@ MAS : A contract is written on stamped paper, when registered with oath commissioner, becomes a valid and acceptable documentary proof by any Court of Law. The person who signs such a document can not deviate from the terms and condition agreed upon, whatsoever. If he does, the aggrieved party can file a suit. Because of open ended rental contract terms, tenants often get stay from the court and then it takes years to get your property vacated. For example you may add the clause, The tenant is bound to vacate the house/shop within 3 months from the date of serving the notice , The rental payment is to be made latest by 5th of each month there onward a surcharge of Rs 500 per day along with the rent shall be applicable. Generally, the ready made rental contract are available which are signed by both the parties. You must add your own clause to protect your rights. I hope it explains all you need. |
