Development charge phase 9

Dear Mr CMY,
As the phase 9 ballot is near I want to ask one question about development charge. As the development charges will be in 3 years installments, how much is the fine if one do not pay the development charge on time. Or is it even possible to delay the installment. Will they cancel the plot in any case if one don't pay the installments at all?
I will be greatful to you of you answer this question as its Importent for me to plan and manage my funds accordingly. Thanks.

For 3 years it will be like 20% of full amount to be paid as devlopment charges. You are charged for only installments you miss.

As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

is there zakat on agricultural land, if yes then how much? also zakat on industrial productions, and on saliried persons?

(There may be some grammatical and spelling errors in the above statement. The forum does not change anything from questions, comments and statements received from our readers for circulation in confidentiality.)

Answer:

Zakah on agricultural land

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Your Question: …is there zakat on agricultural land, if yes then how much?

Agricultural land is absolutely exempt from ‘zakah’ in Islam; thus even if one owns agricultural land worth millions of dollars, one is not liable to pay ‘zakah’ annually on that agricultural land itself.

The ‘zakah’ on agricultural land is determined from its produce:

If the land is irrigated naturally through rain the ‘zakah’ would be 10% of the produce of the land.
If the land is irrigated artificially through tube wells, tributaries, etc…the ‘zakah’ would be 5% of the produce of that land.

Your Question: …..also zakat on industrial productions

‘Zakah’ is not determined on the annual industrial production, but rather on the net value of the industrial business itself.

Your Question: …..and on saliried persons?

‘Zakah’ is not determined on the monthly/annual salary of the person, but rather on his net excess assets which he accumulates after paying all his expenses.

Thus if the annual salary of the person is 10,000 and his total annual expenses are 8,000; thus assuming the person has no other assets or savings upon which ‘zakah’ is due, he will be liable to pay ‘zakah’ on his savings of 2,000 at the rate of 2.50%.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.

Options within the Budget of 50 Lac to construct 1 kanal house

Dear Respected experts and friends

During my recent visit to Pakistan , I got an opportunity to look into different schemes with a view to construct a house. I have checked the following schemes:

1)Bahria Nasheman
2) Central Park
3) AWT phase 2
4)Grand Avenue


let me share my experience with you about all these schemes

1) Bahria Nasheman: Situated on ferozpur road opposite of Central park but entry gate is about 1.0 Km inside fron ferozpur road. There were no 1 kanal plots only 8 marla and 5 marla. It has a very nice development and all the facilities were excellent. Many houses were constructed and people living there. I found it to be bit congested and it will be more when more houses will be built.The rate was 22-24lac for 5 marla and 29-36 for 8 marla. They were anticipating the rate to be increased to 26-28 by june for 5 marla and 32-40 for 8 marla.

2) Central Park: I have witnessed many improvements during my last visit in March. Lots of construction activity was going . Two different agents told me that it has now more than 400 houses where families are living.The approach was from main ferozpur road and commercial plazas were mushrooming on the main boulevard. I have spoken to few residetns there as I was keen to buy there and they all ahd positive views about it. It is very secure and gated community. The possession area plots were available from 39 to 65 in A block. and from 35 onwards in B block depends upon location.
The agents were very positive about the future of it. According to their point of view highly underprieced scheme and it has a potential to grow rapidly in near future. They were predicting and anticipating the price to be with in the range of 60 lac within a year for a canal. The 10 marla has many plots and price will not grow very rapidly. In short , good investment for 1 kanal or 2 kanal.

3)AWT phase 2: Big sort of deserted scheme and the development work was not very good. There were houses and the price range was between 32-55 lac depends upon the location.Due toa ring road interchange at ADA plot it has a huge potential to grow and prices may double (as per the information from dealers there).In my opinion, not an ideal place to built a house but good for investment.

4)Grand Avenue: Startegic location and next to Bahria Nasheman.Highly underrated and ignored scheme by investors with an access from main ferozpur road. The development work was in swing and quality of development was very good. The A block will be ready for possession in October 2015, because they have done the carpted roads in 70% of A block. Small gated community about 2 kM before central park. If the price of central park will appreciate than its price will appreciate too. The 1 kanal plot was available in the price range of 29-35 with installments on old bookings. They got their status clear from LDA (it is not anymore on Illegal list of LDA). It is underpriced and have a potential to give very positive gains.The quality of developed roads is at par with Bahria nasheman.

These were my observations and I did some investments in these socities as I felt the potential in these schemes and plots were on ground

Investment in DHA

Brother CMY, all,

I have hard earned savings worth 13 million rupees which i would like to invest for 5 years in DHA Lahore. I would like to invest in commercial property to enable rental income for my retirement.

Probably my budget is short for a commercial investment in DHA ? One possible option could be to invest in Phase 7 - 4 Marla commercial or 1 Kanal residential plot ?

I think You are Mistaken, People are investing in Commercial not for renatal income but to get Capital Gain in Property, eg a Plaza Bluit on 8 Cror Land and 4 Cror Cost[1 Lakh per Month Mauintinace Tax etc], cant genertate Monthy rental to Justify its cost. The Investment in rental Property is Done that 8 Cror Plot can be sold in 12 Cror in 2,3 Yearsor so. As Lonmg as this trend will continue it will continue growing.
You make shops on certain Plots and your headache starts, rent not paid in time, Bill Not Paid , Business Flopped and tenant ran away leaiving furniture all things etc etc, It is Full time Job

I would Advise Buy a 10 M at certain prime
Location and start Ploy Clinic Make Chambers of Docs etc it is quite good for regular Income, Or a House at prime Location which can be divided in 2,3 Prtions can give you good renatl yield

From where you got this information ? Did you visit area by yourself and found some signs of LRR there ?
Because the Real Estate Experts on this Forum are saying LRR would not disturb NFC-2 Commercial area. It might touch A-Block plots.

Dealer are spreading these rumors so that they can convince you to sell your plots. Even some are saying that LRR can also effect Block B and E, just to create panic so that people sell their residential and commercial plots.
On the other hand if you visit Commercial area, same dealers are building plazas there on their own plots:))

NO this Is false news but this is Correct that there will be some revision of map again to accommodate LRR, But only Sundar side Boundary or Bahria side Boundary will be affected.
Interchange Loops may marginally affect few commercial plots. They will be adequately compensated, It depends what type of Loops are, made in order to decrease the cost GOP is going for Simple Interchanges, Not Like Abdulla Gul which is I KM in Diameter. Have a look of various previous designs of Interchanges in Google earth, and see How they can affect Commercial plots

Affidavit File of Phase 9

Dear CMY,
I bought a Phase 9 Affidavit File on 17th April, 2015 and got the intimation letter of same date. According to letter I will get allocation letter after 30 days (around 17th May, 2015) while balloting is on 15th.
Just need to know if this will be included in ballot or not. Need advice.

Hi,

I have 2 phase 9 files of 10 marla. I bought them 1 month back at price of 39 and paid 1lac charges. So they costed me 40 lac each.

I have ability to hold these for up to 2 years. But I want to know if that will be best choice to get good returns. Should I hold them and for how much time?

Or should I sell them now or after ballot and move my money somewhere else.

This is my first ever investment in real estate and LRE has been best source of information. Please advice what you would have done if you were in my scenario.

By the time I see his posts to delete too many innocent friends have fallen in his trap and posted answers. than I feel so bad to delete their posts too. When I block his post other people important help requests get blocked too. And seeing that hurts me. I admit may be a bad evil or greedy person for this guy but what is the fault of all other 1000s who visited this webpage and were even reading his dozens of post in past few weeks.

Friend just wasted more than 1 hour of important time in this useless post. should have used it to reply to more ballot check inputs Its 4.17 am in Chicago and I am going to sleep now and leaving site almost un blocked entirely so he too can have his say. Dont want to be unfair to him.

I have bought some land, intending to sell it when its value increases. But its value decreased and it did not sell, it remained in my possession for 10 years and its value did not increase, should I pay Zakah on it?.
Praise be to Allaah.

Land that is bought with the intention of selling it after a while when prices have increased is subject to zakaah, because it comes under the heading of trade goods.

The value of trade goods should be worked out at the end of the year based on the current market price, regardless of the price for which they were bought, and zakaah must be paid. The rate of zakaah is one quarter of one tenth.

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was asked: I have a piece of land and I am waiting for the prices of land to go up so that I can sell it, and it has been several years. Should I pay zakaah on it?

He replied: If a person buys land to make a profit then the land does not sell and becomes cheaper, and he keeps it until the price goes up, then he must pay zakaah on it every year, because it comes under the heading of trade goods. If he does not have anything with which to pay the zakaah, and he cannot find a buyer, then he should work out its price at the time when zakaah becomes obligatory and work out its zakaah, and in the following year he should work out the zakaah on its value, then in the third year and so on. Then whenever he sells it he should pay the total amount of zakaah that he had calculated. End quote.

Majmoo’ al-Fataawa (18/225).

He was also asked about a person who bought some land with the aim of trading in it, but it remained in his possession for a number of years. Does he have to pay zakaah on it?

He replied: If a person buys land for trading, then he has to pay zakaah every year, whether the value increases or decreases, and whether it sells quickly or it does not sell. He should work out its value every year at the current market price, then if he has money he should pay its zakaah from the money that he has, and if he does not have any money he should work out the zakaah for each year, and when he sells it he should pay the zakaah for the past years. End quote from Liqa’ al-Baab al-Shahri (15/12).

Property can be purchased to hold for the long term and realise rental income or it can be bought for speculative purposes to resell as soon as an appropriate gain can be realised.
1. Land
Dr Yusuf Al-Qaradawi, Dean of the University of Qatar, in responding to a question on whether land is subject to zakat, statesi: "The purchased land can be categorised as one of two types. The first type is purchased for resale after a period for profit. This type of purchase is a trade transaction and the land in this case is considered a commercial commodity. The land should be appraised annually to determine its value and then Zakah is paid at a rate of 2.5% of that value. This is the opinion of the majority of scholars. Only the followers of Imam Malik have a different opinion. They hold that the land is not subject to Zakah unless it is actually sold. The Zakah is 2.5% of the amount a person receives when the property is sold. The majority of scholars, however, consider this land as wealth and it is then subject to Zakah. This opinion is the most appropriate.
Land held for resale or being held to be developed is subject to zakat at the market value of the land.
"The second type is a land that is purchased to build on and not for resale. In this case, it is not subject to Zakah unless the owner has actually built on the land and rents out the property. Then, he should pay Zakah on the revenue derived from the rent."

One of our brothers/sisters has asked this question:

is there zakat on agricultural land, if yes then how much? also zakat on industrial productions, and on saliried persons?

Answer:

Zakah on agricultural land

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Your Question: …is there zakat on agricultural land, if yes then how much?

Agricultural land is absolutely exempt from ‘zakah’ in Islam; thus even if one owns agricultural land worth millions of dollars, one is not liable to pay ‘zakah’ annually on that agricultural land itself.

The ‘zakah’ on agricultural land is determined from its produce:

If the land is irrigated naturally through rain the ‘zakah’ would be 10% of the produce of the land.
If the land is irrigated artificially through tube wells, tributaries, etc…the ‘zakah’ would be 5% of the produce of that land.

‘Zakah’ is not determined on the annual industrial production, but rather on the net value of the industrial business itself.

Your Question: …..and on saliried persons?

‘Zakah’ is not determined on the monthly/annual salary of the person, but rather on his net excess assets which he accumulates after paying all his expenses.

Thus if the annual salary of the person is 10,000 and his total annual expenses are 8,000; thus assuming the person has no other assets or savings upon which ‘zakah’ is due, he will be liable to pay ‘zakah’ on his savings of 2,000 at the rate of 2.50%.

How should zakaah be paid on land which was bought with the aim of leaving it for a while then selling it?.
Praise be to Allaah.

If a person has bought land with the intention of selling it after a while, one of the following two scenarios must apply:

1 – He aims to save the money so that he will not spend it on anything else, but he does not intend to trade or make a profit. In this case there is no zakaah on the land.

2 – He does intend to trade and make a profit, in which case this land comes under the heading of trade goods, so zakaah must be paid on it.

The value of trade goods should be worked out at the end of one year on the basis of their current value, not the price for which they were bought, and the zakaah must be paid on them. The rate of zakaah that must be paid is one-quarter of one-tenth, i.e., 2.5%.

For example: if you bought land for one hundred thousand riyals, and when zakaah becomes due on it its value is now one hundred and fifty thousand riyals, then when one year had passed you must pay the zakaah of one hundred and fifty thousand riyals. The converse also applies. If you bought it for one hundred thousand riyals and when one year has passed its value is now only fifty thousand riyals, then you only have to pay zakaah on fifty thousand riyals.

Note:

It should be noted that the year for reckoning zakaah on trade goods does not begin from the time one bought the land or other product, rather it begins from the time when the wealth with which you bought those goods reached the nisaab (minimum threshold).

Based on this, the year for this land is the year for the money with which you bought it.
