Send them you income tax returb that you filed. If you have not filed the return due to your employment income than ask your employer to give your certificate regarding salaried income and the tax deducted. But if tax return was ommmited than you may need to file one. You may contat me as being Chartered Accounmtant I may help.

My specific question to all well informed specially to Zeeshan.

How a NRP can fill the "Income Tax Return" and submit.

If you buy a car of 800cc you need NTN, once you got the NTN, Income Tax department start sending the letter & impose the Income Tax without knowing the income and where it come from.

I hope your reply in this forum will help the thousands of Overseas Pakistanis.

All overseas remittance the money through proper channel are exampt from income tax.I got a email from FBR

Non - Resident Pakistani (NRP) having no Pakistan sourced income are not required to file a return of income in Pakistan. However, if due to certain purchase of assets it is mandatry to present NTN than you can get an NTN (Mention in the NTN appliocation that you are a Non - Resident pakistani) from FBR. Subsequently, they can e-file (By sitting outside Pakistan from FBR website) a NIL return 30 September of each year since they are not required to pay tax in Pakistan (If they dont have any Pakistani sourced income like rent, Profit on Bank depaoist etc.).

E-filing will help you to avoid any notice but even if you receive any notice just mention that you are NOn - Resident Pakistani.

Here it is important to mention that you should send your money through bank so as to prove that you remiited your foreign income.

Zeeshan Bhai - 10% witholding tax is deducted by banks on Profit you earn on saving account. Do we still need to pay income tax on this profit other than withholding tax. Thanks.

Yes If you are getting Monthly income on some sources in Pakistan, You need to add them up and Pay tax on Total annual Income. It can be minimized by dividing that Deposit by names of your family members. This is by law but there is still no Fool proof system
On the Other hand If you are investing in capital Growth Scheme then You have not to pay Tax.
Basically this is a flaw in Taxation system, Deposit for Capital Growth and Monthly income is same If withholding is paid then income Tax should be exempted.

Dear Mr. Wajid
There is only one tax on bank deposits profit which is 10% and deducted by the Banks at the time of payment of profit. There is no other tax on this income. The said tax is full & final discharge of liability. If you have some other source of income, that would be seen separately and the profit on bank deposit has no concern with that profit. Mr. Jameel has confused your issue.

I worked in U.A.E. from April, 2011 to January, 2012 then I came back to Pakistan January, 2012 end then I got job in 20th March, 2012. My new employer deducted 30% percent income tax because they said that I am Non Resident because From February, 2012 to June, 2012 I am in Pakistan but my total present days in Pakistan are less than 182 days so I am Non-Resident and they have to charge 30 percent income tax.
HR Manager advised me that my salary from 20th March, 2012 to 30th June, 2012 will be exempted.
Please Advise Me And Clear This Case.

If one earns from a forex company that is based outside pakistan. The income is in dollars or ruppes but it comes through the website and their system. do these earning fall in the network of Pakistani taxation?

I am currently working in Saudi Arabia. Last year I bought a plot in Lahore. Now I have received a letter from FBR to pay tax for that plot. I have heard that property tax doesn't apply on overseas Pakistanis. But I want to know that what are the documents required to avoid this tax?

I am living in Dubai since 1979, invested money by purchasing shares of scheduled banks. The amount I paid for the shares was from UAE. The dividend paid by the company is deposited in my bank account in Multan. I am charged 17.5% income tax (Non Filer Rate).
I also pay 2.5% as Zakat on the investment.
Do I have any concession being non resident Pakistani?

I am a non resident Pakistani and stay more than 183 days outside Pakistan. I want to become a filer to avoid extra with-holding tax on purchases made in Pakistan like car etc. Do I have to submit wealth statement if I file the returns? As you have mentioned above should I declare nil returns as I have no Pakistani source of income.

I am a non resident pakistani. However, all the utility bills of my house are under my name. Hence, we pay a good amount of with holding tax. I don't have any source of income other than my savings in a bank. where i also pay withholding tax on each transaction. Now, my question is, as a non-resident pakistani, i can not file tax return so, how I can get the with holding tax back?

The FBR has just launched an Amnesty Scheme. The Notification says that this Scheme will apply to "all Pakistani citizens, wherever they may be" and will apply to all assets held overseas by them.

We, the Overseas Pakistanis who are citizens of UK, USA etc are bewildered that the FBR's Amnesty Scheme is asking us to pay 5% tax on our Bank Accounts and 3% tax on our homes. The FBR is forgetting that the so-called "Foreign Currency" accounts are in fact our "Home Currency" accounts. Similarly, our houses are located in our "Home" country. There is no need for us to declare those assets to FBR. Please see page 5 & 7 of the Gazette Notification where the wording is worrying to all of us.

There is an obvious ambiguity which is causing unease and panic. The FBR should clarify that the Dual Nationality holders are not required to declare their Bank Accounts and immovable property etc.

The Scheme is an Over-Kill. Instead of going after the cheats, the Scheme is going to create difficulties to honest overseas Pakistanis who pay their taxes to the Overseas governments. Under the Double Taxation Treaties, Pakistan cannot charge any tax on our accounts/properties.

I have been working in Saudi Arabia for the last 35 Years. I have normally 30 to 60 days annual vacation.(less than 182 days). During My Stay in Saudi Arabia I purchased one house in Lahore, Pakistan. I have one local currency account. In which i Have deposited 40 lakhs Rupees got my share form late mothers house. I have one foreign currency $ account. I purchased the dollers from Saudi Fransi Bank and paid from bank account in the same bank. I have purchase receipt and carry the dollers with at the time of my vacation and deposit in my foreign currency account. SHOULD I HAVE TO DECLARE AL THE ASSETS IN MY RETURN, IF I HAVE 50,000 P.RUPEES MONTHLY RENTAL INCOME UP TO WHAT LIMIT i HAVE TO DECLARE ?

A detailed videos are already available on YouTube about how to file your tax return first time. If you are overseas and sending money through proper channel then no need to pay any tax, just file the zero tax return. For further details kindly contact or consult with some local tax consultant or lawyer, they will charge a minor fee of 5K to 10K annually for per return.

A couple of questions.

1- I am living and working in UAE for last 7 years. Do I need to file Income Tax and Wealth Statement Returns?
2- Since I am living outside of Pakistan for last 7 years then do I need to show profit on my bank deposits in my income tax return? Withholding tax on these profits is already being deducted.
3- Do I need to show my property purchased in UAE in my wealth statement under Assets outside Pakistan? Is this column in wealth statement for Pakistanis living in Pakistan and have property aboard? or even Pakistani's living in UAE have to show these assets as well?
4- If the property in UAE is under my wife name then should it be mentioned in her wealth statement or mine wealth statement? as she is dependent on me. I purchased these assets in her name from my money

I bought few plots in Pakistan from my income abroad do i have to declare these I have paid all the transfer fees at the time of purchase! why they say i have to pay fine on declaration as it my hallal money obtained from my fixed salary given by the university.

Filing of Income Tax Return by Non-Residents
This blog goes right into Importance of Filing Income Tax Return by Non-residents and Why Expats/ Non Residents Should File their Income Tax Return in Pakistan.

This very compliance comes with a lot of benefits of being a compliant taxpayer as non-resident person where you don’t have to pay any extra tax whereas you can save money on the other hand.

For your information Filing of Income Tax Return by Non-residents is not mandatory.

Who is Expatriate?
Expat tax in Pakistan is applicable on an individual’s residential status and it does not have anything to do with his/ her nationality.

If the total duration of stay by an Expatriates (in a tax year) in Pakistan is 183 days or more (01 July to 30th June). Then they are considered to be residents for tax purposes as per Tax laws in Pakistan.

Pakistanis (residents) are taxed on their global income regardless of where it is received or earned, while non-residents / expatriates are taxed on their income earned in Pakistan only.

Return Filing: Expatriates Non-Resident Pakistanis
Why it is important for expatriate Pakistanis to file their income tax return in Pakistan
Foreign income is exempt in Pakistan. If a return is filed, such income can be declared as exempt income.
What benefits a non-resident Pakistani/ Expatriate can get?
What benefits will non-resident get?
Some expats transfer their foreign remittance in Pakistan (bank accounts), this amount is invested in profit schemes with a goal of earning profits and so on.

For clarification, the expats are not exempt from taxes on income earned inside Pakistan as investments made in Pakistan are safest then anywhere else.

These investments made by expats earn profit/ interest and tax is deducted by the banks at a higher rate of expats/ non-residents being non-filers by virtue of recent amendments made in Income Tax Laws in Pakistan.

Non-resident Pakistanis tax return filing is not mandatory but if filed it can benefit the non-resident Pakistani to enjoy tax benefits.

So if you are a non-resident and at the same time a non-filer you will end up paying comparatively higher taxes then a filer. So a non-resident apart from enjoying exempt income (foreign remittance) also enjoys lesser rates of taxes applied on income earned inside Pakistan as being a filer non-resident.

Expatriate Pakistanis send foreign exchange and help improve economy. These Expatriates often invest in real estate, saving schemes, stock exchange, mutual funds and prize bonds.

Apart from these investment they also purchase vehicles and immovable properties. In order to make investments they also have to open bank accounts and make certain transactions.

As per tax laws in Pakistan (Income Tax Ordinance, 2001), any person who purchases a plot (he is not a filer), house or vehicle has to pay double amount of income tax at the time of purchase.

Moreover, if any person who invests in banking schemes, earns profit on debt and ends up paying comparatively more tax on such income as compared to “Filer”.

A “filer” is a person whose name exists on the Active Taxpayers List (ATL) by FBR.

Benefits of Filing of Income Tax Return by Expats
Buying Property in Pakistan by Expatriate
If an expatriate/ non-resident files tax return and is included in ATL (Active Taxpayers List) by FBR.

So if you are a filer you will receive all the benefits of being a filer in Pakistan and tax will be reduced by more than 50% and in some cases totally removed.

For instance, if someone buys a plot valuing Rupees 6 million, in case you’re a not a filer you will have to pay tax of Rs.240,000, but if you’re a filer, you will only pay Rupees 120,000.

Pakistani tax laws clearly state that every owner of a plot/land measuring more than 500 sq. yard or property owner is required to file income tax return.

Given the requirements/ rules if the tax return is not filed, this stands violations of Pakistani Tax Laws.
