CDA To Send Cases Of Illegal Housing Societies To FIA

ISLAMABAD (UrduPoint / Pakistan Point News - 14th Jun, 2021 ) : Capital Development Authority's (CDA) management has decided to send cases of illegal housing societies to the Federal Investigation Agency (FIA).

In a meeting, the high officials of CDA discussed various ways to stop the illegal societies from working, said a press release issued here.

In order to protect the innocent citizens from fraud, it was decided that any housing society which fraudulently used logo of CDA and used the name Islamabad illegally would be dealt with rules and regulation. In the first step, cases of three such societies will be referred to FIA.

The meeting was attended by officers of ICT,planning and building control departments.

Capital Gain Tax Changed Related to Pakistan Rental Properties Real Estate Sector

A major shift in taxation on property income has been introduced through Finance Bill, 2021 and all taxpayers shall be subject to uniform taxation on net-income basis at the applicable rates.

According to commentary on budget 2021/2022 and Finance Bill, 2021, by PwC A. F. Ferguson & Co. Chartered Accountants, at present, Individuals and Association of Persons (AOPs) can opt for their property income to be chargeable to tax on gross rent without any deductions, at specified (lower) tax rates.

Companies’ property income, however, is subject to tax after certain admissible deductions at the applicable corporate rate.

Through the proposed amendments, property income for all taxpayers shall henceforth be subject to uniform taxation on net-income basis at the applicable rates.

Withholding tax rates applicable to the property income of Individuals and AOPs are also proposed to be revised as under:

1. Where the gross amount of rent does not exceed Rs300,000: No tax shall be levied

2. Where the gross amount of rent exceeds Rs. 300,000 but does not exceed Rs. 600,000: the tax shall be 5 per cent of the gross amount exceeding Rs. 300,000

3. Where the gross amount of rent exceeds Rs. 600,000 but does not exceed Rs. 2,000,000: the tax shall be Rs15,000 plus 10 per cent of the gross amount exceeding Rs. 600,000
4. Where the gross amount of rent exceeds Rs. 2,000,000: the tax shall be Rs155,000 plus 25 per cent of the gross amount exceeding Rs. 2,000,000.

Further, the adjustment of property income for a tax year against loss under any other head of income is proposed to be reinstated.

The adjustment of such losses could give rise to a situation where effectively no tax is payable on property income.

In order to give full effect to this amendment, the Government may, therefore, consider introducing enabling provision for issuance of exemption / reduced rate certificates in eligible cases.

The government has taken taxation measures on capital gains from disposal of immovable properties and introduced normal tax regime on gains on immovable properties above Rs 5 million.

According to commentary on budget 2021/2022 and Finance Bill, 2021 released by PwC A. F. Ferguson & Co. Chartered Accountants, under the existing provisions, gains on disposal of immovable properties are taxed at special (reduced) slab rates along with reduction in gain based on holding period.

Gains on disposal of immovable properties held for more than four years are effectively non-taxable .

The proposed amendment at the outset seeks to clarify that this regime for immovable properties is not applicable on persons habitually engaged in transaction of sale and purchase of properties or where sale is adventure in the nature of trade or business.

Income of such persons would be taxable under the head of business with consequential effect that no benefit of holding period and special rate of tax would apply.

Furthermore, it is proposed that gains up to Rs 5 million will be taxed at a special rate of 5percent as against the existing rate of 2.5 percent.

The gains exceeding Rs 5 million will be taxed at normal rate though the benefit of holding period in computation would continue to apply as per existing provisions given below:

1. Where the holding period of an immovable property does not exceed one year: the calculation for tax shall be

A = Consideration minus cost

2. Where the holding period of an immovable property exceeds one year but does not exceed two years: the calculation shall be A x 3/4

3. Where the holding period of an immovable property exceeds two years but does not exceed three years: the calculation shall be A x 1/2

4. Where the holding period of an immovable property exceeds three years but does not exceed four years: the calculation shall be A x 1/4

5. Where the holding period of an immovable property exceeds four years: the calculation shall be Zero

In case of disposal of a depreciable immovable property at a consideration higher than its cost, the provisions of law deem consideration as cost of such property, thus, resulting into recoupment of tax deprecation only.

The rationale for such provision was that the Federal Government did not have powers under the Constitution of Pakistan to tax gain on disposal of an immovable property .

However, the 18th amendment to the Constitution was construed by the Federal Government to have given them jurisdiction to tax such gains .

Consequently, specific provisions were introduced for the taxation of gains on immovable properties, but no such amendment was made for depreciable immovable assets.

An amendment is now proposed to tax the aforesaid ‘excess’ as capital gains under section 37. As a result, in case of depreciable immovable assets, the excess should be dealt in the same manner as applicable for other immovable properties particularly with the concept of holding period.

The placement and language of the proposed amendment contradict section 22(8) thus resulting in an anomalous situation, which should be reconsidered.

PRISM 9. PAST PRESENT & "In shaa ALLAH" FUTURE

This is with reference to PRISM 9.... PAST, PRESENT, FUTURE.
Starting from PAST I would like to share few facts.
The most awaited and biggest state of the art Prism 9 was balloted on May 15 2015. Before its ballot date announced the file of 1 kanal manoeuvred around 54 lack in Jan 15. After the announcement the rates got sudden increase of approx 62 to 64 lack from 57 lack approx in May 2015.
Right after ballot Prism 9 went through a static phase for a month or so. But after that time experienced a drastic rise in prices of A,P,C,D,Q, in 1 kanal & 5 marla in R Sectors. These sectors are supposed to be the best sectors of Prism 9 (I hope some of my friends remember that from day 1 recommend these blocks at the most) At that time intelligent people were buying good location plots. Later on F,G,H also get added in favourite list of investors & builders due to direct approach from Ring Road.
Afterwards by the grace of ALLAH Dha Lahore starts fast track development in Feb 2016 on huge scale with a time line of 4 years. As the time passes by, this development faced different challenges like pockets, Sarkari roads, & Villages etc.
But here I must appreciate Dha Lahore development team for their efforts in developing this precious land and on the other Prism 9 holders (Prismers) who really hold their horses. (Prismers) term is is quite famous & popular here now by many people to be ( Prismer ) in Future In Shaa ALLAH.
So again come to the point Prism development was delayed due to above said circumstances. But again here I would like to emphasise & Insist Dha Lahore that kindly develop Prism 9 at their upmost priority bases. In order to give chance to Prismers to avail benefits of Construction amnesty Scheme announced by Government of Pakistan and as well as avail loan facility by the banks.
PRESENT of Prism 9 is again to over come its challenges and better to get resolved As soon as possible and major Strengths is current development stage. In A,P,Q,R
1. Sewerage done
2. Road Structure done
3. Electric dps Installed
4. Water works done
5. Street lights Installed
6. Main gate Inauguration in August In shaa ALLAH.
As well as buyers are not getting good plots in above blocks less than 2.25 crore today.
Keeping an eye on FUTURE many many good things are still pending and most I rate upmost priority is to “Possession”.
As soon as Possession is announced many Overseas, locals, developers are ready to jump in, to start construction activity in Prism 9. As prism 9 is surrounded by all developed areas so the chance of Construction activity is much brighter than any other Dha in Lahore.
In sha ALLAH it seems like rather than better to say Prism 9 will be A BIG cross over to all other phases of Dha Lahore due to its potential & Location.
At last but not the least thank you once again to my mentor CMY sb. For adding me again to this respected forum.
My last words for those who listened to me, My overseas brothers, All Dhas are good to invest but yes Invest by looking into Time & Location of the project and specially your plot. As well as try your hard level best to invest your hard earned money.
I will be always here to answer my overseas brothers who worked hard day & night only to fulfil their dream of “Home Sweet Home"

Well explained. Would be nice if someone also made a detailed post for each block so cross comparison can be made on pros and cons when buying. Personally believe P and D blocks are best due to central locations and they are close to the commercial heaven triangle (oval complex, golf course and zone 2 commercial).

I had missed out on Prism train when average plot was for 65. If you add 20 Lakh dev. charges - the price of plot at that time was 85 lakh. If it is now for 225 lakh, that is 2.64 times.
I had invested instead 74 lakh in a tier-two society ( Beaconhouse ) in a 2 kanal possession plot at Adda plot area at that time. The price of this plot is roughly 2.10 crore now. This is 2.83 times gain.

So while prism is an excellent investment - as Jameel sb has said - other areas have shown good gains as well

Alpha thank you for your reply but still I will rate Prism investment above Tier-2 society because of peace of mind, DHA is DHA. Agree there are areas where you can gain a lot more than DHA. The risks associated with DHA are far less. Investing in tier-2 society as other risks associated.
For instance, if you get 12% profit from bank and say you got 15% from stock exchange in a year both are non-comparable because the risks associated with stock were so high if you get only 3% more it is not worth it then!

I agree DHA is a safe investment from illegal qabza and ease of transfer point of view. However as with
DHA city and DHA valley, one is not that confident in DHA as well. At the time ( 2015 ) a plot with possession was safer than a plot on paper. Also while it is a tier-2 socient - it has a boundary with a much higher sense of security than a very large phase with multiple exists, thousands of residents and multiple villages. DHA prism has a benefit of faster exit, when required - but now with shortage of housing any plot would sell quickly
