اسلام آباد - سپریم کورٹ نے اسلام آباد کے سیکٹر ای الیون میں زمین کی آبادکاری کے حوالے سے ملٹی پروفیشنل ہاؤسنگ سوسائٹی اور سی ڈی اے کے درمیان ہونے والے معاہدے کو کالعدم قرار دے دیا ہے اور سی ڈی اے بورڈ کو ہدایت کی ہے کہ وہ تمام منصوبے کو اپنے قبضے میں لے لے اور آرڈیننس کی مشقوں کے مطابق اس منصوبے کو مکمل کیا جائے۔ چیئرمین سی ڈی اے سپریم کورٹ کی ہدایات پر عملدرآمد کو یقینی بنائے اور ایک ماہ کے اندر رپورٹ پیش کرے جبکہ عدالت نے کہا کہ اگر ملٹی پروفیشنل ہاؤسنگ سوسائٹی نے اس پراجیکٹ پر رقم خرچ کی ہے تو انہیں قانون کے مطابق اس رقم کی وصولی کیلئے چارہ جوئی کا اختیار حاصل ہو گا۔ واضح رہے کہ سپریم کورٹ نے سی ڈی اے اور ملٹی پروفیشنل ہاؤسنگ سوسائٹی کے مابین سیکٹر ای 11میں 54 ایکڑ اراضی کی روانگی کیلئے دسمبر 2008ء میں ہونیوالے معاہدے کیخلاف ازخودنوٹس لیا تھا۔ سوسائٹی کا عدالت میں کہنا تھا کہ اس نے اس معاہدے کے تحت زمین کی آبادکاری کی مد میں بھاری رقم خرچ کی ہے جس پر عدالت نے ان کو اس بات کی اجازت دیدی ہے کہ وہ اپنی رقم کی وصولی کے لئے قانون کے مطابق چارہ جوئی کر سکتے ہیں۔ اس کیس کی سماعت چیف جسٹس کی سربراہی میں دو رکنی بنچ نے کی۔

Where are all these E-11 lovers today and what are there comment on E-11 at this stage and on it's lower standard design / works

I repeatedly said that E-11 is a "dwarf Sector" and can not be called a proper CDA sector.

where as they were putting E-11 ahead of sector D-12.

What to comment on E-16 apart from this that Rawalpindi Housing Society started in 1986 and it is like a tree trying to grow in barren Land. Where cattle come too for grazing in meadows and you never know some one may pulls this plant from roots one day.

Very wrong decision of SC, these were the societies who developed this patchy sector, cda even could not get the possession of land from occupents of cda land, mpchs had developed the cda land, paid the compensation to occupents and now this commercial area will never be constructed by the cda. Cda even could not completely develop D-12 in 20 years time. I condemn this decision of SC.

I wonder why SCP is taking decisions about Capital land issues in bits and pieces. There was a decree about Bani Gala couple of months ago and now its E-11. Why not outlining a working “strategy” for the Capital as a whole. Why not one clear message to CDA for all development work which is its core responsibility. By the way ‘strategies’ are already laid out on papers, SCP only have to give reminders to CDA with supreme authority. So why not a ruling on overall behavior of CDA who is culprit of extreme development delays in Islamabad at criminal level. After all, we are talking about ‘Supreme’ Court of Pakistan. Why picking up just one sector and making rulings about it. Why not clear message to those who are occupying state land illegally and openly committing crime and to those authorities (CDA) who are culprit of delaying tactics and causing a serious social and economic problems in the Capital of Pakistan.

Very Bad decision by Supreme Court. Major fault in this decision is that SCP didn't understand till end of its hearing that MPCHS is not a private firm or a property of a single person. It is a co-operative society where members are the owners of their assets. Hard earned money of poor people was involved by MPCHS to develop a CDA Project. CDA could not get possession of the land till 10 years more. Any how its a honor for MPCHS that they are the Developers of Northern Strip of E-11. MPCHS is innocent in this case.
