Can a Plot be purchase from Mukhtar Khas
Asslam O Alikum,

Mein aik plot purchase kerna chahta hon. Jiss bande se mein plot lena chahta hon uss ne mujhemukhtar-e-khas dia hai patware khane se confirmation ke lieye. Uss mukhtar e khas ke mutabik jiss ki taraf se ye mukhtar e khas banaya gaya hai uss ke pass pehley mukhtar e aam hai jo ke uss ke bhai ki taraf se hoa tha jo plot ka asal malik tha.

Ab mujhe ye baat sab deal wagaira final hone ke baad pata chali hai or property dealer ke mutabiq plot mein koi masla nai hai or plot transfer or registery ho sakti hai.

App se mashwara ki darkhwast hai ke bateiyen mujhe kia kerna chahiey.

Kia mukhtar e khas wala plot khareeda ja sakta hai or transfer ho sakta hai.. or iss ka tarkia kiya hai. Ya iss mein koi masla ho sakta hai.

Bohat Meherbani ho gi meri jama poonji ka swala hai.

Plot 4 marla ka hai or Nadar abad lahore cantt mein hai.

Salam Ahmad Sahib,

Just confirm from local Patwari that this special power of attorney is registered and Patwari can issue a "Fard barae Bae" on this "Mukhtare Khass" then get the registery done according to both documents and then do the "Inteqal" in your name. Thats it job done...

Its normal practice for investors to do " Mukhtare Khass" instead of full registery....for simply one reason its quick and cheap way...Just make sure one thing that orignal registered person is alive...If orignal person is dead then this "MK" will be finished...Hope this help

Such purchases should be better avoided unless the party is well known, LDA, DHA and all reputed societies are not transferring plots on Mukhtar Khas

As per my knowledge...Mukhtaar e Khas is only for some specific purpose like a some legal proceedings in court etc; it is not to be used for sale etc...for that purpose Mukhtaar e Aam is the document to be used...For a good deal preferably use the owner or at best the brother having his Mukhtaar E Aam....
Now use Mr Tahir's advise too!!!

I am finalizing this deal today.

I have got registry permission from cantt kachahri and today i am going for final payment and get the document signed from the owner who has mukhtar e khas.

Can any one please tell what should i take care for on final payment which i will do InshaAllah through payorder.

In these final step i am looking forward for sincere advice from you.. I am bit tense as this is going to be very crucial step for my life.

Also please advise what should i do after the payment for qabza as construction will not be allowed until the inteqal is done which may take another 3-4 months.

Dear brothers explained earlier as well Mukhtar Khas is is very weak Document and now LDA, DHA and reputed housing societies are not accepting it. As per Law If Mr Alam is Owner and he gives Mukhar e Am to Mr Akbar , Akbar Cant issue any other Mukhat rekhas.

The Only soultion is that you tell that you wnat either No Objection certificate from original Owner or You need the original owner to sign registry, ot at least witness. If they are unable to catch primary owner then you may be in Trouble, then try to find who was primary owner and get information of his reputation. In this deal the primary owner can put you in trouble even after 10 years. why you wnat to welcome a disease??

In past 99% frauds were on Mukhatar Khas. why you want to add troubles to yourself

Mukhtar e khaas can sell the property. The only problem is that sometime the Mukhtar e khaas is Jaaly and even cancelled. Check if the owner of the property has realy given this mukhtar e khaas. Contact to the real owners. Check also if the Mukhtaare e khaas is registered at all. Normally people make fraud through this Mukhtaar e Khaas. Check also if the Property is not under litigation. Go to the putwaree and ask for any litigation against this property. Ask for a fresh Ferd. I hope this will help you a lot. Take an Advocate for this process. Also give notice in the newspaper for this property.

I have verified through patwar khana there is no ligitation. Also i have contact to the person who have Mukhtar e aam and who issued this mukhtar e khas, he said it is ok to proceed. Also patwari told me it is ok to proceed the deal with mukhtar e khas. Also the property dealer is saying that there will be no issue.

In two hours i have to do final payment. What else i should do know.

Also i have copy of registry and mukhtar e aam both which i will get today after the payment.

AOA, my advise dont go for this deal, later on if have a problem, no one will help you.*patwari, registry office, or the person from whom you are purchasing the plot, every one blame why not checked before, i have faced and facing in court since many years.
so pls becareful and save your money. Dont be greedy to buy problem plot.

I had no other choice but to finalize the deal and leave the rest on Allah. Because i have already made Bryana of 1/3 amount. But i have included the Last seller as witness which seems to be very nice man and told me that it has no issues.

Well Mr. Lahori, Best of luck but you shouldn't ask this question if you have to jump in the well and there is no other choice.

One stay order (which will take just 10 minutes) from original owner can get you in troubble and then you and the Court for many years. You know what I mean.

Vistor 22: Who is the real owner in your view. I have included the ex-seller who got this plot from his brother through mukhtar e aam and did the mukhtar e khas. So both are in agreement then what may be the problem?

Lahori bhai you are not alone. Believe me we are existing in millions. We do stupid things and then start praying that nothing goes wrong. your point is that you have included the last seller as a witness and he SEEMED very nice dude :). By the way he will have no status but a witness to the wrong transaction.

Lets pray one more time that nothing goes wrong and we are going to do that more than a million time in coming future but let me tell you one thing, if the original owner decides to take you in the court, for whatever reason, you will come to know how life treats us "innocent people" in this cruel world. Lets pray that we dont taste that life time experience atleast this time.
