Dear Members,
I want to ask a rather important question.
I plan to rent out a single story neat house 10 Marla but what are a chances of "QUABZA"???
This thought bothers me a lot, as this house is my only property asset, and it worries me if such a thing happens to me.
In addition, there is the COURT STAY thing. That means when u want your house back the tendent may get a STAY from Court and you would have no option but to let him stay in your home, although you may need it now.
My house is located in Wapda Town, Lahore, if that help.
Hoping to get some serious, intellgent and knowledgeable replies.

1. Selection of tenant is the most important. Usually, the retired people and the company hiring for their employees are the best to rent out the house. 2. Terms of the rental agreement is very important. A tenant can not take stay if an agreement is drafted according to legalities carefully. There are lots of technicalities in making an agreement which a layman does not understand. Only a lawyer can tell you those complexities how an agreement gets void automatically in case of failure to pay rent or comply with the agreement thus rendering anyone unable to take stay from the court of law. 3. Do not ever take rent in cash, always make a clause in the agreement binding tenant to deposit the rent in your given account no., only the bank deposit slip should serve as proof of payment of rent. 4. Make agreement only for one year and rewrite it on expiry. I adopt this method, while renting out my house and shops and never faced a problem from tenants. |

Rental contracts are pretty much regularised and officially documented. No one has much of a choice to make changes in the way one pleases! All clauses and rules are pre-defined and have legal standings. For example, in Islamabad, normally contract is for 5 years and after every 3 years, you can increase only 8.1 per cent per annum. After 5 years, all is void and you can legally re-negotiate your rent from scratch, based on market forces. |

@LLahore: Transaction through bank legally covers both, the landlord and tenant. For example, my rental agreement states that if tenant deposits the rent after 5th of each month then this agreement shall stand as canceled forthwith, thereby I can force him to vacate since in this case no agreement exists in the eyes of law. The bank transaction is the solid legal proof to this effect. @Rental Adisor: Kindly read the Rental Act and the legalities of an void /voidable agreement and then discuss here. What all you have written is the only market practice which has got nothing or little to do with law. I have never contracted in property matters based on a standard ready made agreements available with Ashtam Froosh which are only good for the tenants to take stay as and when they wish. |

Hussain Bhai, Pl.respond to Limu's request. I have two (02) nos. 8 marla plots in Ali Block of Bahria Town Lahore.I intend to build (two units) houses on them & rent out to ensure some stable income in my retired age instead of keeping my money in bank & have some interest. Kind Regards. |

I dont Know exactly but most people now a days write Contract for 11 Months reason I dont Know but there is some legal or Tax benefit |

"Rental Contract" and "Rent Agreement" are two different things more or less having 20 legal differences. A rental contract is made for one year or more and legally it is required to get it registered with rent controller of the area for which a fee has to be paid. Wheres, in case of rent agreement of 11 months, its not required to get it registered with rent controller and as per law it is not rent contract as such but an agreement between the two parties. |

@Dear Aamir Sb, I got a standard rent agreement from stamp frosh (11 Months), and on it, clearly stated that the tendent cannot take a stay from court. But I dont know for sure, it has any "VALUE", because as I understand, the Paki Courts favour TENDENT :) @Dear Hussain SB, I dont think there is anything such as QAZBA FREE, no matter any society. |

Dear Simple "it, clearly stated that the tendent cannot take a stay from court." This sentence does not have any legal value at all. Rather this is the best sentence which perfectly worsens your case for being contrary to the land of law. Because you can not deny anyone of his legal right as per the constitution of Pakistan. As long as an agreement is intact either party can take stay. Try to have a clause which makes the agreement void by a mutually agreed upon clause. Paki Courts do not favor anyone this is we who do not have understanding of the law. |

salaam... anyone who can help pls.. i have rented commercial property. i wanted to know whose responsibility is it to pay the property tax for the house? the tenant already agreed that he would pay and signed the lease but now he wants to back out from the the property tax... the property is permanently commercialized.. |
