Relocation of Plots in Ph 7,

(65079)
Sunday, May 15, 2011 01:29 AM

I had a plot in phase 7 S block, which has been relocated to U block of Ph7,to the worst possible location in my opinion next to the grid station.
My father has recieved a letter yesterday.
I am overseas and as per the market price the max price for that plot is 32 lac, where as my S block plot was 40 lac.
What should be the legal course of action in this regard,if I don't want to take the allocated plot.
Can we go to the courts in Pakistan for help.
A sincere advise is sorted from CMY sahib and experts as DHA should not hve sold the land when it was not in their possision.

Chances of getting a good location plot due to relocation or against new allocation files ballot in DHA6 or DHA7 is not good as no good plots are left in DHA6 or DHA7 any more.

I dont have liberty to post an answer for you about how you can proceed from here. If any one have plot in DHA6 or DHA7 non posession area please call me on phone asap for further discussion on this topic.

Ahsen: If you can bear the lawyer charges and have somebody in Pakistan who can keep an eye on the lawyer as well, I will suggest you should file a petition in the court. As you mentioned you are at a net loss of 8 lacs as of now ( which will be even more if you can consider the future appreciations in S block and U block) so if you are willing to risk 1-2 lacs on legal action, you should go ahead. While DHA mentions on its alotment letters than it reserves the right to relocate the plot at anytime, I am sure this can be a very strong case especially if you purchased this plot from the market and paid a premium due to its location. Better would be to get in touch with other such effectees and file a joint petition which will hold more weight and also bring down your costs and it will also build pressure on DHA and from my understanding of law, I can think there is a good chance of winning. There has been cases where when people have gone to courts, DHA has settled matters out of court to prevent a general verdict by court which will oblige them to entertain each and every member.
