Dear LRE Team , I signed NDC for this plot for 93 lacs with dealer saying (market is not good ) but on Thursday when i came to Lahore from Pindi ..other dealers were offering 120 lacs ( 2 installments paid as well as I am a retired army officer)..
What can i do now ? i dont want to sell it for 93 ( dealer has taken 4 weeks time and given me 5 lacs biyana )

you are stuck. best way is to negotiate and return the biana amount 5 lac rs plus 5 lacs penalty for not fullfilling the agreement incase yu have signed biana. dealer can also take stay on yur plot if yu have signed biana and back off now which will take considerable and long painful legal procedure to deal with. best way is give them 10 lacs with proper documentation if worth is really 120 lac

Most Imp is to Know to Correct Worth of Plot, My realtive Bought a Plot in 68, Plot next to it is being advetised for 4 weeks in 82 by some Colonel, If Minimal difference go ahead.

Plot is C-4 DHA Phase 9 Prism ( 2 installments already paid i mean 19-4 ) so now u have to pay 15 lacs only

Correct worth of Plot is about 110, But may be when you applied for NOC the Plot was 100, it must have taken 30 to 45 days and could have taken even 90 days. In that period it gained another,Keep in mind NOC Plots are offered less money as price can go down as well If Plot was 100, 93 was right offer. Now Opposite happened it is justified benfit of risk taker. However Convince him to pay you bit more.

Deal agreed at 93. Addition of 15 into it as dc, makes it 108. Further addition of transfer charges of around 2, would make it 110 for the buyer. You have already earned reasonable gains on it, that too within very shot time. Let the buyer enjoy further gains, for which he would require years, to be honest. Cancellation of this deal neither favours you nor the buyer. Please follow your obligations and proceed ahead for its finalization.

If u have not signed any agreement or sale deed, and just taken token, then it is not necessary for u to complete this deal, the dealer may get stay from court. But cannot make u sell it.

Waseem saab there is an option, as u said u r an army officer
kindly go to legal branch of dha there is farooq butt saab therw
inform him that dealer has lied to you about the market
and tried to rip u off, he will take your case to director
transfer and will force dealer to renegotiate with you
as dealer is making a huge margin over it, ndc canot
be applied without the prwsence of seller buyer now
do quickly and take ur case ti dirextor transfer and legal
branch

1. Was biana given to you in the presence of buyer ?
2. Was any clause permitting further sale of plot on yet another biana, included in your biana deed ?
3. was buyer's name mentioned on NDC or you signed blank NDC and handed it over to dealer for processing with DHA ?
4. What is end date of 4 weeks time, and has DHA given the date for transfer ?

I was tempted to advise you as you are in the Army.
1. Ask Director Transfer in DHA.
2. Take your COMMANDER on board.
3. If it is OK with both of them:-
a. Forgo your Biyana.
b. Cancel your NDC.
The dealer may take a court stay order or pressure you through service channels.Keep your plot for 6 months and try to save from loss.

Since your stance is genuinely strong, you may exercise all or any of the following options :

1. Step back from the signed deal, take on board your commander and Director Transfer, without leaving an impression that you are a greedy man, have no ethics and running after the money.

2. Ask the buyer to increase the price contrary to agreed deal. If he dares refusing it, either confiscate his biana or return it without penalty, and tell him that you are a characterless retired officer who can do anything.

3. Disappear from the scene for 6 months, and cause him as much loss as possible.

Isn't it that he signed the deal because he had no other better offer and accepted biana because he needed it for clearance of plot dues and release of NOC. Date of acceptance of biana and date of payment of his final dues, can be helpful but I doubt he would ever share it or come out with the facts. Didn't even feel shy to disclose his identity and plot number. Lets pray, he cancels the deal first, and plot's worth falls below 80 thereafter, and remains stagnant for years.
