please explain if you have any logic to it.

Parkview Lahore Files replied on Thursday, September 15, 2011 09:21 PM PST

DHA dont have any land for Parkview
files. Before ballot of DHA 8 Parkview DHA need to buy land for it. DHA dont want to spend any money yet to buy land for all Parkview files so until DHA have land for PV files ballot cany be held.

Parkview Lahore Files replied on Friday, September 16, 2011 02:06 AM PST

That 800 kanal land cant accommodate 3000 plus
files holders of Parkview. That land on back of Paragon will be used for G and K block of Parkview non possession under litigation plot holders.

CVT and Stamp Duty Collection issue.

There is some ambiguity regarding Collection of CVT and Stamp Duty I would request respected members of Forum to share the experience , How they Deposited CVT and Stamp duty

I tell you my examles
in 2008 I Bought a plot in DHA they asked me to directly Deposit CVT to Bank and [Stamp duty was paid later buying Stamp papers and Crossing only after writing names and Plot Number] I think it is most reliable way

2 In 2008 Plot was bought in NFC2 Both CVT and stamp was taken as Cash by society office I have no proof how it was submitted to Govenment.

3. In 2011 Plot was bought in valancia and CVT was paid in State Bank and stamp papers were Purchased and crossed as in case of DHA.

4. LDA also took stamp duty just like DHA

Now my uestion is why some societies are or has been taking cash payment for CVT and stamp duty and how buyer can be sure that actually that duty was paid??
Recently I came to know that Tax dept has isses notices to certain societies to pay CVT and stamp duty, How tax Depts collect CVT/stamp Money directly from societies

Habib replied on Thursday, September 15, 2011 01:29 PM PST

Please also Notice the change in rates in time lime line pertaing to Collection of these taxes
There has been quite a quick change in CVT and stamp rules

1 in 2004 No CVT no Stamp

2 in 2006 CVT 2% no stamp

3.in 2008 CVT 2% Stamp 2%

4 In 2009 CVT 4% stamp 2%

5 In 2010 CVT 2% stamp 2%

6 in 2011 CVT 2% stamp 2% [but CVT due even 10 Merla and Above Plots and stamp duty on all plot sizes

For Rent
Lahore
Wapda Town
Dear All,
As salamu alaqum,

I have to write about a serious issue regarding rental of my house in Wapda Town, Lahore.
I gave it out on rent; on 1st January 2011, therefore the 11 months agreement will end on 30th Nov. This month when a went to collect the rent I gave my tendent a written notice for one month, I wanted him to sign the photocopy so that I have a receiving from him. He insisted that he would NOT sign the recipt of that notice. Moreover, he said that he could not vacate it in September. He would do so in October otherwise in November.

I am having some doubts that he will not even vacate in October, but the fact is I have to shift back to my place as soon as possible.

I am therefore seeking very serious and helpful advice how to resolve this issue amicably.

Dear CMY Sb,
If you could also comment on this issue, i believe it will be helpful for all readers.

Thanks alot.

Regards,
Asif.

MAS replied on Thursday, September 15, 2011 02:26 PM PST

Contracts are signed to be honored not to be breached without valid reason. You have committed to rent the house to him till end of November so why are you serving him notices to vacate early? Is he not paying the rent? Is he damaging the house? Is he making structural changes in the house without your permission?

There can be a termination clause in the rental contract which explains under what conditions the contract can be terminated by either party. Does the termination clause in your contract allow you to terminate the contract at any time without reason with just one month notice? If not then YOU are the one creating problem for your tenant.

You can give him notice to vacate upon completion of the contract period and if he continues to stay, then you can start the legal eviction process. If your tenant has agreed to vacate in October he is an exceptionally nice guy. My helpful advice to you is to go apologize to him.

Asif replied on Thursday, September 15, 2011 03:29 PM PST

Dear MAS,

I wouldn't be able to act upon your advice as the agreement has a clause for one month notice from either party.
If my tendent had wanted to vacate earlier, I wouldn't mind.
Regards,
Asif

comments on house plan

Please if you can comment on the attached plan which is draft only.

This is ground floor only of a corner plot of 61 x95 size. There will be no first floor ( may be in future) . Requirement is three bedrooms. With one additional guest bedroom which will be used very rarely ( that is why it is small). The north direction is from left to right. It is essential to keep 5 ft one side only and minimum 10 feet on front side only as per local laws.

You can see two staircases here. The plan is to have second unit on ist floor in future to be rented out.

Hope to have some useful comments before i go to the architect.

Regards,

ali11 replied on Wednesday, September 14, 2011 09:48 PM PST

strange design & its seems you have a strange requirement as well.

Brother replied on Wednesday, September 14, 2011 10:08 PM PST

Dear Faisal,
I am also going through designing phase of my house construction. During the process i was advised by a friend to have three distinct portions of your house ie FORMAL, SEMI FORMAL & PRIVATE. In formal area its your Drawing ,Dinning & Guest bed. In Semi formal area its your Lounge & Kitchen and in Private area comes your Bed rooms.Kindly see it for yourself whether your design meets this requirement.
Regards and best wishes.

faisal replied on Wednesday, September 14, 2011 10:28 PM PST

@ali, if you can elaborate on why it is a strange design, it will be great. I am curious enough.

@brother, yes it meets the requirment you mentioned very well.

ali11 replied on Wednesday, September 14, 2011 10:41 PM PST

my observations:

Try to move the lounge in the centre of the house. Then practically your house will feel bigger, right now its congested Corridor with a & stairs are eating lots of space. You already have access to back yard through kitchen. Redesign & Combine both walls of bedrooms, it will save some bucks in construction. Why you need a guest bed in front of the house with private access & also bathroom in front of the house!!!! that's ugly.

AG replied on Wednesday, September 14, 2011 11:22 PM PST

Dear Sir,

It is not a good design because,

1. Lounge is used as an Entrance Lobby as well. This is the place where family spends most of their time. People in the Lounge should be left undisturbed.
2. Guest room should be part of DD area. Guest should be able to use the DD without compromising the privacy of the house. In this design guest will walk through the lounge to the DD.
3. A lot of space is wasted in corridores.

My advice for you is to hire some good firm of Architects & give them your requirements. In Pakistan Architects, really, are not expensive & they do a good job. This will help you not to regeret after investing millions of rupees on your house otherwise people will say "Penny Wise - Pound Foolish"

Regards.

Guest replied on Thursday, September 15, 2011 04:49 AM PST

Dear very nice design.
Just one change which you may consider:

Recommended change:
Exchange Lounge area with (drawing/dinning) area, As you know most of the time family will be sitting in the lounge. and when the family is sitting in the lounge, they shall enjoy the beautiful view of the lawn with beautiful color flowers with green grass all the time.

Salam,
Guest

Khan replied on Thursday, September 15, 2011 07:13 AM PST

Some good suggestion mention above. Also cosider of switching kitchen with Lounge. This way kitchen will have cross ventilation and will be attached with DD.

ASK replied on Thursday, September 15, 2011 08:25 PM PST

What's missing here is a lobby. You have direct entrance into the lounge, which is not a good idea for reasons already suggested above. Your bathroom sizes are also a bit on the smaller size for a house this size, at least 2 of the bedrooms should have bigger baths.
Also you have to pass through the dining room to go into the drawing room which is again not a good idea.

AG replied on Thursday, September 15, 2011 09:01 PM PST

@Faisal.

Faisal Bhai you have a big, nice, corner plot. Pl. consider building 2 nos. double story (Back to Back) units with DD, Lounge, Kitchen & one bedroom on the ground floor & 3 bedrooms, servant room & a pantry on the 1st. floor.
You can complete foundation for both units but complete only one unit leaving the other to be completed in future.

Regards.

Income Tax on expatriates-Important Question

I need guidance and advice with regards to Income tax in Pakistan. All my career has been outside Pakistan and so have been all my earnings. I bought a property in D-12 Islamabad worth 70 lacs last year. there was additional Tax ( CST i think) around 2 lacs which i paid. I received a postal mail from Income tax deprtment directly at my local address in Pakistan refering to this purchase and asking me to open an income tax account in Pakistan since they dont have one under my name. Apparenly, they want me to be in the tax net in future.

My quesitons:

1. Is my foreign income in Pakistan taxable ? I dont have any earning in Pakistan.

2. Considering I always used legal channels to send remittance and bought this plot, does this exempt me from paying income tax ?

3. How should I reply to this letter ?

My point is that if I am not earning in Pakistan, why should I pay the income tax. But I am may be wrong so I would need advice from those who are aware of the rules or who have experienced the same.

Thanks,

Fisal

Habib replied on Wednesday, September 14, 2011 05:07 PM PST

Your foreign Income is not Taxable,
Your incomes on Bonds, stock, rent all Collective is taxable
You may need to decalre your assests If You open a Tax file
At present there is no wealth Tax in pakistan.
To satisfy Tax Dept You might have to show How 70 Lac Tansection took place that needs the evidence of Transfer of Money From Abroad.

For All Overseas Friends.
when buy a property in Pak always do transection by legal Channels ie Bank to Bank [no Hundi at all]
Keep a record of that Transection slip and Bank statement in Pakistan of that period.
Banks are not obliged to keep statement record More than 10 ys, and to obtain a Bank record older tha 3 years is also a headache asBanks's sofware continue changing every now and then

Habib replied on Wednesday, September 14, 2011 08:34 PM PST

yes if they asked you then you will have to but not necessily Tax is due, a Tax Consultant can guide you for that.
Minimum will be to send an official registered letter to the office who asked for Tax Returns, attach copies of evidence. This letter will be registered and in case of future issue will serve as reference that you officially replied the Tax Dept.

The advice from habib is valuable. The best thing is to get a recent tax advice from some tax professional.

This will cost you much may be couple of thousand rupees but it's worth considering latest rules and regulation

Though your post is regarding some corruption in the society management but I was glad to read ‘resident of chinar bagh’ from your post. Is it true? Is it a livable place now? Do all the facilities are available there? My plot is in Shaheen block, any construction/development there? Will appreciate your feed-back.
