Assalam-o-Alaiqum to all,

I have a general but very important question how to transfer the inherited property Houses among Sons/Daughters & Widow but before that let me give you brief overview of this family property and would need humble advices from LRE and you the READER of this Forum if you have gone through like this or know anything about this.

- Location: in Northern LAHORE

- Land bought by our deceased father in around 1965 and built houses later in 1970 and 1995.

- 2 x Family House (double stories) besides each other (size of One House: 20 Marla, Size of Second House: 15 Marla)

- Number of Children : 6 x Sons, 4 Sisters, 1 Mother (May Allah give her long healthy life. Ameen) where all children have been married.

- We all brothers divide this property among each other on mutual understanding where one brother has taken his financial part (Hissa) and signed Affidavit about this payment he has received from us and living separately in his own house. So, 5 are left including myself

- Currently 5 sons & our mother are sharing this property houses.

- I'm living abroad so only 4 sons are living currently and my part is not being used by anyone and visited Pakistan once in a year.

- I've spoken to my eldest brother who has been dealing with all financial and family matters for us since the death of father.

We all brothers/Sisters have kids & life is going on but I have worry to transfer this property to our names (Brother/Sisters/Mother) so there won't be a legal problem for our next generation (Grand children of our fathers) when we die and no dispute among our children when they took over our places.

I've spoken to my brother couple of times to transfer this property as soon possible whatever cost occur for this and he checked it with some of Patwari and other officials few years ago, and came to know that the person who sold this land to our Father that we are living on and similar property in our area that person sold to other people had been pledged to bank and had taken loan out of it & never returned that loan to Bank. That person is in Canada and never returned to Pakistan and is defaulter. May be he has died but we never know about him.

So now question starts from here:

1. Can we transfer this property to our names even Seller is defaulter to Bank neither our father nor us are aware of this unless few years ago after death of our father.
What are best options to transfer this as I heard there are two ways to transfer: one through Patwari and other through "AG Office"? Which one is more authentic & economical process?

3. Any idea about the transfer cost involves

4. Unfortunately Two of my brothers have been passed away but their families are still living with us in their part of the house. Would two deceased brother's part of property be transferred directly to their widow & children?

5. What other things we need to take care while transferring this to us Brother/Sisters/mother?

This should not be a problem. If the land has been mutated (intiqaal) in your father's name, you are in good shape. In the jamabandi, the word "murtahin" must have been mentioned to indicate loan outstanding. Bad news is you will have to pay the loan. Good news is it must be a very nominal amount probably less than few thousand ( or may be even few hundred) rupees. These loans used to mostly taken for seeds and fertilizers. If it were a bigger loan, then it would have been quite difficult for the mutation to have been done in your father name.

The Land was transferred to my father's name long time ago and we have all those documents. Just to let you know its not us but other land in same place we live was owned by that defaulter so not sure how other poeple have done it but we concern to ours.

Would you or anyone
update how much would the transfer cost be calculated for this family property because I believe sooner is better and there is no benefits to delay as cost of everything is increasing?

What points will be take into notice while calculating the transfer charges: for example, CVT, Stamp Duty etc. (I'm not very good in these matters, so please ignore if I ask a silly question).

Please take your time and reply for above questions I asked from this and previous post?

You will have to produce death certificate of your father, proof of legal and agreeable heirs and you will have to give an ad in newspaper if any entity have any objection on the impending mutation of this property. You can
contact the area sub- registrar to know the exact amount of transfer fee and stamp duty etc.

Bahria intellectual village

I recently bought a plot size 35/85 on a good location and now want to construct a house. As it is my ist experience guidance is required from brothers for accomodation/ map and expenditure . It will be a dbl storey house for a budget of arond 50 lac. Should igive to con tractor or do it myself.

Rawalpindi, sandwich between Bahria Ph-7 & 8. Also DHAI-1 sector E and F. These 35x85 plots facing swan river, very nice
location and plots. I personally visited plan in January, wanted to buy but they were sold out. There was one available on the back road but I did not like since they were facing 50x55 plots, I heard that Bahria partnering with some of build 5 marla houses there.

the one facng 50/55 are also not bad as they are not on main road . The facing soan river are 3 lac more expensive. Any plot of this size facing soan river or 50/55 should be bought as I think it will cross 50 lac by mid next year as construction is in full swing in this beautiful area

its a personal choice. I would rather buy 1 kanal in phase-7 and build but my budget is no more than 35 lacs.

I am surprised how you guys r praising bahria intellectual village.
Please take a contractor or civil engineer with you to see the site, most of the area is land filled except the 2 and 4 kanal plots on top of this small hill.

These 35x85 and 50x55 plots especially are on far lower height and are made up on soan river bed.

secondly, if you have chosen it for view then you'll see it urself that sectors E and F of DHA 1 are at much much higher
location.

Please take some technical or expert assistance, its not what it looks like...

And if you need further assurance, go and check with those who have constructed there, they will tell u how they are suffering from these land filled area

what your thoughts on sector-A of Phase-8 and Sector-6 of Bahria Overseas Enclave? that area is along soan, also land filled? there must be instruction or a way to build in those areas since Bahria phase-3 was also land filled but its all populated.

you may buy a good one kanal plot in sector D, much much better place than 35x85 plots in Intellectual Village,what i have learned with experience that one should buy/own a maximum size plot at one certain place. In future you will see that even one kanal plots in I. Village will be considered smaller plots as compared 2 or 4 kanal plots - never ever buy a plot to be called ,chooti colony, lateron if one can afford

Agreed, It is stupidity to buy so expensive unit in Silver Oaks, in which one do not own land neither the roof. In this cast one can easily buy a plot and construct much bigger covered area house.

The society you are talking about is PCSIR Staff. Unlike PCSIR - I or PCSIR - II, the development standard in this society is not very good. The
location and approach is fine but there is a reason why the houses are cheaper than surrounding areas.

My knowledge about it is only limited to one visit of the area. Someone who has the experience of living there can tell in more detail. But if I were to decide for myself and looking to buy in the area in this budget, I'll prefer a 10 marla house in Punjab Govt Employees or Wapda Town.

One advice however: You are going to make a significant investment, do visit the area before making a decision so that you are comfortable yourself.

Bahria Jeniper Block

I own a plot in Bahria Town, Sector 'C', Jeniper Block and planned to build a house. If I start construction now, it will be completed in one year, Inshallah! Will this area be populated and live able in next one year because very few houses are built at this stage. Is it also safe since the road from Jeniper is connected to Main Canal Road and I am not sure if there is any security gate or boundary wall on the other end. :h

This will be highly appreciated if some one from Islamabad can shed light on TRUE development status of sector D-12. How many houses are under construction and what facilities are available and what is still remaining ? What is the status of Margala Avenue :h

Also, there are around 150-200 house under construction. Only about 5 - 10 are being lived in by the owners. The biggest hurdle to live there today is that sewage is not officially hooked up. Per the worker who are laying the pipes, it will be another years till they complete that part 100%. If I was to take an educated guess, I think the sector will be livable by next summer; development cannot linger on for ever, it is moving but at a snail pace.

Lastly, sub-sector 1 has most amount of house under construction, followed by 4, then 2. Sub-sector 3 has least amount of house under construction (source: my worker on-site)

I completely disagree on “90 percent construction work on roads”. No footpaths, broken roads, no plantation rather you see villagers with their animals walking around. Its sad and unfair with those who own land there. CDA is to blame for all the delays.

It is expensive due to greed and incompetence of the sponsors especially the Potohar Builders whose track record is dubious. In their first commercial building (Bizon Plaza) in Islamabad F-11 sector, they played tricks with the tenants and cheated them. In the Silver Oaks the per sq ft cost being charged is around Rs. 8,000/- whereas super super A grade construction cannot exceed Rs.3,000/- per sq ft. This is a shear proof of their greed and incompetence.
