Advice Needed,

I have a inherited a share in a small house i.e. from my grandfather to father and then me. My father's brother and his sister also have share. Now my father and uncle have died and my uncle's son is putting pressure on me to sale the house and threatening me that he will sale himself if i will delay. I don't want any dispute but i want to know what are my legal rights if i don't want to sale my share and want to keep it?

Dear Ahmad

There are two way. 1) Get the house evaluate from 2/3 person along-with your cousin and pay his share. 2) Sell the house along-with your cousin and distribute the amount accordingly.

Please refer to Quran Surah An-nissa , it has complete detail on how inheritance should be distributed. You should include all who deserve.

Thanks to all who replied. I want to comment on few things

Curious, The two ways you told me seems logical and right but the thing is that i have emotional attachment to that house i don't want to sale it. At the same time i don't have much amount to buy it yet. While my cousin is threatening me on phone that he will sale or give the house to some one and will get the payment by his own if i will delay.

The house is in a village near Lahore and neither I nor my cousin is living there and we have rented the house and sharing the rent.

Presently Intaqal or transfer from father to me is not done. As per fard The house belongs to my Uncle, Father, Aunt. My uncle and father have died.

All i want is to get some more time to be in a better financial state to deiced if i can buy the house or not.

In your present stance, you need a favour from other side.
Else, a conflict is eminent.

You are wrong my friend and your cousin is right. You are being selfish. If your cousin wants to sell this house then you should go ahead and sell it off and resolve the matter. There is no point in being stubborn and making this matter worse. Whenever there is partnership involved one has to think practically NOT emotionally. You may have emotional attachment with that house but it bears no value or importance practically. Why don't you think it other way round, what if you were in need of money but your cousin refused to sell it. What's your take on that? Look pal, in my honest opinion you have two options to resolve this matter. Either pay him his share and keep the house or sell it off in market and get your share. Best of luck!
