I dont think that it is very strong law and can take years to finalize, the only winner used to be in past when property was sold undervalued in documents to save stamp papers but now the rates are fixed by govt so there is no use to document undervalued. Like in past a house in sold in 0ne Lac but to save money of buyer it is shown that it is sold only in 20000 , Now when a greedy neighbor gets information from patwari that house is shown to be sold in 20000 then he could file case and finally will win house in 20000 which actually was worth one lac. [The logic stands that I am paying seller same amount why he dont want to sell to me who living next door than a stranger] Now a days this clause is automatically removed rather one is at liberty to document price more as value of stamp papers is fixed. Now we seldom hear of these case and usual logic is "NaaK"[nose] rather than monitory benefit |
