Dear, Sir I have bought land one begha in a common khewat/ khata(mushtarka khata) and have intikal in my name since 15 years,and cultivating in this plot since that time , but now another party is saying with proof of petwari that it is our plot ,how I can say that this plot is mine.I think that other party have bought some land of same khewat / khata.but they not have been cultivating this plot ,please explain me according to the law how I can real onwer of this plot,
( INTIKAL in mushtraka khata and with khasra number, can I REAL OWNER of that plot, please tell me leagel point.) Thanks,

A khewat or khata may consist of hundreds of kanals. Within each khewat, there are many khasra numbers, which as the basic units of land. You must be cultivating specific khasra numbers within the khewat in which you bought land. However, our laws does not allow mutation of specific khasra numbers. Mutation can only be done of share bought within a khewat. Mutation can only mention specific khasra numbers if the specific khatooni within that khewat contains a small number of khasra numbers. So check your mutation. Does it give the khasra number? If no khasra number, then the proof that you own a specific plot within the khewat comes from Khasra Gardawari. Twice every year, the patwari updates his records for each khasra number showing the name of the person who has been cultivating the land. Make sure you are getting the Gardawari done in your name for the specific khasra number that you are possessing. Possession is the most important aspect of your ownership. Dont take it lightly. |
