Rights & wrongs Fate of Ashiana housing hangs in the balance

Rights & wrongs: Fate of Ashiana housing hangs in the balance

LAHORE:

The fate of Punjab government’s housing project for low-income people is still hanging in the balance as the Supreme Court’s Thursday order has left the dispute on use of trust land unresolved.

The SC did not vacate a stay order against the transfer of land to the Punjab Land Development Company (PLDC) for the construction of the housing scheme but it allowed the government to continue construction ‘at its own risk’.

Talking to The Express Tribune, a provincial government official said the transfer was in violation of Sections 16 and 17 of the Punjab Waqf Properties Ordinance of 1979. Section 17 states that “a Waqf property shall be used for the purpose for which it is dedicated or has been used or for any purpose recognised by Islam as religious, pious or charitable”.

The Punjab government launched the Ashiana housing project for low income homeless people in January and set up the PLDC to implement it. The plan was to offer subsidised housing to individuals with monthly incomes of less than Rs20,000.

The Revenue Department selected 712 kanals farm and at Saropa Attari on Ferozepur Road owned by the Auqaf and Religious Affairs Department for the scheme in Lahore. The land was a Waqf (trust) property attached to the shrine of Shah Noor Saropa Attari.

The Punjab government provided agriculture land of the same worth to the Auqaf Department at Ocha Ladhay near Raiwind in exchange for the Saroopa Attari land, but this is also illegal as Waqf land cannot be transferred or exchanged and its status cannot be changed, the official said.

PLDC Chairman Sheikh Alauddin denied that there was any anomaly in the transfer of land owned by the Auqaf and Religious Affairs Department or that it violated Sections 16 and 17 of the ordinance. The ordinance allows the use of Waqf land for this scheme, which was meant for poor people, he said.

He said that the exchange of land had been challenged in the Supreme Court, but on Thursday it had allowed the government to continue construction. He said 600 housing units would be handed over to the homeless after Eidul Fitr.

The Ashiana housing scheme offers 3-marla homes for Rs840,000 and 5-marla homes for Rs1,190,000, at monthly instalments of Rs4,500 and Rs7,500, respectively. Only individuals with a monthly income of less than Rs20,000 can apply. Interested buyers must fill out a form provided by the PLDC and submit it with a processing fee of Rs890 at the Bank of Punjab. The buyers are then selected in a draw.

In May, Chief Minister Shahbaz Sharif inaugurated the construction of 3,000 housing units. Work on 600 units has been completed and 21,000 applicants included in the draw to decide who will get the houses.

Asked to interpret the Supreme Court order of Thursday, advocate Muhammad Anwer Shaheen said contempt proceedings could no longer be initiated against the government for violation of the stay order. However, he said if the apex court’s final verdict was in favour of the petitioner, the provincial government would not be eligible for compensation for the construction it had undertaken. The site along with the houses built on it would then be handed over to the petitioner.

AOA cmy sahib i want to know phase 1 to 4 plots prices rises fastly or phase 5 to 9 and please tell me what is the future of phase 9 file his price rise or not thanks regards :h :h

CMY replied on Saturday, August 6, 2011 02:14 PM PST

DHA phase 1 to 5 have seen its gains and now DHA 6 7 8 9 have most chance of growth.

I dont under stand why people are willing to buy 5 marla in DHA 9 at 14 to 17 lacs cash but not willing to buy 1 kanal in DHA 9 at 27 lacs including development charges.

May be we should start saying

DHA Lahore phase 9 one kanal is available at 50 lacs in installments including development charges than we will have 5 to 10 lacs profit on paid amount of 16.75 lacs :)

With word installments attached there are endless buyers:)

CMY Sahib: Very logic and useful suggestions. I believe people will definitely change their mind to buy 5 marla in DHA 9 at 14-17 Lac and will prefer to buy 1 kanal.

Sarwar replied on Saturday, August 6, 2011 07:53 PM PST

Correction : Chaudhary Sahib: Your suggestions are very logic and useful. I believe people will buy 1 kanal plot instead of 5 marla at 14-17 Lac.

People donot know they get plot close to boundry wall or graveyard or grid station or water tower for 1 Kanal.

5 M
location is close to ringroad.

Salman Malik replied on Sunday, August 7, 2011 07:03 AM PST

You have very valid point CMY and probably in the long run one K
files will be more profiable than 5 marla plots.

But people who prefer 5m plots over these files also have very good reasons to do so:

1. Nobody knows when these files will be balloted.
2. It will take several years for development after the balloting.
3. Even after the balloting plot location can change.
4. In files there is a bit of a gamble as if you get a bad location plot you are stuck.
5. For most people it is easier to pay installments rather than full down payment.

So people who buy files or plots, both have their reasons and are right.

Dear CMY sahib
I own a plot V 496 Phase VII. As per the map it falls in village. sir what you suggest to sell it or keep it for future. If I intend to sell what could be its present cost and is the timings are beter now.
Regards

Ibraheem Gilani replied on Saturday, August 6, 2011 01:53 PM PST

Although you have taken advice from CMY but by knowing teh situation I would like to give you my sincere advice:
1- Sooner or later DHA will acquire this village due to its
location ( Near Golf Course)
2- If you are persistent to sell then talk with DHA first and tell them sitautin .
After that take any decision

CMY replied on Saturday, August 6, 2011 02:08 PM PST

Village people are asking 10 to 12 lacs per marla. GHQ is very upset that why DHA should buy a kanal for over 2 crore and after leaving roads etc give same land for 40 lacs to current holders. Its a huge village and almost no chance to be taken over ever by
DHA Lahore due un willingness of villagers even to sell their land to DHA even at 10 lacs per marla.

DHA is going to relocate all plots falling in the area of village.

V496 can be sold at 38 lacs. You should sell it as chances are you will get new relocated plot in ext areas of T and U blocks in future.

L 926 of
DHA Lahore Phase 6 is worth 68 to 70 lacs. It is a good location to build a house. No need to make a switch and pay more money with transfer costs and dealers commission.

Sir,

I have a plot in Phase-8 Near T-301. I would like to make house in 3 years. do you think its worth to hold it or should I switch over due to location or pits reported by you in phase 8. I am also planning to come Pakistan in August and might visit or talk to you in this regard.

Thanks and regards
Ashraf

CMY replied on Saturday, August 6, 2011 01:21 PM PST

Plot is worth 52 to 54 lacs. Not a top class
location for making a house. Its a good location for this price. To make a swtich in good location you will need min 15 to 18 lacs more. I think you should stay with current location.
