Dear All,
As salamu alaqum,

I have to write about a serious issue regarding rental of my house in Wapda Town, Lahore.
I gave it out on rent; on 1st January 2011, therefore the 11 months agreement will end on 30th Nov. This month when a went to collect the rent I gave my tendent a written notice for one month, I wanted him to sign the photocopy so that I have a receiving from him. He insisted that he would NOT sign the recipt of that notice. Moreover, he said that he could not vacate it in September. He would do so in October otherwise in November.

I am having some doubts that he will not even vacate in October, but the fact is I have to shift back to my place as soon as possible.

I am therefore seeking very serious and helpful advice how to resolve this issue amicably.

Contracts are signed to be honored not to be breached without valid reason. You have committed to rent the house to him till end of November so why are you serving him notices to vacate early? Is he not paying the rent? Is he damaging the house? Is he making structural changes in the house without your permission?

There can be a termination clause in the rental contract which explains under what conditions the contract can be terminated by either party. Does the termination clause in your contract allow you to terminate the contract at any time without reason with just one month notice? If not then YOU are the one creating problem for your tenant.

You can give him notice to vacate upon completion of the contract period and if he continues to stay, then you can start the legal eviction process. If your tenant has agreed to vacate in October he is an exceptionally nice guy. My helpful advice to you is to go apologize to him.

I wouldn't be able to act upon your advice as the agreement has a clause for one month notice from either party.

Please if you can comment on the attached plan which is draft only.

This is ground floor only of a corner plot of 61 x95 size. There will be no first floor ( may be in future) . Requirement is three bedrooms. With one additional guest bedroom which will be used very rarely ( that is why it is small). The north direction is from left to right. It is essential to keep 5 ft one side only and minimum 10 feet on front side only as per local laws.

You can see two staircases here.The plan is to have second unit on ist floor in future to be rented out.

Hope to have some useful comments before i go to the architect.

I am also going through designing phase of my house construction. During the process i was advised by a friend to have three distinct portions of your house ie FORMAL, SEMI FORMAL & PRIVATE. In formal area its your Drawing ,Dinning & Guest bed. In Semi formal area its your Lounge & Kitchen and in Private area comes your Bed rooms.Kindly see it for yourself whether your design meets this requirement.

my observations:

Try to move the lounge in the centre of the house. Then practically your house will feel bigger, right now its congested Corridor with a & stairs are eating lots of space. You already have access to back yard through kitchen. Redesign & Combine both walls of bedrooms, it will save some bucks in construction. Why you need a guest bed in front of the house with private access & also bathroom in front of the house!!!! that's ugly.

Dear Sir,

It is not a good design because,

1. Lounge is used as an Entrance Lobby as well. This is the place where family spends most of their time. People in the Lounge should be left undisturbed.
2. Guest room should be part of DD area. Guest should be able to use the DD without compromising the privacy of the house. In this design guest will walk through the lounge to the DD.
3. A lot of space is wasted in corridores.

My advice for you is to hire some good firm of Architects & give them your requirements. In Pakistan Architects, really, are not expensive & they do a good job. This will help you not to regeret after investing millions of rupees on your house otherwise people will say "Penny Wise - Pound Foolish"

Recommended change:
Exchange Lounge area with (drawing/dinning) area, As you know most of the time family will be sitting in the lounge. and when the family is sitting in the lounge, they shall enjoy the beautiful view of the lawn with beautiful color flowers with green grass all the time.

What's missing here is a lobby. You have direct entrance into the lounge, which is not a good idea for reasons already suggested above. Your bathroom sizes are also a bit on the smaller size for a house this size, at least 2 of the bedrooms should have bigger baths.
Also you have to pass through the dining room to go into the drawing room which is again not a good idea.

Faisal Bhai you have a big, nice, corner plot. Pl. consider building 2 nos. double story (Back to Back) units with DD, Lounge, Kitchen & one bedroom on the ground floor & 3 bedrooms, servant room & a pantry on the 1st. floor.
You can complete foundation for both units but complete only one unit leaving the other to be completed in future.

Income Tax on expatriates-Important Question

I need guidance and advice with regards to Income tax in Pakistan. All my career has been outside Pakistan and so have been all my earnings. I bought a property in D-12 Islamabad worth 70 lacs last year. there was additional Tax ( CST i think) around 2 lacs which i paid. I received a postal mail from Income tax deprtment directly at my local address in Pakistan refering to this purchase and asking me to open an income tax account in Pakistan since they dont have one under my name. Apparenly, they want me to be in the tax net in future.

My quesitons:

1. Is my foreign income in Pakistan taxable ? I dont have any earning in Pakistan.

2. Considering I always used legal channels to send remittance and bought this plot, does this exempt me from paying income tax ?

3. How should I reply to this letter ?

My point is that if I am not earning in Pakistan, why should I pay the income tax. But I am may be wrong so I would need advice from those who are aware of the rules or who have experienced the same.

Your foreign Income is not Taxable,
Your incomes on Bonds, stock, rent all Collective is taxable
You may need to decalre your assests If You open a Tax file
At present there is no wealth Tax in pakistan.
To satisfy Tax Dept You might have to show How 70 Lac Tansection took place that needs the evidence of Transfer of Money From Abroad.

For All Overseas Friends.
when buy a property in Pak always do transection by legal Channels ie Bank to Bank [no Hundi at all]
Keep a record of that Transection slip and Bank statement in Pakistan of that period.
Banks are not obliged to keep statement record More than 10 ys, and to obtain a Bank record older tha 3 years is also a headache asBanks's sofware continue changing every now and then

yes if they asked you then you will have to but not necessily Tax is due, a Tax Consultant can guide you for that.
Minimum will be to send an official registered letter to the office who asked for Tax Returns, attach copies of evidence. This letter will be registered and in case of future issue will serve as reference that you officially replied the Tax Dept.

I could see Railway line in the pictures, which clearly indicates it is DHA Phase II ext not DHA Valley. Because Phase II Ext is along the Railway line and beyond. DHA Valley is far away from Railway linesa. Definatly somene wants to unload its plots in DHA Vally.

AK. Imagery date of DHA Valley on google with me is of Mar 2010.DHA Lhr of course is May 2011. Am I missing a layer in DHA Valley? Please recheck and advise how can i get the May 2011 Layer. I am using the latest Google Earth (free)on Window 7 OS. Thanks.

Click on the year box on the bottom right. When you click that box on top left it will give you timeline bar. You can drag the bar to the latest image which is 5/2/2011.

Why we always pessimistic and think negatively. Why we can't believe that work is in progress at DHA valley site. These all picture are available at DHA Valley Official website (www.dhai.com/dhavalley). Google earth is not updated for this area after March 2010 (I think so).

Its not about being pessimistic. Its more about being realistic. Have you ever seen someone who visit the site lately sharing latest pics.

If you want to believe that work is being done... No one has objection. But people who have invested so much money are concerned about real progress not some pics posted by DHA itself.

Also I am wondering how come Google image of May 2011 has updated images of rest of the Islamabad but not only DHA valley.. Can someone please explain me that?

I would like to add that google map for dha valley area is not updated since september last year...why it is not updated ask google.

Okay lets assume if google map is not updated. Can you please share latest progress pictures excluding the DHA II ext pics which DHA is showing off as DHA Valley development?

My friend my comment was only related to the correction of date of update on google, i did not say anything whether the pictures are for DHA PH II ext. or DHA Valley.

I am also want someone to update the real progress as i am abroad and victim of DHA valley.

Note: This is my sincere request to all Pakistanis (Abroad & At Home) only buy on ground plots as advised by CMY in many posts, it is only because of people like us that these people take advantage.

I have learnt my lesson and other 2 plots i bought as investment are on ground plots even tough they costed much more but atleast i am not sleepless in there case

As a general opinion on the subject i think these pictures are nothing but a marketing gimic from DHA, they are using DHA Valley HOMEs pics, DHA Expressway pics and DHA PH II ext pics all together for both projects.

Fortunately you are financially strong enough to invest more in better options but local people who have invested all life savings in these fraud valley project and can not afford any more.

I am also pushing and gathering people on different forums like facebook and this forum to gather up and file a petition in Supreme Court.
