Karachi:KPT responds to charges of selling land for peanuts

Karachi Property News: The Karachi Port Trust (KPT) has clarified a report published in The News, after 13 days, stating that no illegal allotment of KPT land has been made by the trust for ‘peanuts’ or ‘a song’ to KPT Officers Cooperative Housing Society, as alleged in the news report.

The housing society was duly formed in 1949 and registered with the Sindh government under the Sindh Cooperatives Housing Society Act, 1925. In view of past practice of KPT, dating back to 1886 when land was granted in the Lalazar area to the Boat Club on a 99-year lease at the rate of Rs0.13 per sq yds, the KPT has been leasing land for various purposes not directly connected with the operations of the port.

With regard to the society, allotments of the 130 acres were made in three stages starting from 1989, 78 acres, followed in 1990, 27 acres and lastly in 1996, 25 acres. Here, the land allocated to the society was underwater and had to be reclaimed before it could be used for residential purposes.

Other cases of grants of land by KPT for residential-cum-commercial and other purposes include:

1938

8,361 sq yards for Karachi Club annexe

1944

22,296 sq yards to Beach Luxury Hotel

1970

294,965.66 sq yards (61 acres) sold to Pakistan Navy on MT Khan Road for the establishment of Naval Officers Residential Estate-I (NORE-I)

1971

Transferred 630 acres land (a portion of Clifton Scheme-5) to KDA.

2005

Leased 881 acres to Defence Housing Authority, Karachi, as the land in question was marshy area requiring initial investment for land reclamation.

As to the issue of the allocation of land by KPT to KPT United Workers Front of KPT Cooperative Housing Society, the grant of 250 acres was made by KPT in 2006 to the union for the benefit of employees.

In all the above cases, the Board of Trustees had duly approved the grant of lands subject to the approval of the federal government under the relevant provisions of the Karachi Port Trust Act 1886 where the period of lease exceeded 25 years.

It is also relevant to point out that other government organisations such as PIA, Pakistan Railways, KDA, KMC, CDA, Defence Housing Society, Sindh Bar Association, High Court Bar Association etc have their own housing societies for the officers/members throughout Pakistan.

Even in the case of civil servants of the provincial and federal cadre, once they reach BPS 22, they are entitled to be allocated a plot of land.

As to the award of contract to salvage underwater debris at the cost of Rs1.3 billion to M/s Euro Demolition (BV) Netherlands in 2010, it is clarified, that this was an international procurement being undertaken under the Public Procurement Rules, 2004 pursuant to advertisements appearing in the press. Technical and financial proposals were invited from interested applicants and M/s Euro Demolition was found to be most technically responsive given their international experience.

Earlier, an initial award of salvage work to M/s Indus Divers being a local firm in March 2008 at a cost of Rs77.5 million proved unsuccessful due to the complicated nature of the concrete debris underwater.

The KPT had no option, but to terminate the contract in April 2009 and go for a fresh advertisement and award of the salvage contract under the Public Procurement Rules. All decisions with regard to termination, invitation of fresh bids through public advertisement and the eventual award of contract were taken in consultation and with the approval of the Board of Trustees of KPT.

It is further clarified that the construction company (Ssangyong Construction, Korea) which had submitted various proposals from time to time for the said underwater salvage work was unsuccessful since these proposals were not formal bids and did not meet with the technical specifications of the salvage work involved. It was also relevant that the Korean company would, if successful, have outsourced or sublet the salvage work to some other company which would have been in breach of the Public Procurement Rules and KPT requirements.

As to the objection raised by the DAC to the payment of Rs952.61 million to M/s China International Water and Electric Corp, this was not in breach of procedure since the necessary survey was duly carried out by the KPT Survey Board so that adequate and satisfactory measurements were available at all material times.

The DAC has now ordered that the documentation record of KPT be duly counter checked to remove this erroneous objection. Similarly, the objection for failure to deduct and deposit income tax on payments to the same company is also misplaced since the company is tax exempt under Pakistan law. The DAC has also ordered that the tax exempt status should be counter checked by their officials with the Federal Board of Revenue, hence this objection is also incorrect.

Tariq Butt adds: The clarification issued 13 days after the story which appeared on June 18 itself shows the ‘efficiency’ of the KPT.

However, the KPT’s irregularities and lapses, and the loss it caused to the national exchequer were incorporated in the story from the latest report of the Auditor General of Pakistan for year 2010-11.

It is pointless to clarify the story that is based on an authentic government document, which is presented to the president of Pakistan, parliament and the Public Accounts Committee as required under the law. It appears that like several other government organisations, the KPT too did not act efficiently and timely when the AGP was carrying out the audit or it has skeletons in its cupboard that it hid from the AGP.

However, the clarification confirms the irregular transactions but did not respond to a major AGP objection that KPT did not produce record to the audit, and its non-presentation may create doubts as to the actual existence of it at all, and that its Board of Trustees was not authorised to approve these dealings under the rules and law.

The justification that the KPT has given for its irregularities and lapses costing the public exchequer billions should be forwarded to the audit so that it could judge its relevance. The lease of land for a song to the two housing societies of KPT officers and other employees was such a gross lapse that the audit recommended fixation of responsibility and disciplinary action against officials found responsible. Even otherwise it appears a cruel joke that the land was leased just for 10 paisa per sq yard per annum.

The KPT’s argument that other government organisations have their own housing societies for officers, and members have no relevance to the irregularity that it committed, as per the audit, in leasing hundreds of acres of land to the two housing societies.

The clarification did not respond to the objection that when the local firm abandoned the work for removal of concrete structure of collapsed berths, fresh bids were invited, and thereupon, the international firm, which had quoted Rs400 million, quoted Rs800 million for the same work, but later the contract was awarded at a cost of Rs1.3 billion. It only said that all decisions with regard to termination, invitation of fresh bids through public advertisement and the eventual award of contract were taken in consultation and with the approval of the KPT Board of Trustees.

The audit had not agreed to this argument, and had also stated that no record of abandonment of work by the local firm was provided to it even upon repeated request, which was in violation of rules, and in the absence of the record, the propriety and probity of the expenditure could not be ascertained.

Even several months after the audit, the KPT, as per the clarification, is yet to check from the Federal Board of Revenue the status of irregular retention of income tax of Rs24.53 million, which the audit described as a loss to exchequer.

KPT’s present plea and the one it had advanced to the audit earlier was that the company is tax exempt under the law. The AGP had not accepted it as valid.

slamabad—Around 8,00 residential and commercial plots are still vacant in the different Overseas Pakistanis Foundation (OPF) housing schemes across the country.

Talking to APP, Managing Director OPF Israr Khan Jamali said including that 556 residential and 244 commercial plots are still vacant besides that 59 residential plots and 100 Kanal area of commercial vacant in OPF Zone-V housing scheme.

He said across the country seven housing schemes completed for Overseas Pakistanis including Raiwind road phase-I in Lahore, Bhimber road Gujrat, Naudero road Larkana, Moro road Dadu, Budhni road Peshawar, Chittarpari Mirpur AJK phase-I,II,III and Airport road Turbat.

The 55% development work has been completed of OPF, Housing Scheme Zone-V and soon allotment letters would be issued to the allottees.

Israr Jamali said that 25 schools and colleges established throughout the county to look after the needs of children of Overseas Pakistanis adding that more five new colleges would be set up soon across the country.

Around 6.3 million Pakistani work force working abroad, including Africa 95,508, America 1,206,297 Asia & Far East 199,945, Australia & New Zealand 35,000, Europe 1,773,413 and Middle East 2,991,108 respectively.

Ministry of Overseas Pakistanis has established 21 offices of Community Welfare Attaches (CWA) in 15 countries to look after the welfare of the Pakistani emigrants, he added.

CWA to safeguard the interests of the Pakistani emigrants in the host country and settle their dispute, if any, with their employers.

Managing Director of OPF Israr Khan Jamali said that the main purpose of its to advanced the social welfare of the Pakistanis working overseas and their families in Pakistan by identifying their problems and contributing their solutions.—APP

Prime Minister Housing Scheme Islamabad Pakistan Fraud News

ISLAMABAD:

Around 3,000 kanals were bought in the National Park area of the federal capital in 2009 for the PM’s housing scheme, even though construction was prohibited.

This property, which was worth Rs44,000 per kanal, it is claimed, was purchased by the Ministry of Housing at Rs950,000 per kanal from Green Trees Private Limited. And the beneficiaries of this alleged plunder of the national exchequer were bureaucrats and ministry officials.

The change of housing minister, however, landed this case in the Supreme Court (SC), which on Thursday directed Green Trees Pvt Ltd to submit a concise statement in Federal Government Employees Housing Foundation (FGEHF) land scam case within 10 days.

A three-member bench of the SC headed by Chief Justice Iftikhar Muhammad Chaudhry heard the suo motu against billions of rupees corruption in purchasing of the land by the housing ministry.

The newly appointed Federal Minister for Housing and Works Syed Faisal Salah Hayat told the bench that he had no personal grudge with Green Trees, but huge irregularities had been done while finalising the deal. Hayat told the court that Green Trees had utilised Rs1.56 billion of a “poor nation” for the period of two years and seven months, “therefore the money should be returned with interest”.

Quoting interior ministry’s interim report into the case, Hayat said Green Trees signed the agreement for development of a housing scheme on April 1, 2009, while federal cabinet gave approval of construction in Zone-4, where the land was bought, later in 2010. “Such facts expose ulterior motives behind this dirty deal,” said the minister.

The deal was signed when Rehmatullah Kakar was federal minister of the housing ministry. “Being a minister I would be responsible if such irregularities surfaced in housing ministry, but I would suggest forming a commission to probe the influential bureaucrats and politicians thoroughly,” Faisal Saleh Hayat said in his petition.

Interim report also suggests that all directors of the FGEHF be sent to their parent organisation and the vacant posts be filled on merit.

On the advice given by the incumbent housing minister, Justice Chaudhry said that it is futile to ask the government to initiate criminal proceedings against negligent government officials. Justice Chaudhry told the Federal Minister Faisal Saleh Hayat that one of the officials against whom the SC had taken action had become secretary in housing ministry. Hayat remained silent to the comment.

After court proceedings, Hayat responded to the chief justice’s claims by talking to the media persons. He said that secretary of his ministry, Kamran Lashari was a competent, honest and wise bureaucrat who had changed the shape of Islamabad.

Afnan Kundi, a government lawyer, contended that they were ready for scrutiny but at the same time they had solid proof to rebut minister’s stance that huge corruption had been done in this deal. He said that CDA had not issued the NOC to its client therefore the land was not given to the department.

Raja Irshad, counsel for Green Trees, said that they met with the CDA Chairperson Imtiaz Inayat Elahi for NOC but he suggested them to meet “some Faisal Sakhi Butt” to finalise the pending issues. “But we refused to meet any private person,” he said.

The court said a commission would be constituted they examine the concise statement by Green Trees. The hearing was adjourned till July 11.

Earlier, a report of housing ministry had alleged that a top-level bureaucrat, who was also a member of executive committee that sanctioned the deal, is the brother of Green Trees’ owner.

Police conduct raid to arrest MNA Anjam Aqeel in NPF scandal

Islamabad: Islamabad Police has got the physical remand of former Deputy Director (Housing) of National Police Foundation Malik Khuda Buksh involved in billion rupee corruption, whereas the raids are being conducted at different places to arrest other character of the scam MNA Anjam Aqeel Khan.

On the orders of Supreme Court of Pakistan, Islamabad police conducted the raid on the residence of MNA from PML(N) Anjam Aqeel Khan at midnight but he managed to escape from the backdoor of the house. In the meantime police also raided the residence of Khuda Buksh at G-6/3 Islamabad at arrested him. Later on Sunday he was presented before Duty Judicial Magistrate Federal Territory Liaquat Ali Kharal, who handed over him on physical remand for one day to Islamabad police .

Police Station Shalimar has registered the case against MNA Anjam Aqeel Khan, former IG Islamabad Police, former MDs Police Foundation Mian Muhammad Amin and Chaudhary Iftikhar Adam as well as ex Additional Director Abdul Hanan. All the culprits were involved in embezzlement of Rs 6 billion.

MNA Anjam Aqeel Khan, with the help of his cohorts confiscated 45 kannal of precious land owned by National Police Foundation. Police has also took Azim brother of Anjam Aqeel into custody, whereas the police has also requested the court to examine the assets of Malik Khuda Buksh, which will be presented before Anti-Corruption Court Rawalpindi today.

LHC puts off hearing against Ashiana Housing Scheme

LAHORE: Lahore High Court (LHC) Chief Justice Chief Justice Ijaz Ahmad Chaudhry on Friday postponed for July 13 the hearing of a petition against provincial government’s Ashiana Housing Scheme.

An additional advocate general (AAG) stated that it was a public welfare project. He said that the draw for allotment of plots was held in a transparent manner and results were also sent to all the applicants and no illegality was committed in the scheme.

The petitioner submitted that he had not received the result of the draw. He said that before holding the draw, the competent authority should have issued its schedule for the applicants. The chief justice directed the AAG to hand over the copy of draw results to the petitioner to maintain transparency and adjourned the hearing for arguments.

The petitioner, Muhammad Iftikhar Hussain, submitted that the provincial government had to provide houses at an affordable prices to the poor but the scheme had lost the importance, as the process of allotment was not transparent. He alleged that only the favourite of the people at the helm of the affairs were being given houses while the deserving and really needy people had been left alone.

He requested the court to direct the respondents to maintain transparency and equity in the scheme so that actually deserving people could benefit from it.

CM orders implementation of ban on news constructions in Murree



Punjab Chief Minister Shahbaz Sharif on Friday issued directions for enforcement of the ban on new constructions in Murree, with a warning that strict action would be taken against violators of the policy.

He also issued instructions for early completion of the projects aimed at facilitating tourists in Murree.

He was addressing a meeting regarding development projects in Murree, here on Friday. Provincial Minister Rana Sanaullah Khan, the chief secretary, the Planning & Development chairman, the Higher Education secretary, the Finance secretary, the Rawalpindi commissioner and officers concerned were also present.

The chief minister said that previous local governments had destroyed an important tourist center of the province by allowing illegal constructions in Murree. However, he said, the incumbent government had imposed a ban on new constructions for maintaining natural beauty of Murree.

He directed divisional and districts administrations and heads of the departments concerned to ensure implementation of the policy at any cost. He said that, in order to transform Murree into a tourist attraction of the highest standard, development projects would have to be completed expeditiously and all departments should perform their responsibilities efficiently and dedicatedly for the purpose.

He issued instructions for improvement of Patriata chairlift, resource center and early completion of other development projects. He said that an effective system should be evolved for monitoring the pace of implementation of the projects.

The Rawalpindi commissioner, the Tourism Development Corporation managing director and officers of the departments concerned gave a detailed briefing on the development projects.

Now lets ASSUME for a minute that the ballot happens in July/ Auguts 2011:

1- what do you think will be the value (average location) at that time i.e. without paying any development charges?

2- what do you think will the development charges breakdown be i.e. payment and frequency?

Junaid sahib until now we dont know the
location of Parkview files. How could we estimate a price with out a location?

Lets wait and pray we get location etc.

If Parkview file is located in any area of currently in DHA Lahore posession than I could say this.

1)A one kanal plot on a map in all areas currently under DHA possession/control could not be less than 30 lacs other than few plots in Ganda Nullah in DHA 7 Z block where min rate is 28 lacs.

2)I estimate development charges will be 11 to 12 lacs and payable in 3 years in installments.

I am looking for a plot in budget of 20 Lac. I visited differnt schemes along Canal and arround Wapda town and found that Izmir, Wapda Town Extension and WT pahse II all have price 27 - 30 Lac at least for 10 M plots.

According to dealers in my budget i can get plot in DHA Rahber. Dealer also added that they are near to giving possession of 10 M plots in couple of months.

If i get enought amount in 2-3 years i want to start my home otherwise i will sell my plot.

I don't know much about DHA Rahber, current prices and its scope in near future. I would request you opinion about this please. How do you see this option.

I forgot to mention that in Izmir Extension its possible to get plot in given budget. But i didn't visit the extension myself. With comments of property dealer i however i guess its not going to be populated within comming 3-4 years.

You can Definately Get one Plot in WAPDA ext or Architect heir
Location is Much better Than DHA Rahber, these are already populated and all Facilities available there, Though Development standard is Not like DHA Rahber, But DHA Rhaber still dont have Posession no Electric supply and Gas will take Much Time, Location is also Far see Both of above Mentioned areas and then decide, Best Thing is To In crease Budget 6 Lac and try to Find in Valancia, even rather Bad Location Plot will be better than all these, Only Try to avoid facing graveyard, all other bad Locatios are OK after poulation is good

Thanks for detailed information. I could not find plot in given budget in A1 and A2 of WT Extension. A3 on otherside seems not that good and will take much more time.

Sorry I wrote WAPDA ext but I meant WAPDA phase 2, it has better approach than WAPDa Just Next to Nasheman 1,
Even if Architect is not Coperative society But there are not many issues and Registry can be done, Most recomended is Valancia ,
Tariq Gardens is also a good option I consider it as good as WAPDA but for this you will have to increase budget. ie in Both of these a plot can be tried in 25 to 27

Agree valancia and Tariq gardens need 25 - 27. In WT phase 2 the plot in 20Lac is not in good
location infact its far away near private land. I will give try to Architects however.

Asazm Wirk Sahib has given some details earlier and seems possible. He confirmed about the commercial plots on installment in phase 6 and 8 which CMY has also confirmed that DHA is going to issue very soon commercial plots on installments.

He also confirmed that the news would be in newspapers on 06th of July for the ballot of all phases allocation
files upto phase 8. This is a quite detailed information but he didn't tell the source.

Is it possible for DHA to ballot all the phases allocation files upto phase 8 at once????

DHA Lahore phase 9 plots of 5 marla in Shuhda quota were a very good investment in recent past and were highly recomened by us to all our valued cleints and on web here when profit was 1 to 2 lacs on paid amount. But now profit amount have gone up to 8 to 11 lacs on paid amount. At this point we believe DHA phase 9 Lahore at just 15.50 lacs for one kanal is a far better and safer investment instead of paying 15 to 16 lacs for a 5 marla plot.5 marla plot price is with development charges included but DHA 9 one kanal with development charges included will cost only 26 to 28 lacs.

Although not directly related to property , but I think there is some relevance. I have received a notice from the FBR on my address in Pakistan that I must file a tax return including wealth Tax Return.

In fact I have been abroad for the last 17 years. Inbetween I worked in Pakistan in a private co. during 2008 and was payying income tax. Then I left Pakistan came to UAE. Since 2009 I am here. I think the tax people have picked up my NTN no. and sent the notice , since I was not filing any return since 2008.

I would request those friends who have come accross such a situation and/or know how to tackle this to please guide me. Further can I communicate with FBR via email to get further clarifications or explain my position to them.

I am working in a private company. Our tax is automatically deducted however we have to file return. Last year i get notice to file return for 2007 and we hired a lawyer and pay him Rs. 3000/= . He filed the return and wealth statement. After working with him we understood its not a big deal and as BBB wrote you can almost everything. Wealth statement however is bit tricky, you need to evaluate what to show in assets and deducting some advance tax we pay on Bills, intrest on loans, donation to registered organizations etc. Overall its simple task and at most you need to pay few thousands to a lawyer (Lawyers sometime demand very hight fee but with bargaining you can agree on suitable amount).

I have worked in FBR, BBB is right, please fill your return even for nill. Now you can fill your returns online.

Mr. Farooq and Asim Malik Sb, no need to go for any tax consultant, go FBR online website, create your account and
update your job information over there.

Then fill your return. You can make your documents save in fbr website account.

Please note: This is Govt organisation and during filling your tax return or updating the records, you may get some errors but after some efforts I'm sure you will submit your return.

I myself spent almost 2 days to complete my return and all other stuff.

Actually this website is developed by PRAL (Pakistan Revenue Automations Pvt Ltd), PRAL is working combine with FBR, it’s you can say semi Govt type of company.
They launched this portal (website) on 2007, and even after 5 years this portal is not stable, there are so many bugs in the portal and it will not let you complete your RETURN or REGISTRATION easily. There are lot of issues in database too, it’s not updated. So, I believe you are receiving the documents mistakenly. They are trying to computerise all the stuff, and this is the reason they are bothering All NTN members without verification of job and any other criteria.

What I can suggest you is; follow the below steps.
1. Create your login in this website.
2. Check Guidance – help.
3. Check your NTN detail.
4. Update you status like last company (start date and end date etc).
5. File the return.
Once you will file the return, they will not send you any document at your home. You can give them the proof that you filed the return.
You can also
contact them to clear this issue.

Please note that, my personal experience for Support of ebfr is not good, All are F.A , Martic pass guys in call center, they will not guide you well.
I’ll try to get phone number of some responsible person in FBR or PRAL then will share it to you guys after permission with him.

I need to open a bank account with a company name for my small online consultancy work. For that I need an NTN certificate from FBR.
I am a government employee and tax is deducted from my salary, but I do not know my NTN number, neither i have filed any return so far.

Should I apply for NTN certificate directly (via web), and do i need to file my all previous returns ?
(as i have small income so dont wanna hire lawyer or pay much taxes)
will my new NTN (for company) be the same as my previous NTN for my salary income tax?

NTN is different for individuals and for the company.

Once you will click new NTN - It will show you the options (indiviual, AOP (Association of partners), company).

About previous file, You can file maximum for last 3 years through the website.

Both NTN (for company and yours) will be different.

Thank you for your reply. I have tried to search my ntn number via my cnic number but it says "requested information not found,...".
does that mean I am not registered with them?
And will there be any problem if I do not mention about my government job and just apply for business NTN. (e.g. if I do not want to file the last years returns).

Moreover I want to apply for NTN certificate as a "Sole proprietorship" and there is no option for that, there are only three options (individual, AOP and company")as you mentioned also.
does the "sole proprietorship" thing comes under "ndividual" category, and If i select that then there is some portion about business details, but suppose I give my business details there so will I get the NTN on my business name or Individual name. (as i need it on my business name to open bank account).
