related to post51797 regarding income tex return.
i worked as an engineer in govt org from 1990 to 1999 had ntn paied tex during that time from 1999 till now i am abroad during this time i bought some plots and a house in a society the money to buy these properties was sent through bank and by other means also.
i have 2 F/ACC in pakistan my questions are

1-since i have ntn so i have to file income tax for that period when i am out of pakistan almost 10 years?

2-for example during 10 y when i am abroad if i had bought properties but during this time i had transfered 50% by bank 50%by other means where i stand what are the best options and what are worst.

3-during my stay abroad i have no other source of income in pakistan except for some agriculturel land which my wife got from his father after his death almost 3 y before

This is the same situation thru which I had to pass. You should not worry. Visit income tax office whenever you come to Pakistan; usually you'll find them nice and cooperative. Explain to them your situation. I am sure you will get your work done quite easily. However, you should directly talk to the income tax officer and not to some agents or lower level employees. The later may mislead you, compel you to use illegal means and put you in trouble or inflict financial loss.

If you havent got any notice than no worries. Also, you are Non - resident and having a land dont require you to file a return so even you receive any notice it can be explained.

Agriculture income is also exempt so no problems.

If you have transfered money through means than it is worrisome but still if your have your account abroad and you can get salary certificate from your employer regarding salary even than can be managed.

zeeshan i have not recieved any kind of notice yet just trying to gues where i stand also wants to keep things straight even before recieving notice.
the reason to tell land was to know whether we can cover some thing to tell we have land too i mean a source of income.

ACCOUNT ABROAd? if you mean accounts in country where i live yes i have 2 accounts inthe country which are in operation also i have 2 forigen currency accounts in pakistan too. planing to go to pakistan this summer what should i do wait for notice or go to income office by myself?

i am not a salary person i am selfemployed so cannot have salary cert however will not mind to pay tex if i owe jast want guidence how to prceed.

Dear H,

I assume you are going to Pakistan for good thats why you are more worred. What you should do is to prepare a list of assets and liabilities as on now and also net worth (assets - liabilities) as on 1999 (the time when you went abroad). Calculate the amount of funds you sent to Pakistan (You can determine through your bank account). Most probably the difference in net worth before going from Pakistan and now should be the amount you remitted.

This explains the source of income. If you are self employed than must be maintaining accounts or profit and loss account, do keep of that with and if you have filed any tax return in the country you are living may also be helpful.

Legal status of Open Files

Dear CMY will you give an detailed account of Open Files.
Many scheme open File this is on one instance good for revival of real-estate sector but on the Other hand evasion in taxation system. what is legal status these days.
For the people who dont know I give the Basic detail, open File is issued by some housing societies when someone pays the seller but dont want to transfer the Plot in his name and keep on Paying some fees to Society office every 3 months to keep it up to date. Open File is like a Currency note and who ever have in hand is Holder of Plot there is no name mentioned on it. It is Like an open transfer letter the only difference is office of society is involved. It can be sold to 2nd or third person without involving the Housing scheme. In Past many housing schemes especially Bahria also issued many open files.
In general purchases on open files are not recommended and DHA, LDA and other well known names dont deal with open files.

In case of file owner's demise, the decedents of the owner can claim the plot, if the file remains open till such an eventuality.

I want to know one thing about Bahria Town, there are few plots available which they claim these would be directly transfer from Bahria Society and there will not be any transfer fee etc. Can anyone advice me with this, if it is not a scam.
Pay Order will be made in the name of Bahria Town, and the allotment letter will be received after couple of days.Then one can apply for possession and that will be given in a week time.
Is it all that simple?? And Bahria will not ask for any fee or anything and possession will be given. All will be happen in one lump sump price.
Can anyone please help me with this??

These plots are geniun without no issues. As they are directly transferred from behria so you will be first owner of the plot and there are less chances of frauds. Such plots are reletively cheap due to the absence of transfer charges.

Every time Bahria town need some cash in hurry they sell these mostly canceled plots via some selected dealer in market at lower price than their going market rates. I direct allotment letter is given to purchaser with no transfer costs. Dealers are happy from gains from discounted
prices. Buyers are happy they dont have to pay transfer costs and that their savings. Bahria is happy to get much needed cash in hurry to pay for salaries in a time when no one want to pay installments and new projects are hard to sell.

If you have not filed the return due to your employment income than ask your employer to give your certificate regarding salaried income and the tax deducted. How a NRP can fill the "Income Tax Return" and submit.

If you buy a car of 800cc you need NTN, once you got the NTN, Income Tax department start sending the letter & impose the Income Tax without knowing the income and where it come from.

Non - Resident Pakistani (NRP) having no Pakistan sourced income are not required to file a return of income in Pakistan. However, if due to certain purchase of assets it is mandatry to present NTN than you can get an NTN (Mention in the NTN appliocation that you are a Non - Resident pakistani) from FBR. Subsequently, they can e-file (By sitting outside Pakistan from FBR website) a NIL return 30 September of each year since they are not required to pay tax in Pakistan (If they dont have any Pakistani sourced income like rent, Profit on Bank depaoist etc.).

E-filing will help you to avoid any notice but even if you receive any notice just mention that you are NOn - Resident Pakistani.

Here it is important to mention that you should send your money through bank so as to prove that you remiited your foreign income.

Yes If you are getting Monthly income on some sources in Pakistan, You need to add them up and Pay tax on Total annual Income. It can be minimized by dividing that Deposit by names of your family members. This is by law but there is still no Fool proof system
On the Other hand If you are investing in capital Growth Scheme then You have not to pay Tax.
Basically this is a flaw in Taxation system, Deposit for Capital Growth and Monthly income is same If withholding is paid then income Tax should be exempted.

Dear Mr. Wajid
There is only one tax on bank deposits profit which is 10% and deducted by the Banks at the time of payment of profit. There is no other tax on this income. The said tax is full & final discharge of liability. If you have some other source of income, that would be seen separately and the profit on bank deposit has no concern with that profit. Mr. Jameel has confused your issue.

The FBR has just launched an Amnesty Scheme. The Notification says that this Scheme will apply to "all Pakistani citizens, wherever they may be" and will apply to all assets held overseas by them.

We, the Overseas Pakistanis who are citizens of UK, USA etc are bewildered that the FBR's Amnesty Scheme is asking us to pay 5% tax on our Bank Accounts and 3% tax on our homes. The FBR is forgetting that the so-called "Foreign Currency" accounts are in fact our "Home Currency" accounts. Similarly, our houses are located in our "Home" country. There is no need for us to declare those assets to FBR. Please see page 5 & 7 of the Gazette Notification where the wording is worrying to all of us.

There is an obvious ambiguity which is causing unease and panic. The FBR should clarify that the Dual Nationality holders are not required to declare their Bank Accounts and immovable property etc.

The Scheme is an Over-Kill. Instead of going after the cheats, the Scheme is going to create difficulties to honest overseas Pakistanis who pay their taxes to the Overseas governments. Under the Double Taxation Treaties, Pakistan cannot charge any tax on our accounts/properties.

A couple of questions.

1- I am living and working in UAE for last 7 years. Do I need to file Income Tax and Wealth Statement Returns?
2- Since I am living outside of Pakistan for last 7 years then do I need to show profit on my bank deposits in my income tax return? Withholding tax on these profits is already being deducted.
3- Do I need to show my property purchased in UAE in my wealth statement under Assets outside Pakistan? Is this column in wealth statement for Pakistanis living in Pakistan and have property aboard? or even Pakistani's living in UAE have to show these assets as well?
4- If the property in UAE is under my wife name then should it be mentioned in her wealth statement or mine wealth statement? as she is dependent on me. I purchased these assets in her name from my money

Filing of Income Tax Return by Non-Residents
This blog goes right into Importance of Filing Income Tax Return by Non-residents and Why Expats/ Non Residents Should File their Income Tax Return in Pakistan.

This very compliance comes with a lot of benefits of being a compliant taxpayer as non-resident person where you don’t have to pay any extra tax whereas you can save money on the other hand.

For your information Filing of Income Tax Return by Non-residents is not mandatory.

Who is Expatriate?
Expat tax in Pakistan is applicable on an individual’s residential status and it does not have anything to do with his/ her nationality.

If the total duration of stay by an Expatriates (in a tax year) in Pakistan is 183 days or more (01 July to 30th June). Then they are considered to be residents for tax purposes as per Tax laws in Pakistan.

Pakistanis (residents) are taxed on their global income regardless of where it is received or earned, while non-residents / expatriates are taxed on their income earned in Pakistan only.

Return Filing: Expatriates Non-Resident Pakistanis
Why it is important for expatriate Pakistanis to file their income tax return in Pakistan
Foreign income is exempt in Pakistan. If a return is filed, such income can be declared as exempt income.
What benefits a non-resident Pakistani/ Expatriate can get?
What benefits will non-resident get?
Some expats transfer their foreign remittance in Pakistan (bank accounts), this amount is invested in profit schemes with a goal of earning profits and so on.

For clarification, the expats are not exempt from taxes on income earned inside Pakistan as investments made in Pakistan are safest then anywhere else.

These investments made by expats earn profit/ interest and tax is deducted by the banks at a higher rate of expats/ non-residents being non-filers by virtue of recent amendments made in Income Tax Laws in Pakistan.

Non-resident Pakistanis tax return filing is not mandatory but if filed it can benefit the non-resident Pakistani to enjoy tax benefits.

So if you are a non-resident and at the same time a non-filer you will end up paying comparatively higher taxes then a filer. So a non-resident apart from enjoying exempt income (foreign remittance) also enjoys lesser rates of taxes applied on income earned inside Pakistan as being a filer non-resident.

Expatriate Pakistanis send foreign exchange and help improve economy. These Expatriates often invest in real estate, saving schemes, stock exchange, mutual funds and prize bonds.

Apart from these investment they also purchase vehicles and immovable properties. In order to make investments they also have to open bank accounts and make certain transactions.

As per tax laws in Pakistan (Income Tax Ordinance, 2001), any person who purchases a plot (he is not a filer), house or vehicle has to pay double amount of income tax at the time of purchase.

Moreover, if any person who invests in banking schemes, earns profit on debt and ends up paying comparatively more tax on such income as compared to “Filer”.

A “filer” is a person whose name exists on the Active Taxpayers List (ATL) by FBR.

Buying Property in Pakistan by Expatriate
If an expatriate/ non-resident
files tax return and is included in ATL (Active Taxpayers List) by FBR.

So if you are a filer you will receive all the benefits of being a filer in Pakistan and tax will be reduced by more than 50% and in some cases totally removed.

For instance, if someone buys a plot valuing Rupees 6 million, in case you’re a not a filer you will have to pay tax of Rs.240,000, but if you’re a filer, you will only pay Rupees 120,000.

Pakistani tax laws clearly state that every owner of a plot/land measuring more than 500 sq. yard or property owner is required to file income tax return.

Given the requirements/ rules if the tax return is not filed, this stands violations of Pakistani Tax Laws.

Ghazi-Barotha water supply project: Status pending, but not for long

ISLAMABAD: The government will help Capital Development Authority (CDA) implement its plan on provision of water from Ghazi Barotha Dam to the twin cities. Sources privy to the development told The Express Tribune that Prime Minister Yousuf Raza Gilani himself had assured the civic body of full support on the project.

“As per arrangements, the Economic Division in two months time will seek Expression of Interest through media advertisement from different multinational companies for the execution of the multi-billion project,” an official said, adding that the project will be executed entirely on a loan basis.

After its approval back in 2005, the project was marred by many controversies. The provinces’ concern in the matter, however, was the main stumbling block in its execution.

Upon being contacted, CDA Member Engineering, Abdul Jabbar Milano, confirmed the latest development.

He added that the water supply project was high on the priority list of CDA Chairperson Imtiaz Inayat Elahi, to overcome the “imminent water crisis in the federal capital.”
“Due to controversies, we could not add a single source of water to the existing water supply sources for the last many years,” he said. The water situation would further worsen after completion of construction work of five stars hotels, business centres and new sectors, he added.
At present, Simly Dam on River Soan, Khanpur Dam on River Korang and tube wells provide water to Islamabad.

Sanaullah Baloch, an official in Water Management wing of CDA, told The Express Tribune that the project was in doldrums since 2006 when the provinces raised their concern, due to which, later on the federal government dropped the issue.

Originally a Rs22 billion project (in 2005), the same project will now cost around Rs50 billion for completion, he added.
“If the project is executed, in the first phase alone, 100 million gallons each will be supplied to both Islamabad and Rawalpindi,” Baloch said.
The project also includes construction of filtration plants, small reservoirs and two water tunnels. Thus, CDA would be able to provide water to the residents of Islamabad at their “doorsteps around the clock at subsidised rates”, he said.

Milano said the construction work of the project will be awarded through International Competitive Bidding process as per the procedure of the government, after completion of the studies, codal formalities and arrangements of funds.

Not a sudden development CDA has been trying to get the project off ground for quite some time now. Back in October, at a ceremony held in CDA Directorate, CDA chairperson had said that the authority had signed a memorandum of understanding (MoU) with a private Chinese firm to review the feasibility study of the project.

The MoU was signed between CDA and Sinohydro Corporation Limited, a Chinese central government-owned company to review the feasibility study for conduction of water from Indus River System at Haripur/Siran pocket site of Tarbela Dam to Islamabad and Rawalpindi free-of-charge.
