who is responsible for painting, Landlord or Tenant,

I am living in a house on rent.After five years i asked landlord to paint the house.Landlord is saying that it is the responsibility of tenant.Is Landlord correct?Who is responsible for paint tenant or landlord?Please anybody can answer.

I am also a tenant only first time when you get a house then it is the responsibility of landlord then after responsibility of tenant.

I believe your landlord is having a tough time from you as he wants to increase the rent or vacate the premises and you are not willing to increase the rent neither vacate the premises rather asking him for the renovation of the house.Your multiple posts shows you want to obtain every possible answers to refute your landlord. I have sympathy for the landlord.

Tenant is bound to return the house in same condition at the time of acquiring, In this duration he can change and making painting of his choice but by the end of contract the condition of house should be same or acceptable to landlord.

simply in your case your landlord is right.

Looks logical that tenant has to do the paint work in Mr Zahid Ali's case, Can anybody quote some law for the information of all?

if you rent a hotel room, then all services maintained by the Hotel. if you break something or tempered then you have to pay. In rented house it should be the responsibility of Owner to give services to tenant. But remember in against this service Land Lord will ask you to revise or increase rent.

u r fully responsible for the wear and tear of the house. landlord is responsible to give u house in fully living conditions includ all necessary works. then it is ur job to keep the standard of house in order.

This should be calrified in agreement, In genral Owner have to do Painting etc every 2 years

Landlor have to do all paint work and no need to paint it by urslf as he gets the monthly rent and if he insists change the house simple.No need to ser pay cheraanay ki of landlord.

MASIFJAMIL: I am agreed to increase the rent as per landlord demand even though Landlord is not agreed to do the paint work. the paint work is now 9 yrs old. please clarify what should i do? thanks

Depends on the agreement! Do u have any? If not; then it has to be on mutual understanding.In my opinion, painting of a house has to be the job of Landlord.

@ Zahid Ali, Sir. Did u get this house painted by ur landlord at the time of shifting? If not,u should have demanded it.If yes,u should do it now coz u used it and u want to use it further.In the Rent Agreement, u signed with ur landlord,I'm sure there is no clause that who will paint it after regular use.Yes, if u vaccate it ur landlord will paint it B4 offering it to next tenant. Dear ABC and Tanweer, In my agreement, this clause doesnt exist that who will paint after a certain time because the agreement is for only 11 months and it was not renewed. I didnt ask landlord to paint the house at the time of shifting five years ago. I asked many estate agent and their unanimous opinion is that landlord is responsible for paint.any estate agent can reply to this question. I want to be crystal clear in this situation.If it is my responsibility then y landlord bear this amount. By the way, my lot of collegues are landlord and they have always painted their houses by their own and they have never asked the tenant to paint the house. Tanweer, mutual understanding means what, 50 50 percent? please clarify

Dear Zahid sb, Mutual agreement means that you need to take up this issue in an extremely polite and gentle manner with your landlord. Talk to him and try to convince him. My agreement with my landlord did not have this clause as well.However I invited him over a cup of tea and showed him the house.He was happy that I had been taking a very good care of his house, apart from the normal wear and tear, that includes painting. He then agreed to paint the house on his own expenses and I assured him that the house will be taken care of properly and reponsibly. This happened in my third year of renting the house and now I AM in my sixth year. This is what differentiates between a reasonable landlord and an unreasonable landlord.This will also depend on how good relations have you maintained with your landlord. Once again, painting is the job of the Landlord!

Dear Tanweer, I have very good relation with landlord. Landlord wants that we stay in his house.But Landlord has a strong perception that tenanat is responsible for paint. In the blog, the mixed reaction of people have really confused me more. I have asked the landlord to find out an amicable solution for this problem and waiting for his reply. Landlord is living with us on first floor.We are on ground floor.The way to find out a problem by mutual understanding is really difficult.Is there any black and white rule for the solution of this problem.I know there are very few black and white option in the life. Rest of the options in life exists in grey areas.
