I would request saeed hassan Sahib to refrain posting your ad. as it has no relation with property related matters. On copyright, I myself make my living by creating intellectual property. But set aside the western propaganda on intellectual property rights, I believe our first priority about intellectual property should be it's largest possible utilization. A reasonable compensation to the facilitators of intellectual property should be a secondary priority.

As a small example, several easy to manufacture medicines exist today which can save millions of lives. But just because the poor are unable to pay obnoxious amounts of money to already luxurious lifestyles of intellectual property owners of such medicines, millions die without treatment.

I said above example is small because many forms of productive knowledge are, in long term, lot more powerful in their capability to save and improve lives of whole generations.

So if productive knowledge is not transferred merely due to huge compensation required by otherwise surviving (or even 'chilling') facilitators, thats an extremely sad situation in my opinion.

What bro naveed has said is right to some extent but he has considered only one side of the aspect and probably not understood the term "copyright" properly. You produce some creative work, get it registered and legally become the owner of that piece of work. Now if someone tries to manipulate your piece of work, he can't as the copyright is there to protect your work, so what's wrong in that. Now while talking about a trade off through such work, we should not forget that most of the people get into the business of writing books for example, at old ages expecting predominantly some kind of financial assistance through it. Now if that work is not protected through copyright, you will simply end up with peanuts in hands.Medical profession is totally a different field and has no corelation with someone's creative work being protected through copyright. We have to have some by laws if the system has to run smooth, transfer of knowledge / information should also be subservient to these laws. Just my view point.

I disagree with this argument of acceptability of copy right infringement. Our own intellectuals etc die poor partly because their material is used without agreement. As for medicine example----you are wrong again, it takes a company years and millions to develop A drug, many a times they don't get return back. To keep every thing a float they have to charge via patent which gives them monopoly for a certain time after which every one can manufacture. It's business not charity. It's free market economy no doubt with big players and interests involved.
Every one has some excuse on breaching law like taking revenge yourself, tax evasion- this is similar. Change law if you can don't break it. That creates anarchy.

At last please don't be offended.

Rental income tax

Rental income tax is
quite low in Pakistan

INDIVIDUAL TAXATION
Nonresident individuals are taxed only on their Pakistani-sourced income. Married couples are taxed separately, joint taxation is not allowed in Pakistan.

The tax year is the 12-month period ending on 30 June and is denoted by the calendar year in which it ends. For example, the period from 1 July 2010 to 30 June 2011 is known as the tax year 2011.

INCOME TAX
Rental Income Tax
As of 2007, income from property is subject to a presumptive tax regime. Income from leasing property is subject to a 5% final withholding tax levied on the gross rent.

Individuals earning rental income not exceeding PKR150,000 (US$1,729) are exempted from taxation if they have no other sources of income.

CAPITAL GAINS
Capital gains realized by individuals from selling real property are not taxed in Pakistan unless sales of real property are part of the individual’s business.

Capital gains in connection with a taxpayer’s business activities are considered as business income and taxed accordingly.



PROPERTY TAX


Property Tax
Property tax is a provincial tax levied on the value of property. It is generally levied at a flat rate of 10% but the tax rates vary, depending on the province.

Property tax is levied at progressive rates in the Punjab province.

In the province of Sindh, property tax is levied at a flat rate of 20% on the annual rental value of the land and building.

Capital Value Tax
Individuals who purchase real property in urban areas or acquire the right to use the real property for more than 20 years are liable to pay capital value tax. The tax is levied at 4% on the property’s recorded value. If no property value is recorded, the tax is levied at PKR50 (US$0.58) per square yard of the property.

Above statement cant be true since it implies that for a property of 1 crore, one has to pay property tax of 10 lacs every year!

Your information regarding the rate of rental income tax is out dated. It used to be 5% of gross rent in 2007 but since then it has been slabbed. You can check the slab table on page 303 of Income Tax ordinance. The slabs run from 5% for income less than 400K but it is 10% for income greater than 1 Million per year.

It continues to be treated as Final Tax i.e. it is not eligible for any deductions or rebates.

Also rental income tax is supposed to be deducted by the tenant as "With Holding Tax" provided the tenant is a government organization or a company. If the tenant is an individual then the property owner will pay the tax himself at the end of the tax year along with his IT-Return.

I think Br. MAS is somewhat mistaken.Since 2007, rental income is not added to the income from all other sources for tax purposes. In the self assessment form, this income is declared as a separate block of income & income tax is payable at a flat rate of 5% of gross rent for the year ( no deductions like expenditure on maintenance etc.)

You are right about every thing except for the rate which is no longer a flat rate of 5% (it used to be flat in 2007 under Shaukt Aziz but Shaukat Tareen changed it). I would like you to download the latest Income Tax Ordinance from this FBR link: http://www.cbr.gov.pk/ShowDocument.aspx?Actionid=2664

Now check page 303 and 304. This will clear any doubts.

It is categorized as "Final Tax" which is a technical term used for those kinds of incomes which are not eligible for deductions (or rebates) just as you described.

DHA-8 Development Status ?

Dear LRE :flg
There was news that the DHA-8 development has started some time it was stated that it is patch work and then stated no it is start of development in DHA-8. It is not difficult to confirm specially if one is based in Lahore and there is no one authentic then Lahore Real Estate . Would you please confirm or comment.

In August 20011 I was passing through main highway of DHA 8 I I saw one Bulldozer working in one deep patch apparently was leveling it without filling, though in the area as whole there was no signs of development. In Dec 2011 and April 2012 revisited the area and could not find any development or machinery laying in the area , i dont know why it was stooped, As it is only snapshot while passing from main road i cant further comment.

I would add something in April 2012 I saw many patches of Phase 8 Main Boulevard, cut by cutter. I failed to understand the reason of this work. However I regretted that beautifully laid road is being destroyed as possible no good planning was done at earlier stage and now possibly they recalled some important under ground work. However work was being done in nice way and I hope the road may be restored in its original state.

In April 2012 Patch work is completed of main boulevard of DHA Phase 8 and suddenly NLC engineers cabin have been placed in
DHA Lahore Phase 8 V Block.When I inquired them by parking my car on main raod.They said that they are going to start development work in next 15 days as machinery will reach the venue.At that time DHA also confirmed that Development is going to start and cabin are still there.Now DHA is saying that it will take further one or two months for the start of development work in DHA Phase 8.

E-11, E-12 n D-12 are already very well located within Islamabad and Margala Avenue connecting Islamabad to GT road will not have any considerable impact on these sectors.

Rather all the societies located near the point of intersection at GT road (somewhere between C-17 and B-17) will have a very strong positive impact because of a straight, direct, short and fast connectivity with Islamabad.

It will have tremendous positive impact on Sector D-12 and other adjoining Sectors as the peoples of KP Province, Wah, Taxila and Haripur as well as Norther Areas and Kashmir will be linked to Islamabad more closely in terms of distance and time.

The coummuters from that side will save atleast 30 minutes and 25 KMs to reach in heart of Islamabad.

Therefore rich and famous from that region would prefer to buy in D-12 more than any other sector in Islamabad as D-12 will be at the equal distance from all important places in Islamabad.

Also remember E-7 is most expensive Sector in developed area and D-12 has similar
location as well.

The prices will shoot up once the road work starts.

Agree with others - food and water are biggest threats for kids from aborad.
Use always your own home cooked food. you can make pasta for take out. use nestle bottled water.
buy grceries from good store like hyperstar in fortress - meat, chicken, fish etc.
always check expiry dates for food items, medicines.
UPS can be bought from metro or hyperstar store. I bought 1200 watt 24 volt AURORA with 2 x24 volt batteries from exide.
gas or petrol generators maybe be ok but are noisy and you need to turn them on / off.
bring kids medicines with you for temprature, cough, thorat infection, stomach ache, eye drops etc. get them vaccinated and tell their family doctor they r visiting pakistan so he will give the required shots.
would be good to personally know a doctor in lahore. overall good hospitals are very few, medicines can be fake and no one takes any responsibility. So, best option is not to get sick. --> no eating / drinknig outside for kids. if you visit family / friends, always take your kids food like pasta with you. better anoy your friends than get your kids sick.

You have mentioned about hyperstar. Can you please let me know price comparison of items from hyperstar and open market in lahore for things like generator, fridge, deep freezer, TV etc. Is it cheaper to buy from outside market or proces of hyperstart are comparable?

I am based outside Pakistan and I am planning to shift my family to Lahore and was looking at places for purchasing these items.

Not only a UPS even a smaller generator normally seen can not run air-conditioner and generally used for fans and energy saver bulbs. I believe you have imposed a lot of fear on your mind and you can not only suffer but may create frustration for the family here. it is better if you post open the trip and visit Pakistan when at least weather is pleasant otherwise by making ONE room is not going to make big difference. How one can sleep in a air-condition when the next door elderly family member's fan is got off

All that described by LHR above is myth not reality. There are good and bad things in all countries. The only thing that needs to be taken care is the "drinking water."

You should re-think on your plan and visit after september instead as the weather will be better and your kids are not school going. You are going to the same place where you were born and raised. so no fears...enjoy!

Hi All,

I have received a letter from urban developer Central Park Lahore that my plot in possessioned area & it's ready for construction & detail of some facility. Now they are forced to construct my plot asap, otherwise they have implement per day fine 30RS which were implemented since JAN 2012. Is any one else received same letter ? whats the possibel solution if i dont want to build house early, only purpose to hold this plot as i have buy this for my 2 daughters ( currently they are 7 & 5 years old ), at stage of their married i will gift them. Kindly your valuable suggestion is required. Should i hold till 18-20 year this plot or what else.

That is a new issue and is escalating with time, for last many years regulated societies were issuing no construction charges after possession is available, Usually it used to start 3 years after possession and was nominal, even DHA had been charging few thousands a year for Kanal plot. A new tradition is set by Bahria where these charges were increased out of proportion and I roughly remember a figure of 1.5 Lac per year if no construction is done after a certain period, DHA also stepped up and 3 years back for phase 1 to 3 , 55000 per kanal was imposed, [but remember that DHA imposed it after 30 ys of actual possession of DHA 1] now recently they increased for phase 4 where possession is available for about 13 to 15 years. LDA still is charging few thousands a year but there is no peace of mind .
Now hearing about Central park where actual population will not be seen earlier than 10 years, I think it is unjustified to impose these charges from the day of possession. I am afraid if you keep these plots about 20 years then not less than 1/3 of market price will be due as no construction penalty.[i am also taking into account future hike in such fine]
In past many societies were also giving discount on such charges but now every one is charging full amount.

one month ago, I was in their office to sell my plot and they levied same charges on me amounting Rs.7000.
I told them that they had not intimated me but they insisted and i had to give away.
I'm under the impression that they are in no mode of development and are forcing their customers to sell, this way they either buy back the file and get commission as well.
I think it is cheaper to buy back a file than to develop new plot.

i have plot in A block, i'm working in company with fixed salary & not have more budget to change better, so thats why decided a long term planning, as a salaried person with fixed salary & currently inflation it's impossibel for me if i have no saving after 15 to 20 years for my daughters thats the reasons of long planning.
