring stay order from the court, we also went into the court, and case started to move on, n on n on n on.. for 13 years (till supreme court) obviously v won, now that guy bring stay order on supreme courts order (I don't know how he did it but that happened) & within a year that guy died. Now a new struggle to find the wife of that person began, since our house was given to another corrupt person, and that struggle remain for 2 years, then court has given 1 sided decision. Now we start going after police to clean that house, but police wasn't taking it seriously (since the corrupt guy used to give "Hissa" to the police). Then that guy bring jurga to my father's shop, and my father sold that house for half price. (stupid law of pakistan)

using courts in these cases is useless.
other options mentioned above are better alternatives.
