Nop, you can't transfer on your name. You have to do the following: 1)You must have succession certificate issued by the court. Hire a lawyer who would file a case on behalf of your family. If your brother and sisters are abroad they may nominate you or authorize you to appear in the court on their behalf. 2) No way you could directly transfer property on your name even all your brothers sisters withdraw on your favor. Court will issue a succession certificate in favor of all share holders (brother 2 share, sister 1), that may take three to four months or depending upon your lawyer. 3) Property shall transfer to all your brothers and sisters based upon succession certificate. 4) Now, whoever (your brother & sister) is not interested in taking his/her share, may sell his / her share to you or may gift you. |
