Inheritance of daughters
Friends, I would like to know how inheritance law is being followed in our society. From what I understand if someone has only daughters then one third (or half, if there is only one daughter) of the father’s assets must be distributed to other people such as father’s brothers/sisters (nephew’s/nieces if siblings have died).

Is my understanding of the rule correct? More importantly I wish to know how this rule is actually practiced in our society. I have never seen father’s assets being shared with the daughter’s uncles or cousins. Does it ever actually happen? Or people work around it someway. Please comment based on your observation.

It can happen if someone's relatives go to court. But in this situation people used to divide property to his wife & daughters in his life to avoid such complications lateron.

If a person have one or two daughters then all inheritance goes to them/her as per Pakistan law. On the other hand if person does not have any son or daughter then 1/2 of property goes to wife and 1/2 goes to Brothers and sisters of deceased.

it is not as simple as your question first thing you are asking law inheritance law is being followed in our society ,society law is killed the woman to protect property or marry the girl with holy quran (nowzubillah) .there is islamic law for inheritance (could not be changed ) write down the name of every first blood relation and handover to MUFFTI for answer . all fiqah have same fatwa .

I also very much concern with this distribute of inheritance. Dear all participants in this discussion - Please note that this is very important to ask this question to any qualified Islamic Scholar (Mufti Sahib) rather than having discussions without actual knowledge/fatwa. Like we do not ask everybody to suggest treatment for any disease and we straight go to a qualified and specialist doctor to prescribe treatment; similarly, we must refrain asking everybody to give opinion on this question and better we go straight away to Mufti Sahib to explain this distribution methodology. If somebody knows real fatwa on this distribution he may mention here for the information of all readers but he must be careful while stating the fatwa keeping in mine that any mistake in the statement can lead thousands of people to opposite direction of Islamic Orders.

Dear Afzal Aslam and Abdul-Qadir I appreciate your desire to help and understand that in order to correctly know the rules one should consult Islamic websites and a Mufti. However going into the details of Islamic Fiqah is not the focus of my question here. I just want to know if the deceased person’s children are only girls does the asset end up getting shared with others besides the girls or not . I just want to know the GENERAL PRACTICE in our educated urban society. What is your observation in this regard?

Hadia this site is not the best source to understand the details of fiqah. We should contact scholarly sources for that and make ourselves comfortable with what Allah has decided for us.

I understand that in his life time, a person is allowed in Islam to give anything as gift to his daughters. I just want to know how many people make use of this permission to let their daughters have all their assets. Jameel, if your information is correct then that answers my question but I am not sure if it is accurate. Can someone else please confirm? Thank you all.

The laws of inheritance are spread out in several Suras. One can find references to them in Al-Baqarah(2), Al-Maidah(5) and Al-Anfal(8). But the details of these laws are spelled out in the Surah Nisa (4).

Verse 4:11 says that if a man has only one daughter, she gets half of the inheritance irrespective of other heirs. But since the same verse says that the portion of the male is twice that of the female, her brother is supposed to get all the inheritance. The perplexity arises when the share of other heirs, like parents and wives are taken into consideration. That is the reason the different Maslaks interpret it differently.

There are cases when the total of the shares assigned to the heirs exceeds the patrimony. for example:-

According to the above verses (4:1), if a man dies leaving behind a wife, three daughters and his two parents,

His wife’s share of his inheritance is 1/8. (In what ye leave, their share is a fourth, if ye leave no child; but if ye leave a child, they get an eighth)
His daughters would receive 2/3 (if only daughters, two or more, their share is two-thirds of the inheritance;)
and his parents each will get 1/6 of his inheritance. (For parents, a sixth share of the inheritance to each, if the deceased left children;)
When you add all these fractions the sum is more than the total of inheritance.

Wife =1/8 =3/24
Daughters = 2/3 =16/24
Father= 1/6 =4/24
Mother=1/6 =4/24

Total =27/24

This is the reason, share of inheritance is different in different sects according to the interpretation of their respective Muftis'.

Please consult do consult a Mufti for the right answer.

This info was collected for a deceased person who left five daughters, one wife and a father.


(1) Wife: will get 1/8 share of the estate (2) His Father: will get 1/6 share of the estate and also if anything saved after giving every one their shares, will go to his father (3) Daughter: 2/3 of the estate will be divided equally among five daughters.

If the house is on wife's name then it won't be divided or if she is the joint owner then she has the half share and half will be divided (because it is a gift in his life to his wife. Same as he has spent money on his two daughters wedding but all daughters are still getting the same share).

- If he hasn't performed Hajj then money can be spared for hajj-e-badal.
- If he was a rich man then sadaqa can be given which will benefit him a lot.


Abdullah ibn Abbas (RA) reported that the Prophet Muhammad (SAWS) said, "Give the Faraid (the shares of the inheritance that are prescribed in the Quran) to those who are entitled to receive it. Then whatever remains, should be given to the closest male relative of the deceased." (Sahih al-Bukhari)


Allah says:
Allah directs you as regards your children’s (inheritance): to the male, a portion equal to that of two females. If there are only daughters, two or more, their share is two-thirds of the estate; if there is only one daughter, her share is a half. For parents, a sixth share of the inheritance to each, if the deceased left children. If the deceased left no children, and the parents are the (only) heirs, the mother has a third. If the deceased left brothers (or sisters) the mother has a sixth. This is after the payment of bequests and debts. You know not whether your parents or your children are nearest to you in benefit. These are settled portions ordained by Allah; and Allah is all-knowing, all-wise. [Sûrah al-Nisâ’: 11]

"If (there are) women (daughters) more than two, then for them two thirds of the inheritance; and if there is only one then it is half." [Quran 4:11]


"And for his parents for each of them there is one-sixth of the inheritance if he has a child, but if he does not have a child and the parents are the heirs then for the mother one-third." [Quran 4:11]


"And for you there is one-half of what your wives leave behind if there is no child, but if they leave a child then for you there is one-fourth of what they leave behind; … " [Quran 4:12]


"And for them one-fourth of what you leave behind if you did not have a child, but if you have a child then for them one-eighth of what you leave behind; …" [Quran 4:12]


"And if a kalala man or woman (one who has neither ascendants nor descendants) is inherited from, and he (or she) has a (uterine) brother or (uterine) sister then for each of them (there is) one-sixth. I am very grateful to all the brothers who have posted very educating replies BUT:

USUALLY people die when they are somewhat old and their parents are already dead. In this case if a person leaves behind only a wife and a daughter then paternal uncles/aunts (or their children if they are also dead) have a share in the assets.

I am still wondering if people (generally) allow their assets to be shared between their daughter and her cousins or do they try to work around it by gifting their assets to their daughter. Is working around in this way a sin or is it okay?

I discussed with someone who knows better, If you have only one or more daughters then you Brothers and sisters can claim right through court. Best way to avoid this problem is to transfer the property to wife.

Each inheritor must receive exactly the share that he or she is granted in the sacred texts, no more and no less. These Muslims should fear Allah. They should resolve themselves to Allah’s decision and not seek to bar their inheritors from what is rightfully theirs. They should think about “a Day in which neither wealth, nor sons will be of aught, except for those who come to Allah with a pure heart.”

It is forbidden for anyone to make a bequest in a will giving some inheritors more than their appointed share of the estate except with the express and willing permission of all the inheritors – including the daughters. This is a point of unanimous scholarly agreement.

Anyone who bequeaths his wealth to some of his inheritors at the expense of others has disobeyed the command of Allah and the teachings of the Prophet (peace be upon him). He has not only oppressed his inheritors, he has oppressed his own soul.

Muslims must follow all the commandments of Allah (SWT) as Allah the Almighty says, "It is not for a believer, man or woman, when Allah and His Messenger have decreed a matter that they should have any opinion in their decision. And whoever disobeys Allah and His Messenger has indeed strayed into a plain error." [Quran 33:36]

"And whosoever disobeys Allah and His Messenger, and transgresses His limits, He will cast him into the Fire, to abide therein; and he shall have a disgraceful torment." [Quran 4:13-14]

The Prophet (peace be upon him) gave us a stern warning against such crooked dealings. The following is related from Abu Hurayrah in Sunan Abi Dawud, Sunan al-Tirmidhi, and Sunan Ibn Majah:

Allah’s Messenger said:“A man and woman might live their lives in obedience to Allah for sixty years. Then when death approaches them, they give unjust bequests, and as a consequence are consigned to the Fire.”

Almost all arguements are given to deprive daughters of their fair share or minimize it. I request you to read my original question and the two replies that I have posted above. No where have I supported being insincere to Allah's decision. Nowhere have I talked about BEQUEST in violation of Quranic law. I have not even raised the question of bequest. Such a bequest probably has no legal value anyway.

My question was regarding GIFT that a person is allowed to give to his daughters WHILE HE IS ALIVE. From what I understand Allah has not forbidden to give gift to ANYONE not just daughters. Whether such a gift designed to protect the assets from going into the hands of daughter's cousins after the father's death amounts to insincerity towards Quranic laws of inheretance OR is it something perfectly acceptable in Islam is a big question in my mind. However this is a question of Fiqah and therefore I am not putting this question to the readers of this blog (unless some reader happens to be qualified himself or has already consulted a mufti in this matter). I think a qualified scholar would be best to answer this.

My question was that of sociology not religion. I just wanted to know what is the general practice in our society. Personally I do not know of a single case where assets have been divided between a "girl only" family and the cousins. May be other readers have different observations.

1 Get Copy of Docs from seller
2. See if allotment or Exeption [Allotment is better]
3 Make sure that ws not a special quota if yes then seek expert advice if widow quota then it is not transferable other quota were transferable after 10 ys but case to case variation is there.
4 Ask house have completion certificate or not.
If satisfied
5. Then make a deal and tell owner to get NOC
it is 3 months process and needs some follow up
6. Get LAC clearence
7. Get Ptawar Khana [inside LDA] clearence
8. Get account dept clearence
9. Get TP [Town planning] clearence
when NOC is hand then
10. Fill transfer set and get appointment in LDA office, Before that buy stamp papers required
11. Goto office with seller on date specified
Give Balance payorder to seller and Let him sign and thub impression before LDA officer Both of you will have Photo graph there
Original Transfer letter is ready in 2 days
12. Dont forget to get old file from seller and make sure this old file contains all necessary things
This just highlight you will need expert advice on many steps
The steps will bit easier in Plots

The procedure you described is very complicated.
Is the same procedure followed in other societies like DHA, Wapda town, Askari-10 and township etc.
For expatriates this procedure seems to be quiet difficult and almost impossible.
Can you simplify your procedure and also pleast mention what risks are involved in house buying process.

I Think LAC report, LDA Patwar Khana report , accounts report all are part of NOC, I recently bough one house in LDA area, best thing is to pay small biana which you relative or brother can do and then tell owner to get NOC, one can get it in one month, Once you have NOC then process is fast like DHA, Like after NOC I did every thing in one week, And 8th day I was back to UAE, But as a whole the process continued for 6 weeks. Owner Claimed that he paid nominal bribe like 4,5 thousands at one stage but all papers were clear.
If there is no completion letter then it is big headache sometimes it cost more than one lac, Of course some bribe but hefty fine for violation of building codes, One person known to me tried to build 3rd story only 1/3 of covered area on the Back of house, it was not showing from road but still LDA came in action and they stopped the construction and he had to pay 3 Lac fine plus some bribe .

Asalam-o-Alaikum

Experts i'll be thankful if you get me out of the confusion. I want to buy at least 7 marla plot in Lahore. Now i have decided two schemes to chose from for the plot. One is the Jubilee town D-block and second is the Eden Meadows.

I want to buy plot in Jubilee town because:
1-The price is 10 to 11 Lakh that i can manage to pay and get a plot of my required size.
2-I can build my house any time after buying it.
3-Currently my office is in Johah Town, It's near to it.

I do not want to buy plot there because:
1-There is no population and i am not sure how many years it'll take to get populated
2-Currently my office is near to it, but every person switch job and most of the software companies are in Model town, jail road and ferozepur road, so in that case, the office shall be far away from my home so travelling shall be increased.

I want to buy plot in Eden Meadows because:
1- It's 12KM from Kalma chowk and i can move easily to any location from eden meadows like Jail Road, Ferozpur Road or any other place because travelling shall be reduced
2- Most of software companies are on this side, so my distance from office shall be reduced if i switch my company
3- The scheme shall be more beautiful and secure than Jubilee town.

I do not want to buy in Eden Meadows because:
1- It is expensive costing me more than 1800000 in 4 Years
2- Possession shall be available after 3 and a half-years. I am not sure about it that Eden people shall meet their promise.
3- It might be that it is not well populated after i get possession of the plot and so could not build house even after 4-years

Dear Moazzam, MUST not trust on the promises, just go for on ground realities at present. I am of the opinion that one should consider quality living and distance should be the second consideration. Any society on canal road till Bahria Town is of good choice. You may get 10 marla at Bahria Town in this budget and start the house right now.

It is just a mix of water, brown sugar and yeast.

1. Cut a plastic bottle in half, keep both parts. Can be Coca Cola / Pepsi bottle.
2. Take the lower portion of the bottle. Dissolve the brown sugar in hot water. Let it cool down to 70 degrees F.
3. Add the yeast. Carbon dioxide will form, which will attract the mosquitoes.
4. Cover the bottle with a dark wrap and place the top portion upside down like a funnel. Place it in a corner in your house.
5. In 2 weeks you will be surprised by the number of mosquitoes killed.
