There is a proposal to put 10% tax on sale / purchase of all plots over 259 sq. yards. I think this will discourage real estate trading, forcing investors to look for alternatives and resulting in prices to come down. Let's have perspective from the forum. Business Recorder news story follows.

ISLAMABAD: The National Assembly’s Standing Committee on Finance has proposed a range of taxation measures for documentation of the economy and asked the government to impose 10 percent tax on all the property transactions of 259 square yards and develop a data bank of all bank accounts with more than one million to track the wealth of non taxpayers.

Sources told Business Recorder that Chairperson of Standing Committee, Fauzia Wahab handed over a written document to the officials of Finance Ministry on Friday. The language of the letter suggests that the parliamentarians are dissatisfies and displeased over the performance of the economic team especially the Federal Board of Revenue (FBR).

The committee strongly recommended structural changes in the FBR to make it proactive, dynamic and motivated to bring undocumented sectors into the tax net. The committee said that one of the biggest problems of the country was that many segments of the economy remains undocumented largely because of tax machinery’s lack of initiative or drive to bring the rich people into the tax net.

The tax proposal recommended by the committee included bringing agricultural sector into the tax net as well as registration of the market commission agents involved in trade of agricultural goods, initially at market committee level with a fix tax rate in proportion to their income. The copy of the letter exclusively available with Business Recorder stated that the committee had received a number of complaints about section 8A of the Sales tax Act.

The committee recommended that the trend of burdening those already paying taxes should be stopped and tax collectors required to be given the target of locating those who live a lavish lifestyle but are non-existent in the tax payers list. The tax authorities suggested that a strong data bank should be developed on all financial transactions, such as all bank accounts with more than Rs.1 million, sales and purchase of motor vehicles.

The committee wants to know about the buyers of 0.3 million vehicles, which are said to be manufactured annually and whether buyers of these vehicles are part of the tax net or not. A close and an institutional understanding between the Federal Board of Revenue (FBR) and National Database and Registration Authority (NADRA) was underlined to use the ID card number as tracking instrument to assess the person’s financial strength.

The Standing Committee suggested to the government that another segment that is lying out of the purview of tax department is the sale and purchase of property. “We see immense activity in the sector, with heavy investment, yet the state has no real income. The committee proposed that any property transaction within a period of two years should be taxed at the federal level at the rate of 10 percent of the profit in the sales and purchase of property measuring 259 square yards.

The National Assembly’s body on Finance also proposed that an incentive package should be given to honest taxpayers to give them feeling of importance and recognition. The committee requested the government to give a national pride card to them and a separate counter should established to give them preferential treatment in issuing passports, NIC card and other facilitation so as to give message that how honourable it is to pay taxes.

This will cause Capital Flight !

The most practical formula on taxing real estate is to impose tax @ 1% (One Percent Only) on property's actual value every year.

They should once every year assess property's value (keep it at least 20% below market rates because of fluctuation in prices) and charge 1% on it, each year.

This will generate huge revenues every year (regardless of whether property stays with the same owner or is transferred a 100 times). It won't be a mighty burden like 10% on every transaction and that will translate into more buying and selling.

30 Thousand rupees on my 30 Lac rupee property is worth it Only if that money is rightly spent on me and my fellow countrymen :)

I will give 2 percent of my property if they collect tax honestly and its spend on the welfare of my countrymen but question is are they honest first and does this same formula applies on every influential person in any department because we 95 percent hold very less then 5 percent elite.And if they pay right tax on mills lands factories bullet proof cars we would not be discussing that anyway i can tell you the we 95 percent love our country and even give to needy from our own platter when time comes. We have the biggest private ambulance service in the world edhi. we all contributed to that we just need right people in every department whos priority is pakistan not their pocket and family and friends, love pakistan thats it thanks to all brothers and sisters

Just look around you folks, do you see any saints?? We voted them in and we will pay, our generations will pay for our sins.. our leaders are our selection and our reflection.. jaisi qaum vesay leader.. jaisa moo vesi chapair.. I apologize for being so negative but we are doomed as a nation.. we follow the maulvi and have left the Quran.. we accuse the West for our social ills.. we are on either side of the extreme.. either too religious fundamentalist or too modern.. both leading to hell... we elect criminals to eat away on our children's futures.. I am sorry but I do not see light at the end of the tunnel.. There is no end of the tunnel.. it is just a long dark tunnel.. if there is anything at the end, it would be another Zardari, may be his son, may be one of his daughters.. another Benazir and another Bhutto.. another long dark generation of corruption.. and public suicides.. and torture...

Shahbaz owns only one vehicle according to the form, and this too was a gift – a Land Cruiser.

Dear Dark Tunnel,

I am with you on this, 90% of us (with some education) very well know that PPP and PML-N are not going to deliver, lollipops(worth Billions of poor Rupees) like Benazir income support and Free laptops for p0rnography are for the upcoming elections.

Rest of the 10% (yes the educated ones) will always be with them because they have some relatives or some connections with these parties so they get their job done.

It is getting tough every day, first petrol went so high that we turned to CNG, now running my car on CNG has become a burden.

It is hard to make 100 rupees, the 100 rupee that used to buy you so much, now all you can get for a 100 rupee is a litre of milk or a single litre of petrol, such a shame really.

One things for sure, I have Never voted in my life BUT this time I am going to vote Insha-Allah, love me or hate me I am going to vote for Imran Khan!

10% Tax is Not practical but 1% annual is even more worse, Logic is In urban areas prices of prpperty have sky rocketed most of Holders are having sense of wll being that their Property worth is 2 Cror but they are unable to Pay 2 Lac Tax every year, some are retired some are Exapts who have Come Back to Country, Currently I am overseas to pay 1% Tax on My Currebnt Holdings is possible as Long as I stay Abroad But Coming Back home I cant Pat 2 Lac every Year, I may be earning only 3 Lac Per Year.
At the time purchase of property every one is wealthy but situation Changes after repatriation or retirement.

Hi there valuable readers,

I'm planning to buy 1 Kanal plot in coming weeks/months using my hard earned money/savings of my life.

I'm not very good in calculation especially in property buying/selling. I would really appreciate readers' own experience & preferrable request to Property/Accounts expert to comment on below:

How would this affect Buyers and Sellers if Government implement 10% Tax on property price on top of CVT, Transfer Fee, DHA or other shceme's Membership fee, Stamp Duty etc.?

For Example : If Asking Price = 30 Lac for 1 Kanal

Rs.3,000,000 x 10% = 300,000/- :
So you will pay nearly/approximately Rs.170,000 for CVT, Transfer Fee, Stamp Duty which is usual transfer charges when you buy it and now you will pay Rs.170,000/- plus Rs.300,000/- plus 1% commission of Dealer (which is Rs.30,000/-) making it total Rs.500,000/-.

To be honest, I'm not mad to pay half million for a property value of Rs.3 million. I would prefer investing my money somewhere else then property or please suggest if this still make sense to invest in RealEstate and please correct me if I did any wrong calculation above?

Above is for buyers and please comments how would that affect a seller?

I believe, ALWAYS EXPECT SOMETHING UNEXPECTED especially from current Politicians/government.

Dear Sufaid Posh, it is Just a proposal in Standing Committee and as I am in Touch with this Forum for Long time so most of these suggestionns are not approved. However I can advise you to finalize Puchase Before 30 June

If This Clause or even 5% is Implemented then it will be like this, the area You are buying already have a reate Called DC rate Like For DHA 7 suppose is is 25 Lac Per Kanal, That is Fixed even if But in 60 or 20 Lac, So Gove will Charge 5% on That. They are laready Charging 2% Stamp Duty [which goes to Govt Of Punja] and CVT 2% which goes to Fedral Govt, 3 ys Back CVT was 4% and Now has been reduced.
So for any purchase of 10 Merla or Bigger you are already paying 4% of Specified DC rate, This DC rate is revised every June 30th And mostly it is Bit lower than actual Market Price, However there is significant price gain in last one year , Now no average Plot in DHA 7 is 25 . So my expectation is that it will increase for all areas this year.
If You have to buy a property you will pay what ever Due. People Had Been Paying in Past. 20 Years Back Stamp duty was 8% Percent of Total Value But that time there was no DC rate, I remeber we Bought a House we shwoed it as a Plot instead of House Value was shown 3 Lac and 27000 Stamp papers were used. Actual value of that house at that time was 9 Lacs.
In musharraf Period these duties were drastically reduced and it resulted in realestate boom I remeber Buying a Kanal plot by Paying only 22000 fees Just 6 years Back , Same Plt will be Transferrred today in 180,000 without Comession.

Govt should take this action soon, you guys dont have idea about apoor man even who cant buy a 3 marla house or plot, dont think yourself to make money, land in Lahore and surroundings are sold and not many houses but poor man even cant afford to buy small plot or construct home and ending up paying rent. I am agiant this govt but I am with Govt on this step.

Dear Habib and others there is nothing irrational or unreasonable in the above mentioned finance committee proposal. May be we are not reading it carefully. This tax is not on the total sale price of the plot nor is it to be paid by the buyer. This is just regular INCOME tax just like other sources of income are taxed.

As per this proposal the seller who has held the plot for less than two years and is making a PROFIT (i.e. income) on his sale will pay 10 percent of the PROFIT (i.e. income). What is wrong with that? Why should a salaried person pay tax on his income but someone making money through property buy/sell remains exempted? Any Stamp duty, CVT etc payment that the seller made previously at the time of purchasing that plot will be deducted from the profit calculation while selling that plot.

If there is no profit in the sale there will be no tax. If the property was held for longer than 2 years, again there will be no tax. So people who are not doing it as business will be automatically get exempted. Sounds fair to me.

Same argument exists for agriculture tax. Why should agriculture income be exempted? Yes there are many challenges in the agriculture business but if someone is making a PROFIT despite all his challenges he should pay income tax on his net income. The only problem I see in this proposal is that agriculture people will get away once again because of lack of documentation in that business and because of influence of large land owners while the laborer, welder, house servant will continue to pay indirect tax on petrol and many other items.

We are the beggar no. 1 in the world which is why we keep getting kicked and insulted by the west. This will not change unless we pay our tax properly. The argument that rulers swindle our tax money (so we should not pay tax) is not valid because when there is no tax money to swindle they get loans from the west IN OUR NAME and swindle that and leave it on us to pay it back.
