Salam All,

I am bit confused. I have plaza under construction at DHA.. i am offered a fair rent by one bank.I just want to ask a question from you guys

IS money from property rented to bank who is obviously doing ribah/sood business HALAL?

My only reason to invest in rental properties because i want to keep my self away from sood as much as possible

Confused Saab,

You will be much more confused if mullah bhai declares rental income from bank is haram because they are involved in a haram (ribah/soud) business.

In such a case, you may find majority of your potential tenants' income is not truly halal either... for example, if I engage you in a gup shup session and sell an item and sort of lie to you about the product / service... during the selling process to make you pukka customer, then mullah bhai may declare that income to be haram as well.

What if you rented your property to a restaurant business... how will you ever confirm if restauranteur goat meat or doggy / billi meat in his famous biryani ? And if it really pure goat meat (I will be a reqular customer there then), how will you ever confirm if cooking oil restauranteur used is not made from khota churbi / bones ? ...Because mullah bhai may declare all of this restauranteur's income to be a haram one... Because customers are being deceived during the buying / selling process. Makes sense ?

Khan Saab suggested you reach out to several practicing muslims and go from there. Sometimes time is well spent with a practicing muslim then with a mullah / Aalim e Deen.

Bottom line: halal / haram concept in pakistan s really tough !

Dear , not all banks are doing sood. Some banks etc are ok.more over taking and giving and record keeping of sood activity is mentioned as not allowed,but to be sure , contact 2to3 mufti and then decide yourself.

Dear Brother Confused,

I appreciated your concern. May Allah the Almighty bless all of us with same level of thoughts. As per fatwa given below, it is not permissible for you to rent a place to a bank that deals in riba, because that is helping the bank in this major sin, namely riba.

Question: We rent our complex for a bank...whether the rent which we receive from the bank is halal. please clarify.

Praise be to Allaah.

Firstly:

Dealing in riba is haraam and is a major sin. Allaah says (interpretation of the meaning):

“O you who believe! Fear Allaah and give up what remains (due to you) from Ribaa (from now onward) if you are (really) believers.

279. And if you do not do it, then take a notice of war from Allaah and His Messenger but if you repent, you shall have your capital sums. Deal not unjustly (by asking more than your capital sums), and you shall not be dealt with unjustly (by receiving less than your capital sums)”

[al-Baqarah 2:278-278]

Secondly:

Once it is established that it is haraam to deal in riba, then it is also haraam to help others in that in any way whatsoever. That is because Allaah says (interpretation of the meaning):

“Help you one another in Al‑Birr and At‑Taqwa (virtue, righteousness and piety); but do not help one another in sin and transgression”

[al-Maa’idah 5:2]

Based on this, it is not permissible for you to rent a place to a bank that deals in riba, because that is helping the bank in this major sin, namely riba. It was proven that the Prophet (peace and blessings of Allaah be upon him) cursed the one who consumes riba, the one who pays it, the one who writes it down and the two who witness it, and he said: “They are all the same.” Narrated by Muslim, 1598.

Al-Nawawi said: This indicates that it is haraam to cooperate in falsehood.

Al-Sindi said: All of them are cursed for their participation in sin.

The scholars of the Standing Committee for Issuing Fatwas were asked:

I own a building and one of the banks applied to rent it. This bank is one of those that deal in riba. Is it permissible for me to rent it to this bank and others that deal in riba, or not?

They replied:

That is not permissible, because the bank mentioned is going to use it as a place for dealing in riba, which is haraam. Renting it to them for this purpose is helping them in doing something haraam. Allaah says (interpretation of the meaning):

“Help you one another in Al‑Birr and At‑Taqwa (virtue, righteousness and piety); but do not help one another in sin and transgression”

[al-Maa’idah 5:2]

Fataawa Islamiyyah, 2/423, 424

Shaykh ‘Abd al-‘Azeez ibn Baaz said:

There are many verses and ahaadeeth which indicate that it is haraam to cooperate in sin. By the same token it is haraam to rent property to owners of banks that deal in riba, because of the evidence mentioned.

Fataawa Islamiyyah, 2/395

The rent that you take from the bank is haraam wealth, which you must get rid of by giving it in charity. You must hasten to do that, because the Prophet (peace and blessings of Allaah be upon him) said: “Every body that is nourished on haraam things, the Fire is more fitting for it.” Narrated by al-Tabaraani; classed as saheeh by al-Albaani in Saheeh al-Jaami’, 4519.

With regard to the rent that you took before you knew that it is haraam, it is permissible for you, because Allaah said, when He revealed the prohibition of riba (interpretation of the meaning):

“So whosoever receives an admonition from his Lord and stops eating Ribaa, shall not be punished for the past; his case is for Allaah (to judge)”

[al-Baqarah 2:275]

If bank is only dealing in Islamic products and not doing business of Riba, the situation is different.

i think you can get more offers than bank,so to satisfy yourself you can waite and try to rent any other options,i lost my money in business ,rest of money i save in meazan bank,with that money income i always try to help some poorpeople for their daughter marrige arrangement,iam satissfy and feel free,Khuda dilon ke hal behtar janta he.

Thanks.. that's why i asked some practical Muslims at this forum
If i start thinking on your lines..i would be in trouble as after renting i cant poke my nose into my tenant's life/business or listening/taping their phone calls to know what actually actually they do or checking their oils and meet????.. I think i should look at the face value of business at this stage and then its between Allah and tenants

yes that what currently i m doing. i had visit from famous hospital today and they want to make their clinic/hospital at the property.May be deal would be done with them. I don't know why banks are always the highest bidder for rent????...This hospital is a famous one in Lahore charging around 5000/rs per night for private rooms(there are around 16 rooms on upper floors except basement ground and mezzanine) thus don't want to pay extra 20,000 in monthly rent. Any way few more are in pipe line. According to my understanding you cant spend Haram money on Halal things. Doing good deeds is very important but it should be from pure Halal money. Pakistani interest rates are very high and lucrative and it gives you good return but one can easily get same from wisely invested in commercial properties at DHA(from my experience in 3 to 4 years it even exceed from SOOD/Ribah because of capital appreciation)

Dear confused I would advise you not to do so, as it is long term deal so will have many thoughts which will not let U sleep.
This Issue cant be resolved on Logics or discussion this id matter of Doubt.

Can you tell me how can one make good rental income, let me say if I invest in dha and take some cornor commercial plot or on the Main road 100 feet or what else can make it easy to get a good rental income.I mean which kind of property can give me better rental income in DHA. shall I buy 8 marla commercial plot, or 16 marla commercial plot or 4 marla commercail plot, which will be better.And with your experience what kind of rent customer are better in DHA
