SC issues notice in National Police Foundation land scam case

Islamabad—The Supreme Court on Tuesday issued notice to M/s Land Linkers of Pakistan Muslim League-N legislator Anjum Aqeel Khan through secretary ministry of Interior over a Rs6 billion land scam.

Chief Justice Iftikhar Muhammad Chaudhry while fixing the case for June 15 also directed for issuance of notices to Chairman, National Police Foundation, holding the charge presently and during the period when the property was purchased from M/s Land Linkers. They were directed to appear and file comprehensive statements about the allegations made against them. However, those who have retired from NPF but otherwise were responsible for the illegalities should also be served upon through official agencies, the CJ ordered.

The CJP issued notices after observing that a perusal of report by the ministry of interior indicated that a considerable amount belonging to allottees of the plots, National Police Foundation and employees of the Police had not been acounted for completely.

“Thus, it is a case where protection to the property of NPF and allottees has not been provided, therefore, case may be registered under Article 184 (3) of the Constitution and notices be issued,” the order said.

The Chief Justice of Pakistan had taken notice on a news clipping published in section of media that a “confidential inquiry was submitted before the Secretary Interior earlier this month in which it is stated that a member of National Assembly namely Anjum Aqeel Khan is involved in a six billion rupee land scam in which he was aided by four former National Police Foundation officials including former Managing Director.”

Aqeel was allotted 162 kanals of developed land without a formal agreement and as per this ratio he had to provide 300 kanals, but to date he had provided only 71 kanals and he was yet to provide 229 kanals on account of affiliation of land and an additional 100 kanals on account of double purchase.

The report said Aqeel was an accused of fraud as he had allegedly not transferred 329 kanals of land to NPF. On the other hand, he acknowledged that he had arranged the land on behalf of NPF, but denied causing any loss to the NPF, (or) being part of any such scam.

Report was called from the Secretary Ministry of Interior, which stated that “MNA Anjum Aqeel Khan is involved in a six billion rupee land scam in which former National Police Foundation (NPF) officials including former MD are involved.” After going through the report, the comprehensive follow up report was called from Secretary Interior and Chairman NPF for

People had been talking a lot and complaining about these villas a lot. Now that these have been balloted and letters are under issue, I find no one commenting about there location minuses and pluses.

One of the most important thing in today's advertisement is
DHA Lahore phase 5 extension location. Now its official that DHA phase 5 ext will be located next to Askari phase 11 and location map also indicate DHA Lahore have enough land for all DHA phase 5 ext files.

Now when they will hold ballot of it I have no idea but with this new development It feels we are getting closer and closer to DHA 5 ext and DHA 9 ballots.

You will have option to pay plot price in installments if you plan to hold plot for long term or if you want to build a house right away you can pay full amount now and get possession right away and start your house construction.

As my part, DHA Town is far better option for 5M than DHA-9, as
location of DHA Town is mentioned but not for DHA-9. DHA-9 is v huge area and definitely due to small size the 5M plots will locate at trivial area.

From the ad, it would seem that this is yet another smart initiative by DHA to collect huge amounts of interest free funds to utilize for either some investment or fixed term deposit. Smart because they know that the greedy public can't resist games of chance/luck.

1. No quantity given for the plots on offer, and how many in each phase/category (tens, hundreds, thousands?). So no one can make an informed decision of the probability of getting a plot, instead of their money back in a few months. But hey, if you're a believer in prize bonds, then this is just the thing for you!
2. No information of the plot
location. This is very odd. Do CDA/LDA do this kind of selling of plots? No, if you have an exisiting location on the ground and you want to maximize return, you AUCTION it. Market forces come in to play and everything is transparent. So why is DHA so benevolent? (It would be nice if they could show some benevolence in their existing commitments and deliver the already sold phases on time or within the same decade as initially indicated).
3. By pricing it just a little bit below average market price, they ensure tens of thousands of applications. DHA makes up far more money by the potential interest on deposits, and also many of the plots will be below average and some above average. For example, if they get 50,000 applications, avg Rs 1 million down payment, earn 10% on a fixed term deposit for 3 months, they earned Rs 1.25 BILLION in interest income. That is the sale value of 250 ten-marla plots!

Some relevant phrases that come to mind here:
A. THE HOUSE ALWAYS WINS
B. IF YOU LOOK AROUND THE TABLE AND CAN'T FIGURE OUT WHO THE SUCKER IS, IT'S YOU.

It is sad that even now, they are no (enforced) regulations that oblige an organization collecting public funds to disclose relevant information. People who don't learn from history are doomed to repeat it....

Salam, I have a question as well. I am a bit confused. Is this form and RS. 5500 fees is for ballotting ? Like i mean They will take application form from thousands of people and will do KURRAA ANDAZI and the number of people will get plots who will get in the draw ?? or anyone who apply for a plot with this form will get a plot allotment if they want to go ahead ?

I am not sure if my question make sense or not. Basically i am asking if this is a draw kind of thing on which allotment of plots is based or everyone who will apply will get a plot ?

From a gambler's point of view it is an option to get a plot on instalments with a chance of good
location; otherwise losing Rs. 1 to 5 lacs & difficulty of getting rid of it in the market as we have already got a huge number of sellers in Ph 7 & 8. Phases 1-6 have already been balotted for the good locations & some forfieted plots may be left with DHA,7-9 posession date matters.

From an investors's point of view I suggest he should wait to opt for a good location plot & pay a little premium to get a plot on instalments after the ballot.

I can understand why DHA is allowing people to purchase in installments where houses aren't built yet, however even this suggests that DHA is losing its edge and has to resort to these measures.

But in Phase 1-5 if they have any plots then they should be auctioned. I cannot think of the reason behind allowing people to pay in 3 year installment in the older phases unless DHA wants to accomodate some selected persons.

To make my above comment a little more balanced DHA does enjoy more trust of public as compared to other societies because it has delivered more than others in the past which is why many would apply. Each person has the right to choose whether to apply or not but we should all be aware of the lack of transparency and that the applicant's chance of getting a good plot may be less than expected.

If some one plot is in litigation or some other problem its Lda whose responsibly is to provide services and try to solve the case.

Karachi:KPT responds to charges of selling land for peanuts

Karachi Property News: The Karachi Port Trust (KPT) has clarified a report published in The News, after 13 days, stating that no illegal allotment of KPT land has been made by the trust for ‘peanuts’ or ‘a song’ to KPT Officers Cooperative Housing Society, as alleged in the news report.

The housing society was duly formed in 1949 and registered with the Sindh government under the Sindh Cooperatives Housing Society Act, 1925. In view of past practice of KPT, dating back to 1886 when land was granted in the Lalazar area to the Boat Club on a 99-year lease at the rate of Rs0.13 per sq yds, the KPT has been leasing land for various purposes not directly connected with the operations of the port.

With regard to the society, allotments of the 130 acres were made in three stages starting from 1989, 78 acres, followed in 1990, 27 acres and lastly in 1996, 25 acres. Here, the land allocated to the society was underwater and had to be reclaimed before it could be used for residential purposes.

Other cases of grants of land by KPT for residential-cum-commercial and other purposes include:

As to the issue of the allocation of land by KPT to KPT United Workers Front of KPT Cooperative Housing Society, the grant of 250 acres was made by KPT in 2006 to the union for the benefit of employees.

In all the above cases, the Board of Trustees had duly approved the grant of lands subject to the approval of the federal government under the relevant provisions of the Karachi Port Trust Act 1886 where the period of lease exceeded 25 years.

It is also relevant to point out that other government organisations such as PIA, Pakistan Railways, KDA, KMC, CDA, Defence Housing Society, Sindh Bar Association, High Court Bar Association etc have their own housing societies for the officers/members throughout Pakistan.

Even in the case of civil servants of the provincial and federal cadre, once they reach BPS 22, they are entitled to be allocated a plot of land.

As to the award of contract to salvage underwater debris at the cost of Rs1.3 billion to M/s Euro Demolition (BV) Netherlands in 2010, it is clarified, that this was an international procurement being undertaken under the Public Procurement Rules, 2004 pursuant to advertisements appearing in the press. Technical and financial proposals were invited from interested applicants and M/s Euro Demolition was found to be most technically responsive given their international experience.

Earlier, an initial award of salvage work to M/s Indus Divers being a local firm in March 2008 at a cost of Rs77.5 million proved unsuccessful due to the complicated nature of the concrete debris underwater.

The KPT had no option, but to terminate the contract in April 2009 and go for a fresh advertisement and award of the salvage contract under the Public Procurement Rules. All decisions with regard to termination, invitation of fresh bids through public advertisement and the eventual award of contract were taken in consultation and with the approval of the Board of Trustees of KPT.

It is further clarified that the construction company (Ssangyong Construction, Korea) which had submitted various proposals from time to time for the said underwater salvage work was unsuccessful since these proposals were not formal bids and did not meet with the technical specifications of the salvage work involved. It was also relevant that the Korean company would, if successful, have outsourced or sublet the salvage work to some other company which would have been in breach of the Public Procurement Rules and KPT requirements.

As to the objection raised by the DAC to the payment of Rs952.61 million to M/s China International Water and Electric Corp, this was not in breach of procedure since the necessary survey was duly carried out by the KPT Survey Board so that adequate and satisfactory measurements were available at all material times.

The DAC has now ordered that the documentation record of KPT be duly counter checked to remove this erroneous objection. Similarly, the objection for failure to deduct and deposit income tax on payments to the same company is also misplaced since the company is tax exempt under Pakistan law. The DAC has also ordered that the tax exempt status should be counter checked by their officials with the Federal Board of Revenue, hence this objection is also incorrect.

Tariq Butt adds: The clarification issued 13 days after the story which appeared on June 18 itself shows the ‘efficiency’ of the KPT.

However, the KPT’s irregularities and lapses, and the loss it caused to the national exchequer were incorporated in the story from the latest report of the Auditor General of Pakistan for year 2010-11.

It is pointless to clarify the story that is based on an authentic government document, which is presented to the president of Pakistan, parliament and the Public Accounts Committee as required under the law. It appears that like several other government organisations, the KPT too did not act efficiently and timely when the AGP was carrying out the audit or it has skeletons in its cupboard that it hid from the AGP.

However, the clarification confirms the irregular transactions but did not respond to a major AGP objection that KPT did not produce record to the audit, and its non-presentation may create doubts as to the actual existence of it at all, and that its Board of Trustees was not authorised to approve these dealings under the rules and law.

The justification that the KPT has given for its irregularities and lapses costing the public exchequer billions should be forwarded to the audit so that it could judge its relevance. The lease of land for a song to the two housing societies of KPT officers and other employees was such a gross lapse that the audit recommended fixation of responsibility and disciplinary action against officials found responsible. Even otherwise it appears a cruel joke that the land was leased just for 10 paisa per sq yard per annum.

The KPT’s argument that other government organisations have their own housing societies for officers, and members have no relevance to the irregularity that it committed, as per the audit, in leasing hundreds of acres of land to the two housing societies.

The clarification did not respond to the objection that when the local firm abandoned the work for removal of concrete structure of collapsed berths, fresh bids were invited, and thereupon, the international firm, which had quoted Rs400 million, quoted Rs800 million for the same work, but later the contract was awarded at a cost of Rs1.3 billion. It only said that all decisions with regard to termination, invitation of fresh bids through public advertisement and the eventual award of contract were taken in consultation and with the approval of the KPT Board of Trustees.

The audit had not agreed to this argument, and had also stated that no record of abandonment of work by the local firm was provided to it even upon repeated request, which was in violation of rules, and in the absence of the record, the propriety and probity of the expenditure could not be ascertained.

Even several months after the audit, the KPT, as per the clarification, is yet to check from the Federal Board of Revenue the status of irregular retention of income tax of Rs24.53 million, which the audit described as a loss to exchequer.

KPT’s present plea and the one it had advanced to the audit earlier was that the company is tax exempt under the law. The AGP had not accepted it as valid.

8,00 plots vacant in OPF housing schemes
slamabad—Around 8,00 residential and commercial plots are still vacant in the different Overseas Pakistanis Foundation (OPF) housing schemes across the country.

Talking to APP, Managing Director OPF Israr Khan Jamali said including that 556 residential and 244 commercial plots are still vacant besides that 59 residential plots and 100 Kanal area of commercial vacant in OPF Zone-V housing scheme.

He said across the country seven housing schemes completed for Overseas Pakistanis including Raiwind road phase-I in Lahore, Bhimber road Gujrat, Naudero road Larkana, Moro road Dadu, Budhni road Peshawar, Chittarpari Mirpur AJK phase-I,II,III and Airport road Turbat.

The 55% development work has been completed of OPF, Housing Scheme Zone-V and soon allotment letters would be issued to the allottees.

Israr Jamali said that 25 schools and colleges established throughout the county to look after the needs of children of Overseas Pakistanis adding that more five new colleges would be set up soon across the country.

Around 6.3 million Pakistani work force working abroad, including Africa 95,508, America 1,206,297 Asia & Far East 199,945, Australia & New Zealand 35,000, Europe 1,773,413 and Middle East 2,991,108 respectively.

Ministry of Overseas Pakistanis has established 21 offices of Community Welfare Attaches (CWA) in 15 countries to look after the welfare of the Pakistani emigrants, he added.

CWA to safeguard the interests of the Pakistani emigrants in the host country and settle their dispute, if any, with their employers.

Managing Director of OPF Israr Khan Jamali said that the main purpose of its to advanced the social welfare of the Pakistanis working overseas and their families in Pakistan by identifying their problems and contributing their solutions.—APP

I am living in gujrat since birth and a banker by profession. I am planning to change my house and to shift in OPF housing society Gujrat. A 10 marla plot will be suitable ideal space for me and my family. I would preffer a cornor plot. Looking forward to your reply.
