Is it permissible to call someone on umrah with money of Zakat? Obviously close reletives are not allowed but how about if someone who cannot afford to come and perform umrah and I sponsir all his expenses from my zakat?

Question

There is a female (housemaid) who deserves zakat and is desirous to perform Umrah. Can she be given zakat if she intends to arrange a trip of Umrah for herself from the ZAKAT money. Jazak Allah
Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

It is not permissible to pay Zakaah to anyone else other than the eight categories of people who are mentioned in the Quran and whom we clarified in Fataawa 86546 and 88368.

Therefore, if the mentioned maid is among the eight categories of people [who are mentioned in the above Fataawa], it is permissible to pay Zakaah to her and she is entitled to dispose of it as she wishes: she may spend it in going for ‘Umrah, or on her needs of life and the like.

I know, web Fatwa is not always 100% accurate because you do not know the Aalim personally but I've same sort of above question:

I've widowed cousin whos husband died last year and deceased didn't leave enough money for his widow and children for their survival but couple of Lac for his widow and three Orphan children who are still studying.

Can I keep/save my yearly approximate Zakat of two years or so & then can buy a small plot/house for her & her kids in a property scheme according to the sum of that Zakat money?

I know I'm not asking you a 100% Fatwa for that but just discussing you Muslim guys who could have more Zakat knowledge than me or who might have done it already or have seen someone doing the same.

My only concern is that I know her personally her living circumstance as she is my close relative / sister cousin and I'm sure Zakat should deserved to close relatives first, then in neighbourhood and then far Muslim brother / sisters. Isn't it?

Would really appreciate your comments on this.

I do agree with you that web Fatwa is not always 100% ACCURATE but in order to verify the accuracy we need to do some research by ourselves from authentic books and scholars. Anyhow, in order to get some knowledge, you can refer the following Fatwa:

To proceed: My younger brother is just a regular employee, he is not married yet and he still lives with my father. He just started to build himself a house on his own, with my father's help from time to time (as much as he can), and I have given my brother some money to help him finish building the house.

My question: Would it be permissible for me to consider this money to be part of the zakat that I have to pay? Or do I just have to help my brother and not consider this help as part of the obligatory zakat? Note that the monthly salary that my brother gets is limited and that for him to build a house, relying only on that salary, would take years. Please advise and may Allah bless you.

Fatwa : In the name of Allah, the Beneficent, the Merciful,

All praise is due to Allah and may peace and blessing be upon the Messenger of Allah, his family, companions and true followers. To proceed:

Giving zakat to a poor brother whose income is insufficient is lawful and we hope that whoever does that will receive two rewards: the reward for paying zakat and the reward for maintaining family ties, insha'Allah. However, attention must be called to the fact that favoritism [giving to one person at the expense of others in need] is not permissible in regards to zakat, nor is it permissible for someone who pays zakat to protect his wealth with charity. If owning a home is considered an exigent need or a clear necessity in certain cases, it would be permissible to provide assistance with that from zakat money, but if one could do without that by renting (and this includes the vast majority of people) and if spending zakat money in home ownership would use up most of its funds, narrowing thereby the circle of benefit and being unfair to the rights of others in need, then spending zakat money on that would be a question which warrants further investigation. The closest opinion and the most appropriate in terms of proper management of zakat funds would be just to help with rent, in order to broaden the range of benefit from zakat and not restrict it to closed circles, depriving the vast majority of people from benefiting from it.

And Allah Almighty is the Most Exalted and He knows best.

Note: personally, I asked the same question to one Scholar in Saudi Arabia, he advised me Zakaat money cannot be given to construct the house(I gave money to my brother for house construction and accounted it as Zakaat paid).

I am not an authority on Islam - but i feel using "COMMON SENSE" can help

if someone deserves a ZAKAT - it means he can not fulfil his humanly needs (eating,clothing,housing - to him and his family members). This person - who is so - incapable of doing this very basic function of life - neither HAJJ nor UMARAH is valid for him (I mean he should not do it) - now - if he gets money as ZAKAT - he should Only ful-fill his basic requirements. Now - if after taking zakat - he becomes someone - who now can fullfill his Humanly duties and has enough savings - then he may perform HAJJ or UMARAH

i hope - i was able ot put some sense to what has been said here - all are free to Disagree

I am a keen reader of this forum and find it very helpful due to its independent and open nature. I live in UK and want to invest some money in DHA lahore. My amount is around Rs. 40lacs.
I want to know is it better to buy a 10 marla plot in phase 8 on instalments or DHA town phase 9 where development is started as per forum info? I want to invest for 5 years and doesn't have any intentions to build it. 2ndly, if anybody knows that DHA town phase 9 is available on instalments as well? I don't want to invest in files.

I will appreciate any input.

Location of 10 marla plots in DHA 8 is very bad. Think about other options in DHA 8.

in 40 lac u could buy a good
location plot in phase 7 which gave u good return after 5 years dt dnt even think to invest in phase 9 becuz its very long ter investment price is already artificial

10 marla plots in DHA 8 are located in "Y" block only and this area is separated from DHA8 other blocks and also has very deep dent in land. As Amir suggested you to invest in good
location plot of DHA7 or DHA Town phase 9 is a good option also.

You can get possession of your plot in DHA 9 Town next year Insha Allah but development in DHA8 not yet started.

You need to be more specific about your objectives. Will you be visiting it every year, or never. What are your arrangements for payment of bills and taxes. Don't you have any person/relative who can visit it once in a while. Suppose there is a leakage due to rain. Your question does not say what are you talking about? There are many people who live abroad and have there houses back in Pakistan. It is no big deal.Make your questions more specific.

Saeed, If you have a servant quarter, I would highly hiring someone reliable to live and take care of it. I have done it and feel safe about my investment. Additionally you can ask a relative to visit it once a while.

If the house is something you will use at least once a year or more than keeping it for yourself is a good idea. If however you don't intend to visit there often, renting to some one decent is also good, but there is ware and tear with renting, which you should consider. If generating income from the house is not an issue then i believe hiring some servant is a good option. Good luck!

Mr Khan, Rashid and KS thank you for your responses.
Mr Khan: Yes, I and my family will be visiting the house at least once a year. There are a couple of relatives who also live nearby and can visit my house occassionally. I agree with KS that renting will cause some wear and tear but having a servant will cost money as well and God knows relying on a servant is not safer than relying on a tenant with a family. I am not keen to collect rent and only want physical protection of the house both inside and out. So its a bit complicated decision to make.

Saeed bhai, Servant will cost around 13-15K monthly, which I believe is a fair amount to pay for full-time care of the house. Most people pay 8-9K for servants in Islamabad area but they provide food on top of that.

My advice is to pay top salary, so that you are not stranded by your servant in case he find someones else to pay an additional couple thousand ruppees.

Alternatively Khan bhai's suggestion is just as good. Compare the cost of the two, pros/cons and make you selection.

I raher have some trusted worker living there than be empty, even for a few days.

LAHORE, May 3: A Lahore Development Authority team succeeded on Thursday in retrieving nearly 250-kanal land falling under the LDA Avenue-1 residential scheme on Raiwind Road after facing a day-long resistance from ‘illegal occupants’ that led to injuries to over a dozen people, including a deputy superintendent of police.

The land occupants carrying sticks attacked the LDA team, led by Additional Director General (headquarters) Ms Marium Kayani, when it reached the site along with police. The occupants thrashed the Chuhng police DSP and some LDA officials
besides manhandling Ms Kayani. Police in return also gave them a thrashing.

Ms Kayani, who was mobbed by some women, also thrashed one of the attackers in self-defence.

“I acted in self-defence when a woman got hold of my shawl and tried to drag me,” she told Dawn.

The angry protesters chanted slogans against the LDA and the Punjab government for ejecting them illegally and forcibly from the land owned by them for long. They alleged the LDA team had got possession of their land forcibly despite the fact they had already refused to surrender their land at the time of LDA Avenue-1 launch over a decade ago.Despite heavy aerial firing, manhandling and stone pelting, the LDA operation continued for over eight hours.

The day-long scuffles left several protesters and officials injured, including special judicial magistrate Bushra Naseer, three women constables, a DSP and two other LDA officials.

Giving details, Ms Kayani said the LDA had announced this scheme in the year 2002 in the public interest and acquired land under the Land Acquisition Act. She said though a majority of the land owners had already received compensation for their
surrendered land, there were some who were yet to give possession of their land to the LDA despite the fact their land had already been acquired and the requisite compensatory amounts/money had been deposited with the bank for disbursing
among them.

When asked why the LDA had ejected the occupants from their land forcibly, she said under the law the land they were in possession had become LDA property after it announced the launch of Avenue-I scheme under the Land Acquisition Act.

She said it was the right of the government under the law to decide whatever in public interest whether through developing residential schemes or any other activity.

She said prior to this operation, the LDA had failed to retrieve land from the occupants on three occasions. She said the LDA had allotted plots to 2,800 applicants in this scheme and a number of them were waiting for the possession of their land.

She said there were also some pieces of land at this scheme that were yet to be retrieved from illegal occupants.

“We will resume this operation for retrieving the remaining land under illegal possession,” she said.

Meanwhile, on an application of the LDA, the Chuhng police have registered a case against 10 people, besides arresting six of them, for quarrelling with government officials and disrupting the official work.

GRACE PERIOD: The LDA team meanwhile offered a grace period of three days to the occupants of another piece of land measuring seven kanals.

As per the written agreement between the two parties in this regard, staff of the revenue department as well as the LDA will jointly determine the status of the said piece of land and decide whether it was a part of the land already acquired by the LDA for the scheme. In case of its being the part of the scheme, the illegal occupants will be bound to demolish the construction themselves within three days failing which the LDA will do the needful.

INQUIRY: Commissioner Jawad Rafique Malik took serious notice of thrashing of a woman protester by LDA ADG (Headquarters) Ms Marium Kayani. The commissioner directed Lahore DCO/LDA Chairman Noorul Amin Mengal and LDA Director General Ahad Cheema to initiate an inquiry against Ms Marium Kayani and submit a fact-finding report to him within 24 hours.

Good news for lda avenue legitimate plot owners. The time is now to buy in lda avenue 1. But i think people who are holding plots for such a long time will keep on holding so that they can reap maximum benefit from their property.

i think it is a good work by lda estb. the illegal land grabbers thrive under influentials and false sense of sympathy they tend to derive by shielding behind women. such illegal occupants must not be spared. welldone LDA and keep up the good work

Land owners are still living there.

I grew to old from young with my plot in E-12.

But don't loose your hope as hope keeps a man alive.

When developed it will be a best sector but if ever developed.

very difficult for cda to develop this sector because clear decision of S.court for compensation of land and build up property on market rete at present cda have not money even for giving salary to there employees

There's no
update on that apart from misconceptions. I read a news few weeks back about fake E-12 plot files and registrations. So first of all getting the legal registration is difficult, secondly, there's no authentic reasons for its development in near future.
